  1. Yes I believe Eversheds are Solicitors, so they should know better, but it seems when debt collection is on the agenda know one plays buy the rules, but ofcourse we are expected too. Your are right Curlyben, if Jo Public are sent official letters that are not recorded delivery, it is taken that they have been delivered - but when the shoes is on the other foor ....well, thats a different story. I will see what response I get from my complaints, that is if they receive them in the mail! X
  2. Hi, thank you for your replies. I sent the CCA request by recorded delivery back in July. I have tracked the letter and it says that it was "delivered from the royal mail delivery office a day later" but there is no electronic signature available. This info I got from the royal mail trace and track site. Some items I have sent come up with a signature but this one does not. I have tried to ring royal mail but I would have to pay another a fee to see if there is a signature. Surely this is why I paid recorded delivery fee in the first place.   3. Hi I had a Sky Card debt and got into financial trouble and in a DMP. I am writing to all creditors asking for CCA. I had a letter from Eversheds saying that they are administering Sky Cards account on behalf of Max Recovery. Eversheds have failed to respond to CCA, saying that they have never received request, even though they signed for letter sent to them with £1.00 P.O. (They are now in default and second letter sent telling them this, again they say that they did not receive this either). As far as I am concerned I have sent both letters from templates on this site and they have not respo

  5. Hi, hope someone can help. I am in a DMP and 6 months ago I received a letter from Eversheds informing me that my debt had been sold to Maxx Recovery and that Eversheds were administrating the account on their behalf. I sent Eversheds a CCA request that they did not respond to and so then sent default letter as per template. They did not respond to this either. After speaking to them, they inform me they do not have the CCA and that the original creditor does. I explained that they are dealing with the account now and they should respond to our letters.   6. Hi, just an update. As you know, Barclays refused to refund any charges of my charges and disagreed that charges were unfair. I decided to go the ombudsman route as I had my final response from Barclays which they require before taking on cases. Court really wasn't for me at this moment in time. I filled in the complaint form on the 26th June, and am so pleased to say that today have received a letter from the Ombudsman to say that although Barclays do not agree that the charges are unlawful, they will refund me the full amount I had asked with interest, rather than the Ombudsma

  11. Thanks welshcakes, really informative. So am i correct, with the FOB route, will not get the 8% added, but with the court claim this is added? If i am correct with the above, that is a shame as my OH charges add up to approx £3500:evil:
  12. Thanks, My OH is doing the same aganist barclays, she has gone the route of going to the FOB, they have replied back and are e-mailing their view to barclays, requesting barclays pay up in full! Would you think this is a quicker route to go rurther then the court approach?

After sending a request for repayment of charges on 2nd July, have received a standard generated letter back saying " sorry bla bla, your comments are receiving attention bla bla, However we do aim to find a solution within four weeks. A full report or update will be sent within eight weeks" Thoughts on what to do please?

Court case went ahead but was adjourned as Egg had not advised the other creditors of the CO request, Judge was very close to throwing it out completly and did even warn the solicitor that was on his mind!! Any way hearing is now middle of august. Going for a remortgage which has been accepted, this is providing enough money to offer f&f to all the creditors. So hopefully this will be settled before court hearing. Main point to this post is 1st Credit:evil: They have taken over my Citi CC debt. I requested a cca from them, they have sent me a reply, stating " advi
  20. Sorry, one more thing. A bank is one of our creditors whom we are paying a monthly amount through Payplan. I don't think we should offer to settle the debt yet as the account is in dispute and is being looked at by the Ombudsman to claim back charges which would completely clear debt. Payplan say we have to treat them the same as other creditors which I understand. But they owe me 10 times the amount I owe them, so seems unfair we have to offer to clear debt when a refund of charges would clear it. What do you think. Thanks X
  21. Hi, wonder anyone knowledgeable can offer some advise. We have been in a DMP with Payplan for 6 months but having a bit of a rough time with creditors one is going for a C.O other is threatning. This has made me ill and I can't really cope this way. So we have applied to remortage which is at the moment going through. We owe 71,000 and are able to borrow 50,000 and we will be paying the same out as we are paying now with old mortgage and payments to Payplan. So we wish to clear our debts and start again.   22. Thank you to everyone who has offered advice and good wishes. Court case is tomorrow with Egg (DLC) for C.O. but because we turned up last week due to not being told by solicitors that it had been adjourned, maybe this will help. I am going to ring court today and check its is definately on tomorrow and if they can put a note in file that we attended last week and lost days annual leave. With regards to first credit, we are going to get off the CCA letter asap, as at the moment they are at the threatening stage. Will keep you posted on both X
  23. Court hearing is on Thursday. Yes we are going - again! Forthwith Judgement is asking for the full amount of the debt to be paid immediately, knowing you can't do this they can then go for a C.O straight away - which they have done. This is faster than the creditors going for a CCJ I believe. But we have been making regular monthly payments to them via Payplan anyway, but still are going for a C.O. X
