  1. Tried earplugs an putting on my ipod but the problem is deep bass which carries and I can still hear it. Nearly lost my temper again before - was trying to concentrate on something but downstairs had some rap music on as well as the baby crying and the mother shrieking. I just screamed "shut the f*** up" at the top of my voice. Dunno if they heard it but I felt better for a bit before crying on the phone to the council to get me out of here (which they wont). Think I'm just ratty after the lack of sleep last night. Have also registered with homeswapper. Unsurprisingly, no-one wants to swap a house for a masionette.
  2. lol. Nah - my flatmate has some Neitzereb (or however you spell it). All of mine is classical. Cosi fan Tutti has some nice bangs and loud bits, but too much libretto (as with all Mozart operas). Beethoven Symphonies maybe? If I had the money, I'd hire out the Liverpool Philharmonic for a rendition of Tchaikovsky's 1812 overture, complete with a full complement of cannons. All of them, of course, aimed at next door's house!
  3. Just another one about my dad, who is not exactly politically correct, but not one to deliberately cause offence. Watching the TV, he spotted a character whose head height was at waist level of another character. "Whose the dwarf?" my dad asked. The character was actually a non-vertically challenged person in a wheelchair. Only my dad could insult two groups of people in 3 words.
  4. My mother called me yesterday to tell me she had got a virgin. After howls of laughter from my dad drowining out the rest of the conversation, it dawned on me that she meant a Virgin sim card. My mother also has a habit of asking daft questions about the obvious - for example: Me "just going to the butchers" Mum "what you going there for?" Me "well I fancy the latest DVD releases so I'm going to the butcher to buy a house."
  5. Next store had the music on last night and I got it witnessed by the investigator. There was loads of screaming as well - apparently they were singing, but the investigator just said it's unreasonable so it's getting reported. It's the 4th time it has been witnessed now, which he said is usually the number required for a noise abatement order to be granted. So I've been up since 0230 ish, back to bed at 0400, asleep at 0500 and woken up again 3 times by downstairs screaming. If only I could get a noise abatement order for babies and skreiking mothers
  6. Soooo, all this slander / libel eh? At least your getting your money back. I'd grab it and run. Why they are taking so long to refund though is beyond me. The 30 days is a maximum and not a target. They should refund asap. Still, I'd rather wait for it and run than argue the obvious with them. Make sure you update TS.
  7. Trading Standards deal with a wide variety of issues and concentrate on legislation from an enforcement viewpoint. If TS prosecute, it's usually passed over to the authority's solicitors. That's why they suggested to speak to a solicitor - they are more familiar with case law and the rest of the legislation and will probably have a better idea in terms of litigation should it occur. IMHO, I would say that the fact they have been in the shop for 6 months would mean the owners have simply given up on them or forgotten them. I would say hand them to the police, but don't know if you could or not, otherwise a charity so at least some good comes from all of this. But I would seek the advice of a solicitor. Try contacting your local chamber of commerce to see if they can recommend one.
  8. It will depend on how the question is put across. If it was not made clear that the excess you chose was a voluntary excess, then you may have a case. Website comparison sites have been criticised for this kind of behaviour. I have had some unbelieveably cheap quotes for car insurance, only to find that a voluntary excess had been added despite my selecting none.
  9. There are three main ways to cancel a contract. 1. Where the contract itself allows for it 2. Where legislation provides for cancellation (such as a cooling off period) 3. Where there is a breach of the contract or where terms are incompatible with legislation and the contract cannot continue without that term (i.e, unfair terms). You will need to scan through it and see if any of the above apply. Can you scan it and post on here for people to have a look through for you?

  11. The meeting yesterday between the HA and next door did not take place - again. Third time now she has failed to turn up, but I'm not surprised. I pressured the HA manager, as she said that all they could do was to arrange another meeting. I pointed out that it was obvious she has no intention of meeting her obligations, and it's been agreed now that they will issue a final warning before a noise abatement order is issued. I am now praying that she puts on her music and that I get it witnessed. Then she'll have any sound equipment taken off her. Serves her right.

  13. If this company is going after everyone who has said something bad online about them, then I'm surprised they get the chance to do anything else. The internet is littered with complaints about them. These, plus the email they sent to the OP, demonstrate what kind of people they are. I know where I am NOT buying my computer equipment in future!
  14. A CCA is different from a SAR - they fall under different legislation, and each legislation carries it's own fees. I'm afraid that they are entitled to ask for the £1 for the CCA (even though it costs them more to process the thing) as well as the money for the SAR. You may (or may not) be interested to know that all N Brown companies (Jacamo, 40+ and all their other catalogue names) are in the same office. The same staff work on the different catalogues (with a couple of exceptions) - all of them in a big office in Victoria Station in Manchester (between the MEN Arena and Maccies). The head office (where some people actually have a clue about what's what) is based on Lever St - right under Ticket Master's offices. Seems that they like grouping the numpties together.
  15. It's a strange technicality. Beer and cider can legally be sold in the following quantities: Pint 1/2 Pint 1/3 Pint. If a lager top is served in a brim measure (where the capacity is only achieved by filling the glas to the brim) then really you are getting a short measure. However, it is accepted that beers can be sold with a deficiency of up to 5%, so you can get served 95% beer and 5% lemonade legally. I suppose serving a full pint in a line measure, then adding lemonade on top would be a better idea, but line measures are not popular due to expense and complaints received about the measure being short.

  17. I don't think they would care. An alley cat has more morals than that cow next door and her accomplices. Her ex boyfriend was walking down the street yesterday. Dunno if he was drunk or drugged up, but he was "singing" football chants - those that include lots of expletives - at the top of his voice and didn't give a toss about his behaviour. Later in the evening, some friends came to the house - all of them p*ssed (including the driver) and the music started. This from the oh so caring mother who does not attend meetings with the HA because of her sick child.

  21. Well, next door have started their music off again - loudest I've ever heard it. Just gone out and walked 3 doors away and could still hear it. They're putting it on for 10 minutes, then off again repeatedly. The investigator said that this is a common tactic to annoy people and to make those who complain to sound like liars (i.e, when the investigator turns up, there is no music playing). It's sick. And so am I.

  23. Ha Ha, council called and said that next door (not the ones downstairs) missed the meeting that was scheduled on Friday. The tenant blamed her kid being ill. Probably earache or headache if there is any truth in it at all. She's meant to go in tomorrow. Will see what excuse comes up this time.
