  1. How much are you actually owed? Have to say I understand how tempting it is to take the offer but I would stick with the claim. I have recieved full payment of my claim and interest last week, it took just over 7 weeks from start to finish. Ultimatley it's up to you but if there is a big difference I'd keep going, ask your self how you will feel after Christmas around the time when you might get a full refund? Good luck Joty

  4. It depends on how much you are claiming. If you go to the HM Courts web site you can look up fee costs. I believe the fees are the same for your local court or Moneyclaim online. My claim was for £1400 and I paid £120 in fees, but that has been refunded by the Halifax as part of my settelment. Joty
  5. I don't know yet if the moneys in the account, my anti virus software won't let me log onto Halifax as it says there's phishing going on their! LOL The letter they've sent me says to allow up to 5 days for the money to reach the account so I'm not contacting the court until I've actually got the money. I would have thought you should hear soon. Joty
  6. My claim totaled £1407 including court fee and interest. Yes they did ask for the extra 14 days. The letter they sent me was dated yesturday 6th Dec, so it managed to get here really quickly! Joty
  7. Should have said the letter Halifax sent me does say they have told the court they intend to defend but that as it would cost them too much to do so in legal fees etc they'll settle instead! Joty
  8. Bradders I also filed on 21st Nov, deemed served 26th Nov. Halifax acknowledged the claim on the 1st Dec then today I got a letter from them offering me full settlement! Hopefully you'll get yours soon. Have you checked your bank account as some people seem to get the money paid in before they get the letter from Halifax. Good luck Joty
  9. Good Luck David I did read on another thread that Halifax often send out their settlement letters on a Wednesday, apparently the week after the week you get acknowledgement to your claim. Not sure how true this is although it's what has happened to me! I hope you get some good news soon. Joty.
  10. I filed with MCOL on 21st Nov, it was deemed served on 26th Nov, Halifax acknowledged on 1st Dec and today 7th I recieved the offer for full settelment! Have to say it has all gone through very smoothly, I just followed the directions on this site and kept to the suggested timescale. Joty
  11. I'VE WON!!!!! Just had the standard letter from Halifax saying that they intend to defend the claim but as not financially viable to do so will pay up all fees plus the 8% interest plus court costs. Thank you so much to everyone here. As soon as the money clears I will make a donation.
  12. Step 7 of the user guide gives you the wording to use for the court forms, you just need to edit it with your own details. Joty
  13. Halifax have acknowledged my claim, according to the MCOL website. Do I get anything in writing either from Halifax or MCOL to confirm this? Also am I right in thinking I just have to now wait until the 28 days are up or should I be checking with anybody to see whats going on? It will be great to get this sorted! then move on to our joint account charges! Joty
  14. I had the same letter, as have others from reading their threads. I would continue with your claim. I filed with MCOL on 21st November so am currently waiting. Halifax have acknowledged the claim but nothing else just yet. I was really nervous about the MCOL claim but just follow the advice and templates on this site, it's all their for you. Good Luck Joty
  15. Mark, all I said in the letter was that I was sending them a copy of the schedule of charges that had been filed at court today. I have previously sent them one when I sent my original letter, but this one now includes the interest. I didn't go into anymore detail as I have previously warned them that I would be filling a claim through the court when I sent them the LBA. I sent two copies, one to the person I've had letters from in Customer relations and a copy to their Head Office address. Hope this helps Joty
