  1. I dont have the answer to that im afraid but would PAY to find out. When i was putting £500k a year through my account they would take me out to lunch and basically kiss my butt, when i lost my busines and £100k (all paid back to everybody) in 1998/99 it was firing squads at dawn. You can imagine the charges i paid during this time and would appreciate any update you might receive. good luck.
  2. Hi guys. I was just going thru my stuff preparing to put my court claim together at the weekend. I was going thru my bank statements again and just realised this (derrrr silly me) I sent off my SARS on 13 Dec 2006 Barclays *ankers took 127 days to provide information ( i know i know divorce and all that) My point is between 22 Jan(40 days) which is when i should have been able to claim from, and 20 April 2001 (6 years) there are another £400 worth of charges just in that short time scale.. My question is ? Has anybody started claiming back beyond 6 years yet ? and how are they getting on ? Thanx.
  3. hi suzie. They are indeed not allowed to talk to a third party without your specific permission, Data Protction again. Write back stressing that you are offering to maintain payments untill the matter is resolved, if you get no response put the money to one side, They cannot enforce anything without a court decision, if it goes that far, and trust me it wont, you can prove that you offered to make payment but was blocked from doing so. keep copies and use recorded delivery (hope im not telling you how to suck eggs) do all this, and do it now, and they wont have a leg to stand on. Good Luck
  4. Hi . Got home to find a com slip from Barclaycard PO BOX 5592 Northampton NN4 1YZ, with my cheque enclosed for £ 20. I requsted SARS on 2 accounts on 28 April, hence £ 20. On the comp slip it reads Only £ 10 Required For The Information. but on the back of my cheque THEY had written BOTH my account numbers and a ref no of SHRR 3007.. I have had nothing but delays, delays, delays with claiming on 2 Barclays accounts, allthough i am only 7 days away from submitting my court claim on both.(£ 3,363.34p Yum Yum) Has anybody got any suggestions other than returning the cheque with and explaination and trying not to be sarcastic. Thanx
  5. Thats fantastic news, im so pleased for you. I sent my LBAS X 3 off 8 days ago, after last weeks ruling i was a bit down but this has cheered me up no end. Yesssssssssssssssss
  6. Thanx rory. With 5 account claims on the go approaching £10k my head is just spinning. i will however scan and post the CCA if it arrives soon. please keep a look out. Thanx again.
  7. Just an afterthought. What happens if copy of CCA turns up in post 2morrow ? ? ?
  8. Thanx rory32. I am allready witholding anymore payments as i believe Barclays & Barclaycard owe me more than i allegedly owe them. I will send off copy of CCA request to CS again 2morrow.
  9. Thank you sir, i appreciate your help but sent off cca request to Barclaycard on 28 April.. Sent off copies of all corespondents to CS, just seems to be falling on deaf ears..
  10. Hi guys, Barclaycard have passed my account on to Credit Solutions who despite being informed that the amount is in dispute, have now given me 7 days to pay full amount or take me to court. Can anyboby point me to a link where there may be a letter i can send off to delay/prevent their actions. My eyes have gone square looking, or i maybe just to thick to see it for myself, any advice would be grateful. Thanx..
  11. Yay. Go girl. Kick some butt.
  12. Hi Suzie. Although Miss Muppett is right about contracts, dont rely on this, do your own bit now. I believe the letter is a panic letter in light of the Consumer fight back..(god bless CAG) but DONT treat it lightly. You MUST find the pennies to get your letters off now. I know its impossible NOT to worry, but please try, remember the law is on your side, I guarantee from my own experiences, and there have been many, (not proud) that if this ends up in court, you will not have to pay anymore than you are now.I would advise you to keep making an effort to pay what you have been paying, and keep a copy of ALL correspondence, i would also suggest that you read as many threads as poss, and then when you are bored, read some more. Dont rely on 14/40 days, big organizations are disregarding the law, Barclays *ank, (i know) took 127 days to reply to my SARS... Do it NOW NOW NOW. So Chin up and good luck. :) Keep us informed :-? :-? :-?
  13. hi suz, no wonder your blue. im no expert, but if it does end up in court, the judge will allmost certainly side with you offering what you are paying now. if your income/expenditure dictates that all you can pay is what you are paying now, then try not to worry.i would however ask for a copy of the contract that says you cannot cancel your ppi, again im no expert but this sounds very very dodgy. good luck p.s. your forgiven for being in scotland.
  14. Get the non compliance letter off NOW. I waited 127 days thinking it would be tomorrow/tomorrow/tomorrow. It wasnt. Good luck.
  15. Thanx Gemspan. Am looking right now.
  16. Thanx Gizmo 111. I dont think i explained myself very well, so i will try again. I had 2 bank accounts with Barclays, prelim letters for £ 4,000 went off on 28 th April .SARS took 127 days to reply. No probs on move. I had 2 accounts with Barclaycard, I owe them approx £ 3,000 but am still waiting for replies to SARS. i believe i ill be owed twice what they are claiming from me. I will send off non compliace letters ASAP but my general question was, how do i keep Credit Solutions from my door for as long as poss. Many Thanx..
  17. Hello lovely people. I need a little advice over a debt to barclaycard, now handled by Credit Solutions. Basically i owe them approx 70% of what i am claiming back off them in charges. .I emailed them and explained the situation that i was not prepared to pay them anymore money while they are blatantly ignoring my SARS X 2. I have now received a letter threatening court action if i dont pay in full. Allthough im not at all bothered by their letters (got the tee shirt) i was just wondering if anybody could suggest the wording of my next letter to the to put the demand on hold for as long as possible. Any advice would be appriciated. Many Thanks. :???:
  18. In response to your own situation, my experience is, if you are honest, open, but most of all FIRM with dcas and the like, they will more than likely back off. These people ? ? ? are just bullies whose threatening letters are designed specifically to intimidate us..Remember if it does go to court and you follow the correct proceedure, you can allways offer the court what you can realistically afford..£10 pcm ? again if you are open and honest with them, the courts are a lot more friendly ? ? than the dcas. Good luck. you wont need it, just self belief.
  19. Finally got my statements thru from Barclays today.it only took 127 days,4 letters, and 5 phone calls..hope yours come thru tomorrow..dont give up..
  20. dear all..forgive my ignorance, but reading through your threads,am i right in assuming that i can claim back charges from Barclaycard, just as with Barclays bank. i hope this is case and do i go about it in the same way ? another 2 grand sounds good to me. thanx.
  21. Dear all. On the 13th Dec 2006 i wrote to barclays regarding copies of my bank statements,i followed the advised proceedure to the letter, but todate 126 days later i still have not received them. i have since followed up my original request with 3 written reminders, and 5 phone calls. allthough they are very polite and keep promising copies within 14 days. NOTHING. any suggestions please. :-? :-? :-? :-? thanx.
  22. Dont waste a day my friend.i have been trying since 13 Dec 2006 to get my information.i have followed guidance to the letter and have so far sent 4 letters and made 5 phone calls. i make that 135 days and still promises, promises, promises. good luck
