  1. I heard that the test case was 14th Jan 2008 and was expected to last around 6-8 days
  2. welcome back lee We are busy firing letters off to our local MP's FSA and OFT at the moment (have a look at the general forum), most of the talk here is re the OFT case, there is so much good advice around at the moment (from a lot of the claimants, not the board), and we are all pulling together.
  3. We have a £2200 overdraft and are claiming nearly £2500 back, they havent threatened to close ours down. Not sure if its because we havent had any charges for the past 9mths or whether they are just not threatening to do it anymore. If you do go ahead and they threaten, then complain about their bullyboy tactics.

  12. Hi Irishrose, I am in the same position as you, mine was transferred from Basildon. Are the courts supposed to send you a copy of the defence, or do we just rely on Abbey sending us a copy?????. As we are just assuming that Abbey actually filed their defence with the court. Everyone should get something in the post within the next couple of weeks (there is a backlog in sending orders out confirming the stay). I honestly do not know why Southend seem at the moment to be the only way staying every claim they are dealing with.   14. Once your case has been transferred, then ring the court and ask what is their position on claims, i.e. are they carrying on/staying all claims. Hopefully your court will be carrying on. can I make a suggestion to all that read this thread, over in the general forum is a link called FSA to review waiver - please look at it and sign the petitions that are on there, we are trying to get as many people as possble to sign and bug their mp's
  15. Abbey generally send out a standard defence. A lot of the courts are continuing with claims, only a very few seem to be staying cases pending the outcome. why dont you ring your court and ask them what is happening re your claim. It might put your mind at ease.
  16. I have emailed my 7 local MEP's as well. Well I thought the more the merrier. If Southend Court stay all the claims as they told me that they will be in their letter that I received saturday, I am also toying of the idea of complaining to the 3 local papers around basildon. As a lot of the courts around the country dont seem to be putting a blanket stay on all claims

Also can I ask that anyone reading this thread, also look at http://www.consumeractiongroup.co.uk/forum/halifax-bank-bank-scotland/108984-list-all-mps-written.html It is such a good thread, and could benefit us all. They are trying to get a letter sent to every MP in the country regarding the unfairness of the waiver whilst the banks are allowed to continue charging us their penalty charges.
  22. Even if your cases are not stayed, can you help by looking at the thread ***must read****** help by writing to your MP - it gives a link to a thread in another forum. They are trying to get a letter objecting to the Waiver implemented by the FSA, sent to all MP's throughout the country, and are keeping an eye on who have had letters sent to. One MP has already written to the FSA to get them to state the reasoning behind their waiver. thanks
  23. I have emailed Southend this morning to ask why all claims at this court have been stayed, when others around the country are carrying on, and received a reply to say thanks for my enquiry and it will be passed onto the correct department for a response. i will let you know what they say.
  24. I have posted a link to this trhead on the Abbey forum asking everyone to write to their mp using the brilliant letter on here and let everyone know who the MP is that they have written to, so that we can try and send letters to all the current MP's
  25. http://www.consumeractiongroup.co.uk/forum/halifax-bank-bank-scotland/108984-list-all-mps-written.html This thread is a must read, please please write to your local MP opposing the Waiver the FSA implemented on our cases, you can then add your MP to the list, we are trying to make sure that we have bombarded all the listed MP's. Some are taking note and one has even written to the FSA to get them to justify their reason for putting a waiver on the claims. There is also a link on this thread that directs you to a brilliant letter to send to your mp.
