  1. Hi all... I am due to be made officially redundant next Monday, and I have a few questions that my extremely dim employers can't answer... Firstly, when are you entitled to receive the redundancy payout? Mine is quite healthy as I've been there 4 years. I believe I read somewhere that it should be paid on the day you leave or as soon afterwards as possible, but I can't find anything to back it up... My manager said she thinks it's either the payday following the redundancy (which would be end of September) or the month after?? That would be end of October, and 6 weeks after my redundancy.... Secondly, I have been making Student Loan Contributions out of my salary for the past 3-4 years now.... can they take from my redundancy payout? If so, that would be a considerable chunk of money gone.... Thirdly, (and this is more out of general interest than anything else really) I have been on long term sick leave from the company for the past year now. During most of this time there has been a claim with the company's insurers for income protection, which was turned down a few weeks ago. My employers then called what would have been the 'final stage' meeting, i.e you either come back to work or you are dismissed. I panicked that they were trying to screw me out of my redundancy payment and immediately insisted they postpone the meeting and said that I'd appeal the decision (in the hope of stalling for time). They did, and then a week later sent me a letter basically saying that I would still be made redundant no matter what. I had a meeting with my manager the other day and she told me that HR had sought legal advice on the situation... (I'm sure she shouldn't have told me that lol...) So, if they had of decided to try and sack me before my redundancy was due, would this have been wrong? Just to satisfy my own curiousity really...   2. Thanks! I called them today, and the guy on the phone said my loan wasn't with them, it was with their 'chester loans' dept? (No idea who/what they are, as far as I knew it was all IF!) Anyway, he put me through to them, and once I'd managed to find out that they haven't destroyed all my data as they tried to tell me, because I'm an old customer he said the statements will be in the post ASAP. I'm not 100% convinced this will happen but we'll see!!

Hi, I sent my S.A.R off to IF a few weeks ago, and last week I had a phonecall from them- a really nice poilte guy, asking if I wanted all of the information they hold on me, including notes from when I've called them etc. or if I just wanted a list of charges. I told him I wanted information on everything on my account, including the charges and notes of contact etc etc, he agreed this and said I would receive it soon. Received a package special delivery this morning- about 50 blank pieces of paper with no information at all on my loan account (which is the one I'm going after), just a few sentences on one page about a savings account I'd half opened in 2002! The accompanying letter, thanking me for my request etc said 'I can confirm that you do not have a loan account with us' They didn't return the cheque either, so I can only presume that it will be cashed shortly, but I don't have the information I need! When I sent my request I included my customer number relating to my loan account to make it easier for them.... Any ideas what my next step should be? Will I have to send the request (and £10 cheque) again??

  6. Hi guys, Thanks so much for your replies. I knew that the SAR didn't put the account in dispute- that's where I started to panic because I hadn't got to the stage where it was yet, so didn't know if I could use that or not! I'll follow your advice and let you know what happens, I am definately NOT the kind of person who can deal with telephone confrontation well so will avoid speaking to them at all. Now I have an idea of how I should go about tackling this, I feel so much calmer. Thanks!!
  7. Hi everyone, I need a little bit of advice with Barclaycard. It has been unpaid since November 2005 and until today I haven't heard anything from them. I sent my S.A.R - (Subject Access Request) on April 23rd, and today I have received a letter from Buchanan Clark and Wells debt colleting agency asking me to contact them to settle the full amount! (£815.27) I had some idea that this might kickstart them into coming after me for their money, but haven't really thought about how to deal with it! The letter seems to be the usual stuff (I've received quite a few letters from DCA's in my short time!) but one bit of it says: 'Unless you make arrangements to settle the account within 72 hours our agent may be instructed to attend your premises to establish your residency and reason for non-payment' What does this mean? Bailiffs?? Although I'm probably not as concerned about this as I have no intention of letting them in my house at all! My claim for charges will amount to around half of the outstanding amount, plus a claim from Barclays itself will roughly add up to the other half. I have read somewhere that no collections action can be taken against an account where the amount owed is in dispute but who do I contact? And how do I go about it? Any help you can give would be very much appreciated! Should I call Buchanan Clark and Wells? Write to them? if so what should I say??? Thanks

    Fidji v Egg

    Hi Fidji, I don't know if it's any help, but I sent my SAR letter to the same address at Waterhose Square, and received a response (although not the response I was looking for- just a delaying tactic from Egg!) within about 10 days. The address at the top of the letter they sent me is Egg Customer Details Team Point North Waterfront Way Brierly Hill West Midlands DY5 1LU Although I am not exactly sure if this address is the right place to send it to or not, it might just another stalling tactic, I wouldn't be surprised!
  11. Sorry if I'm butting in on your thread here Kitty, just wanted to clear up what Mistermind has said! If we both sent off the template SAR letter, requesting all information Egg hold on us, and enclosing a cheque for £10, then do the 40 days start from the date they received that letter, or do they begin from when Egg receive this form? In the form we have both received (I presume that they are carbon copies), it says that if we request the 3rd option (which we already did with our first letter!), we will be sent out an 'information pack' basically to advise us how to do this. It also says that they will require identification, and a £10 fee will be charged. I am assuming that this is a delaying tactic by Egg, but are they able to do this? Is my plan to send the form back along with a reminder that the 40 days began from the date they first received my full request, AND that a cheque was sent with the original request ok or do Egg have more leeway here than I think they do?
  12. Hi Kitty, I sent my SAR off on the same day as you, and received exactly the same thing in the post this morning! Returned cheque, yet they say in the form that they require a £10 fee! What a cheek. I don't know if this is the right way to go, but I plan on sending the form back, with a copy of my passport as ID, with a letter reminding them that I made a full request under the Data Protection Act in my original letter, enclosing another cheque, and reminding them that their 40 days to comply began when they received my letter on 25th April, and that if they don't comply I'll file a claim for non-compliance! Maybe you should do the same, although I'm quite new to this so someone may be along with some better advice soon. Makes you so angry doesn't it?!
  13. I've read alot on this forum about sending a request for my credit agreement, and I have to say I don't totally understand it!! What does this mean, once I have requested the agreement? Also, as I have already sent a Subject Access Request, haven't I just acknowledged that the debt exists and that I owe the money??
  14. I have moved twice since I last received a statement! However, each time I have called their customer services and told them my new address, thinking that if they did track me down I'd just offer to pay a small amount each month etc, but I've heard nothing! I think they are just rubbish lol. Feel better knowing that they can't do anything while I'm claiming though, that means that by the time they can do something against me, I'll have paid them back and will be rid of Barclaycard forever
