Just about to send Draft Order request and covering letter to County Court, do I also need to send a copy to Cobbetts who are acting for Natwest?

Received Form N157 and the Judge has dispensed with the AQ. We have been informed that there will be a Case Management Conference (block booking as they are hearing several cases on the same day) on 2nd October held before three District Judges however we have not been told to prepare any documentation other than that already submitted which only consists of POC and reply to Cobbets CPR18 request. The form states that if we do not wish to attend the Judges will rely on docs. already filed with the Court. We will be attending and I wll contact the Court re any docs. we need to prepare, my question is - as the Judge has dispensed with the AQ do I still send the Draft Order to the Court with a covering letter and if so do I send a copy to Cobbetts as well. Hello Steven, thanks for replying. All the N157 says is that the District Judge has considered the statements of the case and allocation questionaires filed (I didn't receive a AQ) and allocated the claim to the small claims track. A Case Management conference will take place on 2nd October listed with several other cases at the same time before three District Judges. In the notes at the bottom of the Notice it says if we decide not to attend to inform the Court and the case will be heard in our absence and the Judge will rely on documents already filed. There is nothing to say hat we should take any documentation with us to the hearing.

Have been waiting for AQ from Court (I know in a lot of cases they are not now sent out). Today received notification from the Court (form N157 Notice of Allocation to Small Claim Track) that the District Judge has allocated the case to the small claims track and the Case Management Conference has been block listed for 2nd October before three Disrict Judges. We have no problem whatsoever about attending Court but there have been no requests from the Court for any further documentation from us regarding our claim. Will we have to prepare the Court Bundle for the Management Hearing or is there anything else we need to do to prepare for the Hearing and is there any point in contacting Cobbetts to see if they are prepared to settle prior to the Court date. Recieved NatWest defence and Cobbetts CPR 18 request on 7th June and replied to Cobbetts immediately answering all points re. request for further information, also sent them a CPR 18 Request of our own for further information requiring a reply by 25th June, as expected nothing heard from Cobbetts. Can I now send a letter to our local Court requesting they strike out the defence due to non compliance of CPR 18 request by Cobbetts or do I wait for the Court to contact me first re claim reallocation and possible AQ. I know others have sent CPR 18 Requests to Cobbetts and am wondering what they did if Cobbetts failed to reply.

Told by MCOL that our claim was transferred to our local Court last week and we would be hearing from them shortly. The problem is we go on holiday this Thursday for two weeks, is it likely that the Court will send any correspondence with a reply deadline date while we are away?

Thanks to Stevepm for all the really helpful posts. We received the CPR 18 request from Cobbetts together with their defence to our claim against Natwest and replied as suggested with our answers to their request for further info. together with a CPR 18 request of our own. We have given Cobbetts until 25th June to reply to our CPR 18, what do we do if as expected they ignore it? Still haven't received AQ from Court. Have our own thread at Leigh v Natwest.

Have been reading up on what will be required if we need to prepare for Court but can't find the Australian Default Charges Report and O F T Statement. Can anyone assist please.

Have also sent to Cobbetts a CPR 18 request of my own for further info. having read some of the other threads. have given them til 25th June to reply to my request. Has anyone else taken this course of action and what is likely to be Cobbetts response. Have tried searching the forum re this query without success.

Just sent off reply to Cobbetts regarding their request for more info. under CPR 18 also sent copy to Court at Northampton, decided to answer their queries in the hope it may speed things up a little. What happens next, initiated action via MCOL so will our claim now be moved to our local County Court also have not yet received AQ? Feeling a lot more confident about this since we found this site.

Just a thought. Will we need to send a covering letter to the court together with our copy documents of our reply to Cobbetts?

Have today received the Natwest defence from Cobbetts and it seems to be the standard defence received by most claimants on this forum. Am now going to forward copy template letter from forum refusing their request for info. under CPR Part 18 together with a breakdown of charges I am reclaiming for my daughter. Have not yet received the Allocation Questionnaire so should I send the letter etc to Cobbetts and a copy to the Court or should I wait for the questionnaire. All advice really welcome. Will keep you posted re progress. Still finding this a little bit scary.

Just started a claim on behalf of my daughter for almost £1800 in bank charges against Nat West. Received the Acknowledgement of Service from Cobetts and states they intend to defend all the claim, they now have until 13th June to submit their defence. This is all new to both of us and we are really glad we found this site otherwise I think we would have been really struggling. Will let you know how we are going on and no doubt be asking for a lot of advice too.
