  7. Hi Folks, I tlooks like the Bank have not send through their defence in time and it is now 2 days overdue so i am going to go ahead and file a Judgement by Default. Has anyone gone down this route before and what was the timeframe and outcome. I have spoken to the courts and they confirm that a defense has not been filed, so i would like to hear from anyone who has taken this route before. Regards, Paul
  8. Did you fill in the questionaire ? Were you at some point asked to provide evidence, ie. copies of your charges, dates and so fourth ? It sounds to me that you have not provided the bank with any supporting info but i have not got thaty far yet so am only summising.
  9. The first thing you need to establish is "WHO" did had the conversation with Lloydstsb ? Perhaps you should send them a DPA request for all the conversations they have on file with yourself, this should at least spread some light on the matter. Personally, if you had not had the conversation and they claimed you did, threaten court action, i am sure there is something to gain from this, although at present, i dont know.
  10. To be honest, it happens all the time. The bank can argue many different reasons for being late and ultimately, the courts make the final decision. Obvisously if there was a serioius lapse in time, then the courts would be more likely to favour the claimant. Botton line here, dont worry, you will still get your money
  11. Thanks for your swift responce, however maybe you have misread or maybe i have not explained properly. I was questioning what would happen if you realised you were wrong AFTER they had paid out and what if the bank also found this out found this out after they had paid, would you be liable for the shortfall ?
  12. Welcome to the site first of all, but why go back to 2002 ? Why not go the whole hog and claim your 6 years worth ?

Ok, lets say for argument sake (this is merely hypothetical) that you have tallied up all your charges and so fourth and you end up with a final figure, but this figure is wrong but you only realise this after you have made your claim. 1. Are the banks actually checking these spreadsheets we are doing, and what are the chances they would pick this up ? I mean even if is only a few pence, but on the other hand, it maybe more. I doubt it very much that all of us are getting out figures correct. 2. Can they contest the amount and if so, then what ? 3. What if they paid up and then after the fact you realised you made a mistake that they didnt pick up at the time. Can they recall any monies paidif their auditors picked this up after a payout ? Just a few questions i thought i would throw out to the forum
  14. Put it this way, they cant take what you have not got, if yo make a reasonable offer to them, ia m sure they will accept. Once they have settled the first claim, then there is nothing stopping you from claiming again, as long as you have not signed a condition with them, for instance, if they agree to pay you your charges back, but you have to sign away your right to make further claims, this is a big NO NO !!. P.S. Dont worry, dont let the buggers get you down, they know they are in the wrong and want you to sweat it out.

  17. Ok, i think i made a boo boo. It looks like i have sent off the LBA first, rather than sending the prelim letter. Although i have received a response back from the bank. Am i clear to just go ahead now and make the claim, i mean, it looks like they are receiving these letters day by day. Although i have received this letter within the 14 days i gave them, does this mean i HAVE to wait til those 14 days to be up before proceeding, or can i take the letter as a response to the fact that they are unwilling to pay up ?   18. Ok, sent my LBA on the 30-04-06 and received a standard reply from Musarat Siddique on the 02-05-06 (damn quick i might add). Is this the point that i file a claim online ? I hope so, i cant wait any longer, the anticipation is killing me, hehehee.
  19. If i might ask, what sort of documents would you be required to send to the court as evidence ? I assume the statements that you received from the DPA request ? If so, would that be enough ?

Hi Folks, Thought i would never see these, but i have received my DPA papers through, just need to sit down tonight and work out the charges and then start the ball rolling good and proper. 1 Quick question though, when i get around to sending the LBA, can i give them 17 or even 10 days to respnd rather than the "safe" 14 days ? What can they do if i gave them 7 days for instance ? Regards, Paul

  22. I was wondering if anyone could help me with a query i have concerning Stamp Duty Land Tax. My girlfriend has just bought a house and she got a mortgage for 150,000, she was informed that she will have to pay 1% Stamp duty because the value of the house is 150,000. However she has just found out that the actual value of the house she is purchasing is 148,000 and as a result, she will not have to pay Stamp duty because the overall house value falls under 150,000. The bank are disputing this, stating that the value of the house has to be under 120,000 to be expemt from Stamp Duty. Can anyone shed some light on the matter for me, it is slightly confusing. The estate agents say "NO" the bank says "YES". Oh and another quickie. Who is responsible for collecting the Stamp Duty ? Thanks for any help.

  24. Thanks for your help. 1. Roughly 2100 pounds 2. Approx 320 pounds 3. Yes i did inform the landlord, both myself and the ex girlfriend went to see him to get the lease changed over to her name solely. When i did see the landlord, i explained not to worr about the rent, as i would TRY and get it for him andnot to hassle my ex for it ( was trying to remain civil ) but he has nothing in writing to confirm this.
