  1. I'm really wary about this apathy with the 'court bundle', I'm sure they are using it to try and trip someone up. They may change there tack at any time, so we must cover our backs completely, just in case........ If they start going to court, and you are one of the ones without proper court evidence, your case is sunk ..... keep the faith:-) by the way, just wondering, does anyone have any evidence whether the team at Barclays or any other banks read these posts ?? would be interesting to know, it's a good way for them to judge what they're really up against..............
  2. thanks bally & glav i have already gone through the complaints procedure at Abbey, and have a person assigned to me for my case, however the cheques still remain lost. They suggested that rather than destroying the cheques, sometimes misc. deposits are stored in a temporary ledger account, (i.e. if you don't claim it, they will keep it !) I asked that if they did this, surely they will have a log of the payments made into this account ( after all they are a BANK ?) but that seems to be too complicated and they are just random deposits, and we have to prove our case that it is our money before they give it back . I would understand all this if it was my fault, but this is purely down to the lack of organisation at Abbey, why should I have to prove anything ? I am also a bit concerned now, considering Glav's problem with unpaid cheques, these banks seem to be more like gangsters than high street organisations....... we shall see...... I'll keep my money under my mattress in future, it's safer !!!!
  3. :o You won't beleive this story: I got full settle from MBNA, sent to me in two cheques about a month ago. Everything was fine...then.... I decided to deposit them in an ABBEY business account which I hadn't used for a few months to keep it separate from other stuff etc.. So, as Abbey don't allow you to deposit business cheques over the counter, I sent them in the post to Abbey in London. Rang to check they were in there OK, and got told that the account had been closed since January, and the cheques have most likely been destroyed, as per their usual system for closed accounts. Asked why they had closed my account, they said because of inactivity on the account, and they had sent 3 letters and made one phone call to inform me, but without any reply, so they closed it. Turns out they were using my old house address (moved 2 and a half years ago) and had been sending stuff there (crazy, as I have 4 other ABBEY accounts and a mortgage with Abbey, and they've always used my current address, so why would they do that), anyway, it seems that I have to re-apply for a new account, and they still don't know where my cheques are !!!! I have been in touch with MBNA as I will probably have to stop the cheques, and get them re-issued. Luckily I have found MBNA really good to deal with and have been the best out of all the banks, so it shouldn't be too much of a problem, i hope... Just thought I would tell the story, as I am probably the first in the history of CAG to spend months getting charges back from a bank only to have them lost by another BANK !!!!!!!! :eek: I really do hate ABBEY they are the most dissorganised bank I have ever dealt with.
  4. i sent the litigation team a nice big present by special delivery (6 YEARS OF PHOTOCOPIED BANK STATEMENTS), and a letter saying that they don't need to do any checks, all the evidence is there, so can you pay me please....now ! we'll see what they say............

  7. Well, I 've been dealing with Tom Hickey [email protected] so that fact that no-one else has mentioned him, is starting me to thinking I've been shafted again.!! Maybe he's the janitor or something, and they just gave him an e-mail address for a laugh, just to deal with my sorry case. bloody hell !!.......................... he's probably some spotty IT guy who's hacked into my case and messed it around a bit for a laugh, cos' he's bored........ if i ever get my hands on him !!!! ok i'm getting carried away again must go to bed................. :o

  9. Hi y'all Reading through this thread, I'm not sure whether anyone has available a copy of the T & C's for any of the years 2000 - present. I think I'm missing something, could somebody point me in the right direction/ thread. By the way I have already filed all my stuff ready for court date, and advice seems to be to go back and add in the T & Cs to the bundle,....is everyone getting in a bit of a tizzy about these T & Cs or should we take it very seriously.....do you reckon ?..
  10. yes atlantic, they're all just doing their jobs, (it's not they're money after all), however this lady had a bit of a swagger about her, and made me get (unecessarily) annoyed with her about the whole thing. after all, we all know they're going to settle in the end, so why put up the pretense, just PAY UP, and spare the court system for more important things !!!! aaarghhhhhhh......................................................
  11. I decided to get the bit between my teeth with RBOS after months of stalling etc... OK so I finally, after 4 phone calls today, and everybody trying to deflect me from the correct department, finally got through to Lesley Sandford in the Royal Bank of Scotland Credit card customer care team (disputes department). She reckons that she's the head honcho there, so I asked her why she would not settle my small claim for £335 after I had evidence that they had settled many others of higher value before court. She absolutely refused to budge, and said she would see me in court. Strong tactics from RBOS ! I pointed out that RBOS has never defended a claim in court to this day, she refused to comment, I asked her then, if in that case I was going to be THE test case (which would be big news for the press !), and they were going to defend me in court, she refused to comment. I asked her for the name of the solicitor involved in settling the disputes, she refused to give me his name. I asked her to confirm that they knew that the claim would increase by £120 for court costs, and if they were fully aware that they would have to pay me the increased sum, and she was taking the resposibility for that, she said that she fully understood, but i would still have to go to court. so court here I come !!!!!.....................bring it on.

Im trying desparately to get through to the department dealing with claims at the credit card operations (customer care team at RBOS in southend. does anybody have any contact information, i.e. email addres or direct phone number ?? they keep stating that they do not deal with disputes over the phone and i cannot get to speak with anyone thanks andy

  15. thanks dar£n i've just come back from watching 'pirates of the caribbean' and i'm in 'swashbuckling' mode, and I just wanted some more peices of eight:D i guess i will read through all that stuff carefully, and weigh up my chances, before I decide to put my life on hold to claim back a few hundred quid... cheers ahoy, matey !
  16. I have my claim going through for my past 6 years charges, but rummaging around today I came across a further 2 years full bank statements (1999,2000) of course, with charges on them... It's like finding gold these days ! I just wondered (difficult to read all the threads) if anyone had any luck with Barclays yet, claiming past 6 years ?? If so, I'll go for it appreciate any info...
  17. so I started thinking yesterday, (maybe too much !)..... ok, Barclays told me they are going to pay me before going to court, so if by telling me that, would i relax then and decide not to file my evidence for the court date ( i had to file by 4pm today)...... so my brain was working overtime, and thinking, well what if they are pulling a fast one on me, i.e. i don't file, then the case gets postponed or something, and the whole thing gets delayed another 3 months.. so i spent a frantic morning getting it all together and got all the paperwork in to the court just in time by 3.45 !!! i've come all this way, i'm not going to lose it now !!!!!!!!:o
  18. yeah, go for it.... BTW, I received my full settlement cheque this morning !! they had said i would have to wait 10 days. they seem very eager to pay me now ! I only worry that if you make too much of a point of the interest that they may question paying it, as (correct me if i'm wrong) but if it does go to court, they only have to pay statutory interest of 8%. However, I do beleive that in my claim,. they didn't even check the amounts, they just paid it, so don't worry too much, I'm sure they're not worrying, in my opinion, I think they're just being told by the big cheeses to pay off all the small claims without questioning now.... good luck

  20. Hi Below is a copy of the letters I sent to MBNA recently: A second letter was necessary: I got a letter back yesterday, saying they are sending me the full amount, so it must have worked! Good luck with yours... Andy
  21. BTW again I forgot to say that the claim include a fair amount of compound interest which I worked out using the calculator on Martins website (moneysavingexpert) so it wasn't just the standard 8% interest, it was a lot more ! i think MBNA just couldn't be bothered working it out !
