We know only she owned the bungalow, and he did not have a joint bank account with her (again from my mother as recently as February this year and from my birthday check the same month in her sole name). Mum told me that she simply gave him and his wife her bank card and pin number when she stopped going out. My mum also told me Aunty said she had lent "thousands" to the wife over the years, not a penny paid back! Oh to have been a fly on the wall. I have one more question, which I think I already know the answer to. I now know that the son is the executor. Can anyone confirm that there is no way he can administer this will with applying for probate is there? I am going to pay for a Caveat to be entered ready for when he applies for probate. My female cousin may be being treated badly (and she has confided in me that she feels the abuse will not stop for her until this matter is resolved, and she can have final , being treated like this will be the final act of cruelty against her by her mother) and I may not be able to do anything about that, but by goodness I can make sure my poor old mum gets what her sister wanted her to have. And yes Mr P, there is most certainly a will. Aunt used to tell my mother everything, they were so close. And Aunt has thrown it in her daughters face over the year's as well. Of course, without seeing the will I wouldn't know who the executors were. Can you be an executor as well as a beneficiary? If so, it'll be the son. He was the only thing that mattered in her life.

A bit of a story but I am very worried about something. On 21st April 2017 my aunt passed away. She had a son and a daughter (my cousins). She treated her daughter very cruelly all her childhood, whilst favouring the son and at 16 dtr left home, cut most ties, several attempts over years to put things right, no joy. Dtr now happy, loved, housed, and fed, all by her own hand and pure hardwork lol. However, the son is dishonest, used to thieve off his employers, and steal out of his mother's purse. He then set up a business with his sons and has been bankrupt three times (although as far as we know not currently bankrupt). Aunty has left a property worth nearly £500,000, and she was also rather cash rich. Now, my mother and Aunty used to sit and joke about the little nest egg she had left my mum . Mum used to say she was going to give it to the Donkey Sanctuary, and Aunty said at least some good would come of it. Dtr also confirms that on the one occasion when she challenged her mother about the sheer injustice of all this (after all father had TWO children and had he not died at 47 Aunt wouldn't be in the wealthy position she was when she went) was told emphatically "everything to go to son outright, except a bit of money for you, my sister and her daughter. I have only left you money so that you don't try and contest the will and ruin your brother's life!" Aunt also told my mother this several times. Over the last 8 years or so Aunty became more housebound so her son and his wife took over her care and control of her bank account (although not by power of attorney). I know all this from my mother. Moving onto June 2017, my mum died unexpectedly. She was not a wealthy lady at all. I was able to give her the send off she deserved, and I asked for donations to the Donkey Sanctuary. Well, in doing this it reminded me about Aunt's will, and I thought, well if probate has been granted, then I could look at the Will (becomes a public document then?). And do what mum wanted with whatever she had been left. I really cannot imagine I would have been left anything much because my Aunt helped me out so much when I was a kid. But when I look at the Probate thing on line, they haven't registered it. Now, I told my cousin (dtr) about this, and she says "of course he hasn't applied for probate yet, he wants to empty his mother's bank account first, he is not a suitable person to deal with the estate. he is extremely sly and dishonest". Is there anything I can do here? I think my mum was left a small amount of cash, I would like to have that sent to the Donkey Sanctuary as per her wishes, but I suspect my cousin (son) is not applying for probate yet so he can continue to use the cash in my Aunt's bank account, just as if she were still with us. This cannot be right can it? I do not speak to him, and will not be speaking to him. On another note, I really feel for my cousin (dtr). She truly had an awful life with her mother. This is all confirmed by my own mother. And the things I have had to listen to from my cousin, its heart breaking. It was outright child abuse. My late Uncle (who adored his daughter) got early onset dementia and died when he was 47 . He was in a highly paid position with a fuel company, the house was paid off and Aunt received his very generous pension and all the rights that went with that until she died at 87. I feel that my cousin (dtr) should have an equal share in this, and I wonder, does she have any grounds to contest this Will, whenever we get to see what is in it? I do hope someone can help us out here, neither of us have ever had to deal with anything like this, and the first time we try to, it seems full of dishonesty and unfairness! Hi Bazza, I just wanted to update you quickly, its been a while. I had another Blue Clinic apt, AFTER my podiatrist had extracted most of the infected bone and was happy the infection would now be gone very shortly. He actually warned me that they would still want the toe off for "financial" reasons, whilst he would prefer me to see him for a few more sessions, as he could get that last piece out, and that would solve it. He told me to stand my ground. So, off I went, got told I was up for the chop, had a bit of a **** fit, and was told to think about it, and go back in a month. In that month the podiatrist got the bone out, stopped the antibiotics, gentle tentative walking, shoes (EEEEE fitting) on for an hour a day. Went back to the Blue clinic, saw the head honcho this time, who praised the podiatrist for saving my toe! I have to go back in 6 months, but I think I'll be alright now, with a few visits to my podiatrist to make sure everything is ok. Thank you ever so much for explaining all this too me when I was so distressed - everything you said turned out to be true!

Got through the Blue Clinic. Now have to have MRI scan on foot but even I could see it looked a bit misshapen. The Dr who saw me rea;lised how upset I was and was very kind, and insisted he wanted to hear how this has been affecting my life. Then it was off for redressing (GP taking blood for me another major blooming issue at surgery Thurs AM) and by this point I was done for so my dear old mum just told the nurse that she would would redress the toe under her supervision, so that the nurse wouldn't have to have a bad day! I phoned the clinic where my podiatrist is as he asked me to ring to let him know what had gone on. The receptionist let slip that there is a multi-disciplinary meeting on 11 May 2017 (I've not been invited so god knows whats going on now). So that's very muc h like you described in one of your posts above. Had a GP telephone consultation today to get the blood test sorted. By now my GP has probably had Blue Clinic notes, and knows that it was very difficult for me. He was very nice and wants me to come and see him as he realises how depressed this is all making me, and a watch has to be kept on my mental health as well.. He has put me on the list for physio to deal with the sciatica on the other side, bearing in mind the restrictions the toe causes. Well that's where we are, I feel like back to square one but hey ho gotta keep going. Thank you for all your support.

Seen the podiatrist today, had a tiny fragment of bone removed again, bloody agony, my elderly mother now has badly bruised upper arms where I had to grip her. I am in shock. But never mind, its done, and pink and granular were both mentioned in a good way. For anyone who wants to doubt your advice, my podiatrist agrees with your advice word for word. Just Friday and the Blue Clinic but its not Friday yet. Confined to barracks except emergencies for another 4 weeks.

Well you certainly helped me understand what two vascular surgeons and a GP didnlt! So I am listening to you and the podiatrist. I will post up what happens, after Friday.

I am not diabetic, my dad was, its the type 1 and all his 7 siblings had it, none of their children had it, some of the grandchildren developed it, no great grandchildren have it yet. Well, you know what, my podiatrist is really the only person who has paid any attention to this and I think he has already yelled from the rafters. Hence the GP's getting me these appts. But I will show him this tomorrow, The though of amputation of anything is horrific to me and is actually keeping me awake at night. It is the little toe on my right foot, on top of the toe, and the podiatrist has had to do unspeakable things to it with a scalpel whilst I practically break my 77 year old mother's very frail wrist. I feel like marching into my doctor and demanding to have things explained to me in future in just the way you have. I wonder if you lecture?

Thank you BazzaS. My podiatrist is coming to my home tomorrow to do some treatment, I'll ask him all of this. You see, where I had been told to walk I was trying to avoid the ulcer so I was walking weightbearing on my big toe. If that makes sense. I have a letter now an urgent apt with orthopaedics on Friday morning. I am absolutely terrified of anything medical, and its not just a case of "oh I am frightened" its to do with the PTSD, and I feel my GP was wrong right at the start not to look at that toe and palm me off with anti-depressants. My stay in March in hospital for the week was so traumatic too my silly brain that a lot of its been blanked out. But I know I was in a dreadful state mentally. I was diagnosed with sciatica in October 2009. At the local hospital. With physio and hardwork I got myself ove rit as much as one can by walking mainly, a hobby anyway. I was left with drop foot but managed that with step ups in my shoes. In 2015 it started to become a real problem again, or so I thought. This time it was preventing me from walking properly. I went to the GP who referred me for physio and I was given exercises to do, including pushups which really seemed to help on the left side where the sciatica was, but my right leg was getting more and more painful. I was then referred to a sports psychotherapist via the GP who gave me a talking to about "analysing too much" especially when I told her my dad had died from blocked arteries and I was sure I had this. in my right leg. Then they sent me to the back pain clinic where I collapsed with pain. Now something weird strarted happening to me, it felt like I had a cut or blister on my right little toe, but there was nothing there.. In the end I was trying to walk my dog in my partners size 9 trainers (I am a 6) and even this became impossible. I went back to the doctors and instead of look at my toe, she put me on amilitryptyline. It just so happened that mum was having her feet treated by her podiatrist so I asked him if he could see anything wrong with my toe. and when I put my foot on the floor he got very excited a nd told me I needed an immediate Doppler test as he could see I had hardly any circulation to the toe and that was causing the pain. It was also very serious. A few days after this the doctor invited me to have a Doppler test. s The nurse refused to let me leave the surgery until she had seen a doctor with my results, the DR (this was a Friday afternoon) tried to get me an immediate MRI scan. The earliest was Tuesday which I duly had, I saw the vascular surgeon the next week and the week after that I had a serious blockage removed from an artery in my right leg. When I came round, although the pain was gone my toe was now covered in a huge black scab. I was in for a week, nobody even looked at the scab til the last day when the head honcho on ward rounds, and to discharge me just said to "keep soaking iti and applying scholl products, and that pink healthy skin would reappear as the toe was "viable". When I got home, (with a special soft boot for my right foot as I still could not get shoes on) I rested for a fortnight as told, soaking the foot everyday. I got a blood clot in my leg. So then I had to take the superdrug to get rid of that. Now every health professional I saw, including my GP as he was being fed info from the vacscular surgeon, told me to get out and walk on that leg. Which I did, I was so proud when I could do 2 miles without stopping. I went to Rotterdam and Amsterdam. Mind you I had to tell the GP that my toe kept getting infected. And so he asked me to see his nurses 2 x a week and they were to report on it to him. The first nurse kept saying soak and keep walking no dressing required. After a couple of weeks of this the 2nd nurse was on duty, she used to work on a vascular ward and informed me that the toe needed to be kept permanenelty covered with Iodine patches and dressings. Now, I cannot do this myself. the sciatica on the other side prevents me from either getting down to the right toe or raising my right leg to the bed or a chair. It was also painful enough to make me scream in agony whenever they touched it. In then end they just gave me some dressings and told me to get on with it. My mum had to do her best for me three times a week and is still doing this today I saw the surgeoun for sign off in November and I showed him this mess on my toe. He just said my leg was fine (Doppler and warmth) and said I needed podiatry services. Due to age and not being diabetic I don't qualify for them. However, I'm not sure what has gone on but I am now having my podiatry services. The surgeon told me to keep on walking even after he saw that ulcer. Right now, fast forward to January 2017 and I had my first appt with the loveliest podiatrist you could ever wish to meet. And he is very unhappy and annoyed at they way I have been treated. He says that since the op I should have been offered podiatry services straightaway because my toe was black. Apparently there are things that could have been prescribed to help me. He says I should never have been allowed to walk until the toe had healed, everytime I take a step I break away any new skin trying to form. He is having to keep me on permanenet antibiotics, which the GP has just tripled, an urgent Xray and swab has been taken. THE GP rang me to say they could see the infection which is now in my bone, and also that there is a loose slither of bone. At the same time, because I have h d to stay off the foot since January my sciatica has flared up so I can't get to the loo without help and all that jazz. I fee lthat at 54 I didn't have the year to waste that I just have, I am angry and in a lot of paIN. I am a serious hiker amd I miss it so much and I don't believe I'll ever do it Again. I am also a PTSD sufferer and walking in the sticks with my dog on a bad day was my way of dealing with it. So now I am like an adder as well. # Should I be complainiing to someone and who? We suspect my mobility will now be permanently affected. Sorry for the long post. Grateful for any advice or pointers.

We know now it has nothing to do with my rtb over 30 years ago. We had an opportunity to speak with a London based conveyancer last night, a friend of a friend. She said that in 80,s there was an awful problem with people buying under RTB and then being unable to make their payments through the recession, and the council having to house them again. Also that the council's rarely if ever actually Checked to see who was behind the application, just took it as read. On into the 90,s and they had to be more shrewd because of money laundering g etc. She also said that the council are building a profile of wayne. Now this is where I struggle, because surely to build a proper and accurate Profile of some one you have to have the full picture. They have only questioned him about the two court entries, but not about his income or all the savings he has. She said also that because Wayne said he had no credit agreements on the form, they might try to say he has made a fraudulent application. I heard his answer them when asked if he had any credit agreement he said "no, I don't have any HP, no credit cards, even the car was paid for outright". SO this is his understanding of credit agreement. She has told us that the Halifax court entry is time barred and that this can easily be removed. The other one should now be disputed. I will get on with the court things, as regardless of what is going on they should be sorted out. But nowhere can I find anything to read which sets all this out and explains what our rights are when things like this happen? It seems this could happen to anyone and we have been quite frightened by it, so all of this might help others out there. Is it right that someone exercising a right should be made to feel frightened at the reaction they get from the other side? And thank you for input Mariner. Wayne has ,worked hard to turn this place from a shell into a home over the years. He has also worked very hard to save enough money to go through with this purchase. there is no way he could buy a property on the market here in Poole. This is his home and he wishes to make that permanent. I agree it depletes social housing stock, but then the gov need to do something about that. this is about Wayne exercising g his right to buy and not the politics of it. and if from now on everytime someone applies to buy their home, they are going to have to be prepared to being treated like a fraudster, then there needs to be information on that somewhere. WELL CB wayne got very cross with them on the phone and told them they were doing this because they w were slowly being asset stripped. IT CAN only be that they are trying to protect their stock. But Wayne genuinely feels he has been bullied in a way, he is really upset about this. I really don't, know what to do next.

I have read through the links that Stu provided, and they are using para 11 Sch 5 Hsg Act 1985. I am going to read this bit of the act in a minute, but so far I have seen nothing that would refer to small debts like this only bankruptcy which doesn't apply. However, there is another section 125 to do with delay. It seems that if the Council fail to issue RTB2 either admitting or refusing your right to buy within 4 weeks of your application,thereby causing unnecessary delay, you can start this procedure and it involves them then having to deduct all the extra rent you had to pay from the price of the property. Well,they issued RTB2 on 2.6.2016, and this as within the 4 weeks. However have they coCked up beçause they have not issued us a refusal notice within the 4 weeks? Waynè has spoken to them yesterday, and they just say they are going to issue a letter refusing his RTB. a Any help at this stage would be great. We are fed up with this council, first we are accused of drug use, and now this. Good job we are not paranoid or perhaps we should be.

Thank you Stuart. Well it looks like we do have a problem. Wayne received a letter from these Fraud people yesterday telling him that if he wished to have the right to buy, he has to deal with these two small debts and provide them with full details of the debts. We were a bit confused because on checkING through the paperwork he found that they have actually admitted his right to buy on form RTB2. Wayne rang the Council today,and they say that they are going to decline his right to buy on the grounds of these two debts. Is this right? The mortgage broker he is going to use is not bothered about these two debts. The Council told Wayne that this is all part of fraud prevention. How can Wayne having 2 smaĺl debts in anyway constitute a fraud, and are the Council acting correctlý? Many thanks for reading.

I hope I am posting in the right place. Wayne has been the sole tenant of this little flat for 18 years. We are not married, but do live together. I have never been on the tenancy. I am on the electoral roll (the bit that is private) and the Council Tax know I am here because Wayne had to write to them back along to give up his single person occupancy discount. Wayne applied to buy his flat back in February, and an energy surveyor has already been. He had a letter to tell him that the District Valuer will contact him to make an appointment. RTB2 admitting his Right to Buy has not yet been received. He has been to a broker and he will arrange a mortgage for Wayne, even though Wayne has two small debts that have been registered. These are $501 to Halifax Building Society (now through a debt collection agency). He closed his account in 2007 and unbeknown to him they added bank charges. Over the years they have added up to this amount. Wayne refuses to pay this. They entered a note on his credit file in 2012! And about 9 years ago he had a load from Provident. He handed over the payments regularly, but rarely saw his book. It was always "being updated by Head Office". Then the agent left and Provident came knocking after the money that she had pocketed! Wayne went mad and actually went and had a go at the thief at her other job in a shop, in front of her manager. He never heard from them again, but then when he had his credit check done by the broker, both came up,. Last Monday Wayne was at work, there was a hammering at the door. I opened the door to a burly great bloke and an official looking lady. They asked where Wayne was and I told them he was at work. The man said they were from the Council´s investigation team and they were investigating fraud? I told them they needed to speak to Wayne as it was nothing to do with me. Wayne duly spoke to them, and the lady told him that every time an RTB application was received, they had to investigate the applicant to help prevent fraud. She arranged to call back on Friday, today. She turned up with the same gentleman as before. The first thing the man said was "we have credit checked you and found two debts, and this may prevent your application to buy from being approved!", Wayne looked at me in surprise, so I simply said the mortgage broker said this wasn´t a problem, and I cannot see how this can affect his Right to Buy and in any case Wayne has argued these two debts and he will Tell you about them. The man accused me of being aggressive! Anyway we got past that bit and he denied that he said this! He was asked a series of questions, showed his passport as ID, had his photo taken. The last question before they left, was "have you ever benefitted from the RTB discount before?" Wayne answered honestly "no". The man said "if you are absolutely sure that you have answered honestly ... pause... then please sign this form". Wayne signed. Now, in 1984 I bought my Council flat from this Council under the RTB scheme. Years down the line I sold it and bought another property with my then partner. We split up and the property was sold. Shortly after that in 2006 I met Wayne and we´ve been an item ever since. (I can´t say "girlfriend and "boyfriend" I am 54 and it just doesn´´t sound right!). I am not anything to do with this application, it´s Wayne´s. We are not married and like anyone else we could split up in the future. Without wanting to sound mercenary, I have an elderly aunt/godmother with a house in the New Forest who has not long to go and I am a beneficiary of her will, and I want to buy my own place when the time comes. Therefore I will not benefit from this, Wayne has a much younger brother with learning difficulties and he wants to leave it to him. I am very worried that they are going to stop his RTB because I have already had an RTB before. I´m pretty certain they can´t because we are not married. The other thing was they asked NOK - well, his mother is bonkers, as is his younger brother and his older brother Albert, he rarely sees. So he said me. I´ve told him to ring them and get that changed to Albert. Sorry for long post, but lots went on today! Can anyone see any pit falls here? This is just a case of a long term tenant wanting to exercise his RTB. Can they really stop this because his "girlfriend" had RTB before?

Ok chaps, here I am back and fighting fit! I actually had to spend time in hopsital due to the clot. Ni sooner had it gone and I came home I got. another one. Iam declared 100% fit now by the hospital. Right, so the file arrived and I went through it with a tooth comb. I found a report from the gas company to PHP and it stated that the gas engineer had smelt a peculiar smell in our boiler cupboard, felt unwell anyway and this tipped him over the edge. He said he wondered if it might be cannabis. He said that we looked "stoned". Oh dear oh dear. So we pointed out to PHP that I had taken 10mg of diazepam that morning to be able to cope with the scanner, and that neither of us had had any proper sleep for over two weeks and it showed in Wayne in particular because he´d had to go to work as well so was exhausted. We asked what qualifications the gas engineer had that enabled him to make the decision that we were "stoned" We pointed out that they told us we were accused of smoking cannabis in the property when in fact the gas engineer hadn´t said that. We also noticed that the gas company are now suggesting that, because Wayne went to their office to hand in the letter of complaint, they can no longer let this engineer work in our little Close for his own safety! The only thing we can find on the file with any reference to drugs is that a downstairs neighbour´s visiting 13 year old daughter, said she had smelt "drugs" in the street around our flats. She told her mum and she wasn´t allowed to visit again until her dad had "sorted" it. He apparently told the Council about it, and they just made a note on each tenants file about this (we can see which other flats they put a copy on) This was a general matter and we were not accused of anything. There is nothing else on file about drugs at all, so this must be the "previous matter" they referred to. So, we wrote them a letter putting these points to them, and saying that if this was not looked at again by someone else we would be putting in a formal complaint. 8 days later we got a letter from a manager apologising, confirming that it would be deleted from our records. Also confirming that they would tell the gas company the outcome of this complaint. They also confirmed that the mention of the "smells of drugs" in the street some years ago was nothing to do with us, and that the HO was wrong to use this as her evidence alone. So we are pleased that this is over and we have been listened to. . We could I suppose take it further over the personal remarks made by the gas engineer, but do you know, I can´t be bothered! We hadnñt done what they accused us of and we are happy that they have acknowledged their error. Thank you everyone for all your help and input.

Hi chaps, I´m so sorry for not getting back to you sooner. I developed a DVT in my leg that had the op, and it caused all sorts of complications and made me very unwell. I´m out of hospital now and on the mend. Right, the HO, after speaking to her "Senior" decided to uphold the complaint. so we have said that we will be putting in a formal complaint, once we have received the data we asked for. Wayne will be collecting his file this week, they won´t post it, so afte r having a thorough look at that we´ll start the formal complaint procedure. Oh and isn´t life funny sometimes. We have just had a very vile and unpleasant character housed in our little area. A complete alcoholic and known by many to beg locally. The HO, who doesn´t get a say in who is housed, is just expected to manage them, has actually taken the problem seriously and guess who she had to ask to be a witness! I will do it because this person has upset the whole ethos of our community, and had especially affected his immediate and elderly neighbours. He keeps banging on doors asking for money, shouting and screaming in the street in a drunken rage, bumping taxi´s late at night so the whole street is woken up by police etc. All the old ladies used to sit outside in the afternoons chatting, no w the minute they see him coming they dash indoors, lock the door and stay in there. Such a shame. So, yep, I´ll keep the diary sheets for her, since I have a very good view of what is going on, but oh dear, fancy having to come and ask me! I almost invited her inside to have a coffee and a joint! That is a joke ofcourse. So, I´ll keep you updated, but nothing will happen until after the weekend as we are going to sit down and have a good look at the file.

No the document is not and ABC and I would refuse to sign one of those because very simply, we have not done what we are accused of, end of story. She just decided to write to us with a written warning, rather than bother to actually investigate the problem.
