  3. Hi Fruit, good news about the fees x. Its good to organised, it shouldn't do any harm to keep sending nudge letters. Read on here that someone was sending the letters every 10 days, until they settled, no reason not to persue the shabby for the other account! Good Luck x

  5. Hi there, you should ask for all POD's (proof of delivery), with regards to the goods, when they can't produce them, they can't ask you to pay for them! As for goods returned, you should have your POD's i.e. post office stamp or the little ticket the courier sticks to the returns note. Gratten tried to charge me once, when someone else had signed for goods 300 miles away at my old address! Stick with it x
  6. Hi Fruit, firstly don't worry, there are a lot of people on this site and all they want to do is help. Some courts have dispensed with the AQ, but the fee is still payable (usually within 14 days), others still issue the AQ and payment request! It sounds like you aren't going to get an AQ, but still have to pay the fee (killer, I know)! To be on the safe side find the number for the court and ask, they're usually very helpful.   7. Hi all, I'm just printing off my basic court bundle (court date 04/09/07 @ Walsall). Clicked on the Early Day motion from the House of Parliment! Could someone tell me exactly which bit I print or do I have to print every section? Any advise would be much appreciated x

  9. Hi Paulo, I'm in court 04/09/07, was also sent the CPR 18 request and sent back the small claim track letter (I haven't heard anything from them since then)! I've asked for a court buddy to help me (a bit thick at all this), plus I'm away for the 3 weeks before the hearing so the bundle will have to go in early. The letter from the court also stated that it would take no longer than 1hr 30mins, they are either going to give me a grilling or they are doing them in groups. I'm wondering now if I should be sending a nudge letter to RBS or Cobbetts (don't know which)? Good Luck & I'll keep you posted x

Hi all, just to let you know I've now had a court date of 4th September 2007 @ 10am, it says it should take no longer than 1 hour 30 mins, I'm wondering if they may be doing a few at the same time! I've been looking at the court bundles, still a little confused, but have requested a court buddie, in the hope of getting it right and my case not being struck out. I find it very interesting when reading through other peoples threads, that they have had some form of contact with the bank, I however have not heard a dickybird! Should it be me who makes contact with them?? I have read somewhere about nudge letters, should I be sending them or just do my court bundle and wait? Keep your fingers crossed for me.

  12. Hi all, another update!!!!!!!!!!!! Had a copy of Cobbetts AQ today (I sent off my AQ & cheque Fri recorded delivery to the court)! They have put in Section G (other information), I quote: Case management directions cannot be proposed until the Claimant serves a Reply to the Request for Further Information which was due on the 1st of May 2007. In light of this, the Defendant my amend its defence or apply to strike out. Oh my God, have I done something wrong??? When the sent the Request for Further Information letter, I replied with the small claims track template! Have I done the right thing??????????? Can someone please give me some guidance, I'm really worried now!!! Many Thanks

Hi all, have just received the AQ that Cobbetts have filed at court and now I really am worried They have put in Section G (other information) and I Quote: Case management directions cannot be proposed until the Claimant serves a Reply to the Request for Further Information which was due on 1st May 2007. When I received the Request for Further Information, I sent them a letter stating that I expected it to take the small claims track, section 18 blah blah blah! Is this a normal AQ from Cobbetts or will it really be stuck out or is it another scare tactic??? As I say I am really worried now, I've come so far (thanks to the forum), any help would be REAllY appreciated Thanks Lady x P.S. Soz for any spelling mistakes (try to do this at work) x

Hey all, just a quick update Got my AQ from Walsall today, and the request for the £100, it now gives me until the 14th May to return it I will be using the template on the forum (so I don't get it wrong)!!!!!!!!! Just wondered if there is anything I should be now be doing in anticipation of a court date Cheers Lady
  15. Hi all, quick update Was reading in a different thread about the AQ not being sent out!!!!!!! My case has been sent to Walsall County Court, I was a little confused about the £100 fee that is payable for claims over £1,500! All sorted now, I rang the court and it turns out that Walsall have to send out AQ with their instructions, but other courts may have been told not to. It would also seem that the £100 is still payable on claims over £1,500 even if you don't get an AQ, so make sure you send it If in doubt ask
