Well I was just about to serve Abbey a claim tommorrow. I am in Hull so now I don't know whether to bother if the judge is going to do this. -
They sent me the cheque (I had closed the account three years ago!) Along with a letter saying basically 'We hope this resolves the matter.' A couple of days later I got a letter from the court saying Smile had paid up and to fill in a form (included) to end the proceedings. It's all very cut-and-dried. I'm serving Abbey next, I don't think they'll be as easy.

Served my claim from my county court last week, and today got an ominous plain white envelope addressed to me. I looked on the back and recognised the Balloon Street address, and feared the worst, but out fell a cheque for £1437! I'm over the moon! Now I'm just looking for how to finish up with the claim procedure now they've paid up. The whole procedure took since January! Now to serve my claim to Abbey...

Gesture of Goodwill came late - how to respond?

Hi there, Abbey deposited £330 of my £1380 claim into my account as a gesture of goodwill, and I recieved the letter pretty much the same day on the 11th of April. I sent my previous letter giving them a 17th of April deadline. I've been a bit busy so I haven't had time to respond until today, so do I need to send the acceptance of part payment letter to them, or just continue with Moneyclaim online anyway? The part of the letter that's a problem is: "My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale." That date has been and gone, what should I do? Thanks for any help

Been sent partial payment *after* 'going to court' letter

Thanks for your quick responses I had closed the account by going into my branch of Abbey and signing a slip the cashier gave me. I haven't recieved any confirmation in writing that they closed it, that's why I checked online. The amount they deposited is a 'gesture of goodwill' they wrote in the letter to me. -
Hi everyone! It's nice to be here I've been watching these forums and the ones on MSE too, and I am at the midway stage, but there has been a complication, (the Step 2 and Step 3 letters refer to the ones on MSE): It hasn't helped that I moved home on the 23rd of March last month, and so there may be mail stuck in the letterbox of the old address (we did have it redirected, but there was a week before that started. I'm checking that mailbox today) I sent the 'Step 3' letter on the 3rd of April threatening court action with Abbey, and on Saturday I got a reply from the Step 2 letter, with Abbey offering £340 of my £1386 claim. I had closed that account in my local branch about 2 weeks beforehand. HOWEVER, I have just tried logging onto that account online to check it was closed - but it's not, AND they have deposited the £340 in there already! Now what? I've already sent the court threat letter for the full amount, so what do I do with this £340 sitting in my supposedly closed account! Argh!
