  1. I looked into claiming about 2 years ago but a house fire meant that I subsequently lost my statements and the spreadsheet I had been working on. I am now looking at restarting my claim but I need to get copy statements from A&L again. Ths thing is, as I have delayed it, the majority of my charges were over 6 years ago. What can I do about this? Thanks for any help you might give and thanks for reading.
  2. Beserker, did you do your claim through MoneyClaimOnline? They didn't submit a defence for me either, well in fact one turned up yesterday even though I filed for a default win on Saturday. Should I just send the bailiffs in now? Sorry to jump on your thread but this is bound to help other pople.
  3. Sorry one thing I forgot to ad, it looks lik Moneyclaim haven't received their defence as in the column that say 'warrant' it now says 'start', Thanks for any help.
  4. Right I have now had a letter from the bank with a copy of the defence they have entered. I am claiming from Oct 2000(which is 6 years prior to starting my claim) to December 2006 (as charges kept being added on). One line of there defence states that the charges prior to March 2001 (6 years prior to me starting the court case) 'did not arise within 6 years before this action was commenced and are statute barred'. So what should I expect now? I know it doesn't ever get to court but if they want me to be the first I'll see them there!
  5. They have already closed my account, this happened as son as I asked for my statements! I am claiming for over £1000 interest and altogther my claim is for nearly £7000. Thanks for the reply.
  6. Hello guys, I found the step by step guide which says I should file for judgement so I have just done that. What happens now, i.e. when should I expect my money? I ticked the box that says they should pay 'immediately' Thanks for your replies guys.

  8. A & L acknowledged my MCOL claim on the 15th of March, they still havent filed a defence. Do they normally do this? And should I now enter a 'judgement by default'? Thanks for any help.
  9. I have retyped the letter in full here: 'We have received from Northamton County Court a copy of the claim form that you have issued. We note however tht you are seeking to recover charges added to your account since 30th October 2000. Under the limitation act 1980 the maximum period for which you can make claim of this nature is 6 years. Can you therefore please provide us with a detailed breakdown of the charges that you have incurred since the 8th March 2001 so that we can consider the matter further. Can you please provide us with this breakdown within 7 days of this letter.' If I did this it would hardly affect my claim as I have recently been subject to some charges. However, they are wanting mw to backdate the claim 6 years from the date when I filed the claim, surely this is wrong. If this was the norm then everybody would be forever changing their spreadsheets as weeks pass, taking out the old and adding in the new etc. Also, if I gave them what they ask for would this be classed as a new claim and have to start from scratch? I am very nervous about the implications of this letter. If I do ignore it what could happen? I don't want to miss out on my claim in full, it is for nearly £7k. Thanks in advance for any help.
  10. Hello, In November, I wrote to A&L asking for a breakdown of my charges. When they arrived, I started the spreadsheet from October 2000, I can'y remember why. I have recently filed a claim with MCOL. My spreadsheet was actually written in December and the dates the spreadsheet covers are 30/10/2000 to 21/12/2006. I received a letter this morning from A&L saying that I am only allowed to claim for 6 years and I should send them an amended spreadsheet that only covers 6 years. What should I do? could this put my claim in jeopardy?
  11. Hello again, Thanks for the help, so as long as my claim is just below £5000 not including the 8% interest that will be fine? It works the interest out to about £1100, does this not count within the £5000 limit? Thanks again.
  12. Right, I have totalled up my clim and it comes to £5159 without including the 8% interest. I made my claim from November 2000 but added the charges up until they closed my account in December 2006 is this ok? I read that you shouldn't really claim for over £5000 through the small claims court, is this including the 8% interest or excluding it? I am very grateful for any help as I am waiting to send my claim off. Thanks.
  13. Hello Neil and thanks for your reply. My statement are copy statements and so show nothing on the back. Basically I'm not claiming the £5 and £10 overdraft charges at all, But I am claiming the £25 overdraft fee's. Is this the safest way possible?
  14. My ovdraft charges are £10 during 2000 and 2001 and then are £5 for the other years, can I not claim the £0's or £5's then? Please help as I'm waiting to send my claim off, Thanks.
  15. Hello all, I am currently in the middle of my claim, I am asking advice for my brother. He has been with the Alliance and Leicester since 1993, subsequently he uses his account a lot, has a decent overdraft limit etc. He would like to find out the amount he might be able to claim for but he doesn't want them to close his account just for asking aout the amount. i.e. if its elow £1000 he doesn't think its worth getting a new bank account and aranging a new overdraft etc. So, will they close the account or maybe treat him differently to what they might have done after receiving the initial letter asking for statements?
