  1. Thanks guys for all your help and info... mum has been trying to get through to shelter but its engaged, she will keep trying. My sister is going down today and she is going to get copies of all documents and she will try and speak to the lenders solicitor and ask questions like who is responsible for property management, should my parents keep paying the direct debit etc mum has also just told me they had a burst pipe two days ago and had to pay a fortune to a emergency plumber, and couldnt get hold of the landlord...Feel this is just the start of the nightmare...
  2. the company wasnt a limited one and she has had no contact from the company since the start of this year.... the landlord solictor told my mum that the partnership had been disolved and she would only be dealing with one landlord from then on, the building society solictor has told mum that the mortgage that was taken out on the house was only granted for short term lets and they didnt know that mum had a long term contract already in situ but they have send its not legally binding .... its so frustrating being miles away and not being able to help.... thanks for replies guys
  3. have a bit more info.. Mum has spoken to lender's solicitor this morning, and the house was purchased in May 07 but the mortgage was taken out in the December 07, he has told mum that they're contract isnt binding as the mortgage was for short term lets only and they have 7 years left to run The company wasnt a limited company and was run by two men who have since spilt from the company. Mum is going to give shelter a call for advice. The lender are willing to delay matters for a month due to mum's health problems, but have advised her to seek legal advice.
  4. Hi all, Thanks for all your replies... Have spoken to my mum and she tells me that they had problems in the summer with the original Direct debit not being collected? they finally managed to get in touch with the landlord who gave them a different account number to pay into. The house is in some state of disrepair and the landlord was going to put new windows, kitchen bathroom in etc but hasnt. Also Im not sure but I think they have had the boiler gas check only done once in the last 3 years. As far as im aware the tenancy is for 10 yrs at £500 a month! Mum has tried to speak to the lender but they said they won't give her any more info. I live abroad as in British forces so will ask parents if they can get photocopies of documents sent to me via email. We have contacted CAB and awaiting a call back ref home visit for mum and dad..   5. Hi all, looking for some advice for my parents.. Have found out over the Christmas period that they sold the family home to one of these "we buy your house and you rent it back" schemes a couple of years ago. They then received a letter last week from a building society informing them that the landlord hasn't been paying the mortgage and the house will be repossessed, my parents are not in the best of health and are worried sick. I have tried to contact the landlord but to no avail. My parents have been paying monthly via direct debit on the 1st of each month and this month the landlord came round in person the following day to ask for next months in cash! any advice will be greatly appreciated thanks
  6. Hi everyone, hopefully I'm posting in the right place. It's abit of a long story but I will try and condense it down... We had an overdraft with Hsbc for £2000 and in nov 2009 they cancelled it and requested the full amount to be paid back. I spoke to the call centre and advised them that we couldn't do that and would only be able to pay £50 a month.(I have been off work for 6 months due to ill health & I'm back on reduced hours) We have been doing this since then but at the begining of April we received a letter that we had to contact them with regards to a repayment plan to suit them. The letter stated we could call in to our local branch and speak to someone, which we did only to be told that they didn't deal with that sort of thing in branch and we would have to call the money management dept but to get all facts and figures together first and call at our leisure (Managers exact words). we did this a few days later only to be told that we are too late and its been refered to a Debt collection agency! What sort of thing are we too expect, My husband is in the Armed forces and works away, so I will be here to deal with it any advice will be greatly appreciated. sorry once again for a long post
  7. can i claim charges back on my credit card... direct debit wasnt set up in time and i was late paying by one day and the cc company have charged me £24 for a late payment letter to be sent

Hi everyone, just to let you know we have received our offer letter today for 85% of the claim, which we are more than happy with as we cant do the court option because we are overseas, it will clear the overdraft and we shall have some left over to go into the savings account. It has taken exactly ten weeks from start to finish. Thank you to everyone who has helped us and Good luck to everyone with their claims, hang on in there, its worth the wait.Donation on the way once funds have cleared .....Thanks again :D

UPDATE Had a very nice letter from HSBC today, asking what I'm going to do about my overdraft and would i call them asap.. so have just got off the phone and I said that I'm waiting for a reply to my letters requesting my bank charges back and was told an offer letter has been sent out on the 23rd June!! so if that's correct its exactly 8 weeks since i started the claim!! Trying not to get too worked up as knowing my luck it will be an offer of £10! lol will post again once the letter arrives hopefully in the success story section ....
  10. me again, sorry but it's abit of a "rant" posting today... pay went into new account aok, checked on HSBC and the standing order for the loan (which we cancelled online on 15.5.07) had been paid!! pushing us over the overdraft even more! I called HSBC and they said you can't cancel a loan standing order, i said then why did it allow me to do so online and gave me confirmation this had been done... so now i will be charged yet again!! and I asked if it will be recalled like the Bank of Scotland loan was last month and they said no!! so why cancel that one and charge me £25 and let their own go through....the young chap on the phone despite me telling him at least 3 times Im british forces overseas in Cyprus, kept saying i can only cancel the s/o if i go into the my branch! .... so at the minute im banging my head against the wall waiting for them to call me back with regards to what can be done....sorry for the rant.... oh for an easy life;)
  11. Im in Cyprus so not sure what they will say to me... Ive just written off an letter to them explaining that my receipt and warranty details are in storage but have the extended warranty with curry's etc so hopefully i will get some news soon
  12. Just want to say thanks for the info with regards to the faulty camcorder.. went to use ours at the childrens sports day and it came up with the lens cap fault... rang JVC and it should hopefully get sorted cheers mate

Hi Pete, we are classed as part of the uk but because our postal address is BFPO it isnt recognised as a UK address...as for speaking to the CO ... afraid cant do that .. we have chain of command and im way down on the list... we will go down the same route as cassie has gone and prepared for the wait... we have dug our trench and got our rations and brew kit,so we will be fine:)
  14. yes i have had a read of the link.. think thats the best and only option for us really. Does the "8 week" time scale start from the original letter or the last letter we have just sent? and should i make any other contact via email say once a week just to let them know we are still about ... don't really want to call them cos it will cost a fortune calling from Cyprus...its a pity i cant Skype them:D
  15. me again, just another quick point, when sending the revised list of charges I havent got a reference number as the first letter for the joint account was never acknowledged, only received a "colin" letter for my wife's account even though they were both sent together... shall i hang on to see if the latest letter is responded too? thanks again
