  1. recieved a reply to my second cca leter today, basically its a standard letter and they say the've complied with my request and they wont reply to any more correspondance.....am still not sure about the cpr route, is it worth sending a sar letter

  2. hi slick , sorry i didnt reply, i,m getting a bit bogged down at the minute.

    Yes there are late penalty charges on the account but not sure how much and when there from, will look back through what statements i have.

     

    Why does this make such a difference ?

     

    re the account being in dispute, if myself and barclays have differing views on this who decides, and is there a specific time that they cant argue otherwise i.e after the 12+2days and then the 40 days?

     

    basically my thinking is that is there a quick way to get this to court so i can force their hand,(do they have an agreement or not?)as it seems to me that all they want to do is delay things as long as they can.

  3. Am i right in saying that if barclays give me a bad rating whilst i believe the account is in dispute, then they are committing an offence?

     

    and if this is the case can i immediately issue court proceedings.

     

    If this is the case then surely it becomes a "put up or shut up" scenario.

     

    Obviously i,m no legal expert and the views of some people here will be much appreciated.

  4. Hi i need advice re ppi.

     

    I have a credit card with lloyds that i,ve had for 5 or 6 years .

    for the first 2 years i had ppi that i didnt even know about, when i discovered it i cancelled it.

     

    i now have a balance of 3grand.

     

    how do i make a claim..... should i i do a sar first or send the letter requesting a copy of the cca.

  5. i sent the s78 re my leeds card to barclays as they have taken on the leeds accounts. they replied with a letter which stated

     

    " under section 78 , we must supply you with a copy of your executed agreement and a statement of account which is practicable to refer"

     

    " please note, a copy of your current credit agreementwill be sent under seperate cover "

     

    They then sent a letter which said

     

    "enclosed is a copy of your barclaycard terms and conditions "

     

    Basically there first letter agrees that they should send a copy of the executed agreement , but all they actually sent was a copy of the terms and conditions.

     

    Can anybody advise me as to what letter i need to send next.

    attached are 2 loan agreements for new vehicles. These are customer copys , not copies of the originals. i dont know if the originals were signed or if they even have them.

     

    Is it worth sending a cca request in the hope that they dont reply in time?

  8. Hi sorry to hijack this thread , but i,m a bit new to this .

     

    I am thinking of challenging my credit card agreements but i have a few questions......

     

    Has anybody actually had confirmation from the credit card companies that they will not persue the debt......and on the flip side has anybody actually been forced to carry on paying

     

    Is it ok to stop making payments and if so when

     

    Has anybody suffered adverse credit rating because of their claim

     

    What are the main points to look for on the agreement to see if its unenforceable.

     

    Once again apologies for for hijacking.

  9. Hi guys, am new cag so be gentle.

    I am about to start a buisnes claim going back to 96, i have all my statements.

    Is it better to do just 1 claim or to split it, 1 for the last 6yrs and a seperate 1 for all previous.

    Also with it being a buisness claim is there a seperate template letter, and because it was a partnership who signs the letter.
