Hi again I don,t know wether they can take money when the account is in an overdraft situation because I am always into my overdraft as soon as i get paid but as soon as I was " in credit" due to a bonus payment they snatched money as soon as the cheque had cleared before I could get to a branch to draw it out. I have now opened a basis cash account with another bank and I am transfering everything to that so that I am now in control not the halifax. Have a read of bookworms thread " Taking back control of your finances" it shows you exactly what to do, very informative and it fitted my situation perfectly. Regards Santos

Hi I have been in a similar situation with the halifax taking money from my current account to pay a halifax credit card ( which was in dispute at the time!) and i am waiting for a new account to be up and running with a different bank and i will kick the halifax into touch, but surely they cannot remove funds to pay a DCA ( Blair oliver scott).......... well I hope they can't Regards Santos

If my memory serves me correctly, "surlybonds" has posted quite a bit of useful information with regards to this thread, and I even seem to remember reading about him threating a CRA with court action if they didn't comply with his request. I am trying to find the relevant thread at the moment. It is a really good read if you can find it. Santos

Thanks for that Sequenci, I have just applied over the phone for a basic bank account with an "ethical bank" which I hope will be accepted, then I can "take control of my finances" ( just read the excellent advice offered by bookworm) and soon I will be in control not them. Thanks for the legal sounding stuff. It always sounds better when you start telling people about rights you have so as to let them know that you have been informed of your rights etc. Regards Santos

Hi all, Sent a CCA to my bank with regards to a credit card and not agreeing to ppi etc after falling 3 months behind with payments due to difficult change in circumstances etc. After going over the 12 + 2 and entering into default they then stole £120 straight from my current account as a payment and so left me short to pay standing order etc which was to them anyway for an insurance premiun. I know all about the rights of appropriation etc but does this still allow them to act unlawfully when the c/c account is in dispute or are they just taking the p#ss and hoping I wont question it. Any advice would be welcome, Regards Santos
  10. I always try to recycle when I can, but didn't realise I was doing it now lol!! I will need to request more detail from B&C because it was more to see how much ppi had been added which I had never agreed to so I will have to inform them accordingly. I will post the draft letter up here for improvements when I have got my head around how to word it. Regards Santos
  11. Hi all I have received 3 lots of SAR's from 3 creditors. Creditor A has sent a full list of statements from the past 6 years and returned my postal order as it was not required. Creditor B has sent an A4 sheet listing all charges over the past six years and returned my postal order again because it wasn't needed. Creditor C has also sent an A4 sheet listing all charges over the past 6 years but has not returned my postal order ( ah well, 2 outa 3 aint bad ). The questions I need to ask are; 1.) do I keep hold of the returned postal orders for future reference (eg court ) or can I take them back to the post office and have them re-written to use on my next batch of SAR's. and 2.) should I contact B and C and ask for the full statements so I can check the maths myself.   12. Hi Gemspan That is a heart warming read. I am at the moment just at the begining of my quest to turn the tables on these companies who think they are the be all and end all and the average person in the street is treated like something nasty they have just tread in. This site and all its fantastic members have given me the push I needed to get my life back in order and not to just bow down and accept that what I once thought of as all powerful financial institutions who would take care of me and my finances through good times and bad are no more ( when you suddenly have a change of circumstances for whatever reason) than a bunch of blood sucking parasites who will nail you to the floor (till they have everything you own and have worked a lifetime to achieve) and apply the most unbearable pressure till you crack and your health begins to suffer. So at the moment my creditors who treat me with respect and show a bit of compassion get my full cooperation and payments as and when agreed and a letter off myself thanking them for being reasonable in dealing with my situation. Those that treat me like doggie do do get nothing but a brickwall errected between me and them with my side being 6ft high so I can throw as much s*** as I want at them and hope alot of it sticks, but their side (being on the bottom of a hill) being 30ft tall so no matter what they throw back at me has alot further to travel, lol! On a lighter note I have 2 dogs, one is old and wise (like myself) but the other one is younger and as mad as a box of frogs (like the banks,DCA's etc) lol! Kind regards Santos

Thanks Skunk Just been reading through the solicitors letter again and they have missed some numbers off the account number, so I am just going to inform them that the details they sent do not relate to me so I cannot comment on this matter any further. Wonder how they will reply to that? Santos

Thanks for the advice 1159Skunk and Powell The credit card company received the CCA and SAR by special delivery next day guarrenteed ( got the printed proof ) and then did what they normally do in response to any communication by myself, just completely ignored it and gave it to someone else to deal with. So the CCA etc were all received before it was passed on. I am now going to write to the Solicitors and inform them of what has transpired so far and then wait to see if they start court proceedings. They will get no personal info off me either because I think my personal Data has been bandied round enough already. I am going to write to the Data Controller at nasty bank as well and question him as to why he totally ignored the requests. Is this grounds for a complaint to the Information Commissioner?
