  2. Hi Rebel Yes that pretty much sums it up I could email the template to the dealer today but would it be better to leave it till tomorrow? The only thing I am worried about is the finance company saying "you need to give them a chance to fix the car" Surely after the way they behaved when my husband took it back they can't expect us to deal with them? Thanks all

Hi Conniff I basically said in the letter that he had 2 choices either he could take the car back or I would reject it under the SOGA I also quoted the year :-/ he didn't even have the letter out of my hubby's possession before he refused to take the car back my hubby explained we had it 2.5 weeks he kept saying it needs to go to our garage but refused to fine the address he said this is private property the car is yours not ours Thanks Sorry yes as my hubby was parking it on the street he came over the road and said I accept your letter and you will be hearing from our solicitors he still wouldn't take the key I am going to send them recorded delivery
  4. Hi Sorry for all the updates but the dealership has a "email us" option on thier website could I email this letter and then send a hand written one by recorded mail and woul the email in my sent box act as proof? Thanks guys

Hi Just a bit more as my hubby was parking it on the street the guy came over and said I have accepted your letter and you will hear from our solicitors he also said he will get it towed somewhere else and make us pay for it Should I ring the finance company back today or leave it till tomorrow? Hi all Thanks again So here's the latest hubby arrived at dealership with car they have completely refused to take it wouldn't let him park it on thier forecourt they said it needed to be taken to thier garage less than a mile away tow truck man was happy to do that but they refused to fine my hubby the garage address My hubby has had to leave it in a street next to the dealership they refused to accept the letter my husband had to put it on the desk in the office the man who was there who as far as we know isn't the manager was telling the receptionist to not accept the letter he over heard my husband call him a t***on the phone to me and he is saying my husband swore at him he didn't and he had already refused to accept it My hubby has took pics of the car but had to bring the key home because they wouldn't accept it what should I do now? Thanks Just to add they kept saying it's private property the car is not ours it's yours

  10. Hi rebel Thanks I intend to ring them tomorrow but the car is being towed to the dealer today so what do we tell them when we drop it off I have drafted a letter basically saying you can either take it back or I will reject it under the sales of goods act 1974

Hi guys Rang finance company the dept I need to speak to speak to is closed until tomorrow they said the dealer may be willing to take it back can't see that somehow so what do I write in the letter to the dealer? Ask if he will take it back tell him if not we will reject also as my hubby will hand him a letter how do I prove he got it?

Thanks again guys Got a man fetching the car at 10.30 today he wants £80 which I don't think is too bad told him we need a headed letter receipt tol him why he said no problem Out fiancé company is open today at 10am I am going to ring them if I say we are rejecting the car what do I do if they say we MUST give the dealer a chance to fix it first?   15. Thanks Conniff So the first phone call we make tomorrow morning would be to the finance company right? And we need to say we have a disabled son we need a reliable car please help us reject this one so we can find another? Thank god out son wasn't there he was home with me he has Autism he would have found the whole thing very stressful I also need to get a receipt for the taxi don't i? The company he used is based in derby where the car broke down if I ring them will they send one? I need a cheap towing company the AA wanted £150 to bring it home Thanks again
  16. Hi Rebel Thanks so much for those links Do you think there's any chance the finance company will help is rather than us having to fight with them too? We don't have great credit we can't just walk in a dealership and get credit for a car we have had 2 cars off this finance company in the past and we have a good relationship with them our daughter recently passed her test she's 21 in a couple of weeks they have already said they will give her finance as long as me or my hubby go on her contract as well so we get on really well with them Having said all that I won't keep a dud car for that reason just would like thier help sorting it I do have a person on my email list from the fianance company my husband was dealing with before we found the car he would email and give her reg plates she would search them and tell him if the car was over priced etc should we draft a email to her? Will we be told to "give the dealer a chance to rectify the problem" before we are allowed to send it back Such a worry thanks guys

Hi Bankfodder The car cost £4000 but as I said we have it on finance we made the first payment on 1.8.14 up to now the finance company have been really helpful and I really don't want to get into a row with them (although I will if I have to) ideally I would like to hand this car back and look elsewhere for another with the finance company on out side but I think I may be dreaming We had a mobility car for the past 3 years but our sons DLA changed and he is now on low rate mobility so we need a reliable car for his sake Do you think the finance company will help us? Would the 14 day cooling off period be long gone? Especially since we have made a payment the man at the finance company did say to new on the phone yday "if we can prove the car was faulty we will certainly have the dealer fix it" If I put my house phone on speaker phone and record on my mobile that should work do I have to tell them I am doing that? Hi Guys Hope someone can give me some idea of what we can expect we bought a car on finance some 2.5 weeks ago it's a Peugeot 308 57 plate The garage we got it from offers a "30 day mechanical guarantee" my questions are the car broke down yesterday approx an hour away from where we live my hubby called the AA who towed it to the nearest garage car park as they wanted £150 to tow it home My hubby and daughter had to get a taxi home costing £32 my hubby rang the dealer and his receptionist said first he wasn't available then he had popped out then she said he's not back till Monday all in the same conversation so I feel we are going to have a fight on our hands The finance company were really nice when I spoke to them told me not to worry they would help sort this out the guy said "we have rules that have to be met this end too" he was talking with regards to the dealers So who would be responsible for getting the car to the dealer? Us or them? The finance company offer a 14 day cooling off period are they working days or any days? What can we realistically expect? What is the dealer obliged to do given the car is under a 30 day mechanical guarantee By the way the aa man said the "flywheel" had gone causing the clutch to go and he said it was mechanical Thanks guys

Hi guys Bit of an update still not had a refund either from this company or the bank Had a email from the company this morning saying that since I am accusing them of fraud I need to fine them the incident number the police have me when I reported it and also give them a list of people who have access to our bank account I think they are trying to stall me hubby is going to ring the bank again today

Hi all Thanks for all replies I know on the face of it it looks like my husband made a stupid mistake and we should just suck it up and I have said to him words to that effect but he is insisting that he recieved a text from a company stating they were offering a free service he never heard of or had any contact with "loans-only.co.uk until they showed up on our pending transactions the following day having taken £67.88 from our bank When you visits "loans-only.co.uk" website it comes up in big bold writing "one off membership dee of £67.88" he is a little naive but he's not that stupid he would never have agreed to that the original company who contacted him were either a cover for the real company or they passed on out details my husband ticked the box that said no 3rd party contact to me this is fraud The bank are now saying they need to investigate that could take 2 weeks they have at last agreed to stop this company being able to take anymore money from our bank they have asked for email proof of the company saying they know we want a refund they have recieved that My husband did contact the FSA about this who said this loan company was not registered with them our point is this transaction was fraudulent my husband had no contact whatsoever with the company that ended up helping themselves to our money I believe that is fraud and I believe the bank should help Thanks again guys I will keep you all informed

Thanks Dx Here's a text message my hubby just sent me don't know if it makes any difference Did you tell cag that I went on one website and that website which said was free gave my details to another website and it's them who took our money the bank are saying because I looked for a loan with the first website then there is nothing they can do Thanks again

Hi Dx Thanks for reply it is still ongoing hubby has rang lloyds back they are now wanting the email proof that this company have said we know you want a refund but we have found you 2 loans they have however agreed to stop them taking any more money out of our bank I will update as soon as I can Thanks again

Hi guys Got a bit of an issue my husband received a text the other day offering him a too good to be true loan and he stupidly applied for it I knew nothing about this until all of this happened beause I would have smelt a rat he applied they asked for his bank details just to confirm his identity they said he didn't even find it funny when they asked for his 3 digit security code (he doesn't come on cag and is not nearly as knowledgeable as me about this stuff) the following day a company called "Loans-only.co.uk" took £67.88 out of our bank they were of course a broker and it is not the same company name my husband received the text from We contacted lloyds who said they can do nothing until the transaction is completed which it has today they are now saying that we have to give this company 14 days to refund it we just keep getting the same automated response from them saying "we know you want your money back but we have found you 2 loans" Lloyds have told my husband This morning that not only are they not bothered that nearly 70 of our child's tax credit money was taken but that the company can now take what they like when they like because my husband has given them permission he said he would like to now refuse that permission they said no sorry nothing we can do Is this right? Please help
