  5. Hi I have sent in the court claim--i am disputing the debt I also have sent restons a letter asking them to disclose the evidence they will use in court I will wait and see what comes back. I did the same with one of my Barclaycard Accounts, and they did not continue and so the claim was 'stayed' gill5blue
  6. the date of the letter was 1st Feb 2008 remedy date: 15th February 2008 note its late now 11.15pm I will be back tomorrow evening all advice gratefully recieved
  7. Hi Thanks for the help so far. The 'application form' I posted on photobucket is actually the one my husband bought home with him when he applied. I did CCA 'AA' and they did not even send a copy of the 'application form'. They responded with current terms and conditions nicely printed out-it looks nothing like the copy I have. The help I need is understanding their wording of their letter: They state they have included a copy of the 'executed agreement' and a copy of the 'current terms and conditions' and they state they have complied under section 78 this is the bit that confuses me they state they will not be entering into any further correspondence relating to the provision of copy agreements? ARE they correct? gill5blue

  10. Hi All UPDATE Received a wonderful grovelling letter from Lowells, they have 'closed the account', so I now need to check credit file to see if it has been wiped off with no default showing I won't say it is a win just yet until I am sure it is all done correctly Gill5blue

Hi I would suggest 1)Write to the credit card companies and request the 'Consumer Credit Agreement'-look at the templates available on this site-and do not be embarrassed, start a new thread here for each credit card, ask questions. 2)The credit card companies pre 2006 agreements(possibly you need to check this date), thay are mostly 'unenforceable' and they only have 14days to respond. So after 14 days you are legally allowed not to pay them, you need to again write to them-use the templates provided and tell them the account is in 'dispute'. 3) Then deal with the rest of your life, keep updating your threads, always respond to creditors letters, read a lot more threads on this site-we are mostly ordinary people who got sucked in by credit card Co's chucking money and encouraging debt at us. Hi Stressed Luckily for me they actually did not have any thing, it was a credit card originally from Woolwich then taken over by Barclays, I cca'd barclays and their first response was they could not find any paperwork, and would not pursue me for the account, so this was easy for me. gill5blue
  13. I have a letter from one person already and thay have taken my advice and informed the ICO too, hopefully she is a cagger and knows what to do.
  14. Hi I could not resist informing Lowells of their mistake. I told them thankyou for sending me the unenforceable agreement and please supply me with true copy of the Consumer Credit Agreement as previously requested for nearly 2 years now. I also stated that contained in the same envelope was EIGHT other peoples agreements/application forms, and I have forwarded the copies to the relevant owners, and I also told lowells I took copies and informed the ICO of their 'Breach Of Data Protection Act '. One poor girl in the office is in trouble, for incorrectly posting nine peoples copies to one person. One Supervisor is in big trouble, all the agreements I looked at were unenforceable-all to be eventually written off. Im not sure who will have to deal with the ICO, hopefully a Manager Gill5blue
  15. Hi I had an account written off last year and last month it showed 6 payments late. I wrote to the credit card Co and pointed out their mistake(and included their letter sent to me writing it off) and today it does not exist on my credit report. I keep monthly copies of my credit report on 'word' for comparison. gill5blue

  17. Hi I have forwarded the copies to the repective owners and I have sent copies and informed the ICO. I have informed the dca of their 'breach of Data Protection Act', but omitted the names and addresses of the other people-they will have to request them and be very nice to me. Out of curiosity, does anyone know how much approxiamately we would likely to get in compensation. I could see how much they owed, bank account Nos, sort code, names, addresses how long they have lived at the addresses, how old they are etc, etc. My debt is unenforceable. Gill5blue
  18. Hi Everybody, Upon checking my credit report recently this supposed debt was recorded, I wrote to them, including a copy of their letter writing it off stating this was unnacceptable. I have received a grovelling apology from them and today it is not on my credit report, it has completely disappeared. WAHOO. So my win still stands. Gill5blue
  19. Hi I have sent all the copies on to the respective people with advice to contact the ICO, I have informed the ICO, with the evidence. I have informed the DCA concerned but omitted to tell them the name and addresses involved(whoops, well we can all make mistakes), they will have to write and ask me for more information, great, now I can be as awkward as them-ie ignoring my request for the enforceable CCA, not removing 'DEFAULT' on my credit file etc etc Good luck We hold a good hand of cards Gill5blue
  20. Hi I am reading this thread with interest beacause I received Eight other peoples CCA, but this was from Lowells. I tried contacting these people but was unlucky, so I will have to post them on after I have informed the correct ICO and OFT etc then I will inform Lowells what I have done and charge them for postage envelopes my time etc, I t looks like we are in a similar position. Hi: GKTP I will be forwarding them all to their respective owners soon, after I have exhausted all suggestions and posted them I will inform Lowells of their mistake 'broken the Data Protection Act'.
