  1. If it is Hire Purchase then it is secured on the equipment purchased, i.e. musical instruments and not on your property. Please check exactly what debts are secured on your house and if you are in any doubt you can check through the Land Registry. Cheers Gladstanes

  4. My bitter experience tells me that you should go to Citizens Advice, explain everything and ask to have an appointment with a solicitor. This will cost you nothing financially. The solicitor can be with you in Court if it gets that far and will be able to tell the judge how you were given the loan, i.e. your personal circumstances at the time. You probably should not have taken the finance from LTSB at the time, but neither should they have offered it to you. I think that they are trying to scare you by counterclaiming and a solicitor will give you both confidence and skill in court. I have had personal experience of a Citizens Advice solicitor and he was excellent. This situation is not nearly as bad as it seems. All the very best Gladstanes This is my opinion.   5. Hallo. I have had several county court judgments registered against me because I was not able to meet loan repayments. I would just ask you to clarify in your own mind exactly what you are hoping to reclaim. If your daughter had a loan agreement and could not meet the repayments, was warned about impending court action and then taken to court in the correct process then it is unlikely you can dispute that. I would suggest that there would have to be a very good reason to get a decision in your favour for that side of things. However, as regards the unlawful charges on her CURRENT ACCOUNT then as you will realise from reading this site you are presently entitled to claim all of them. For example, if your daughter did not have sufficient funds in her current account to meet the loan repayment and she was charged for that in the usual way then I am sure you can claim. Please do not confuse defaulting on the loan account with charges on the current account. Should you be successful in reclaiming bank charges please insist on a cheque. My belief is that LTSB cannot just deduct these charges from a loan balance because the court , i.e. the law , has set the monthly payment. All the very best to you.   7. Hallo again. I was just double checking all charges on my account and I noticed two which I had missed in my original correspondence to LTSB. Should LTSB suddenly credit my account with the amount I have originally requested and I decide that I would like to claim for the extra 90 pounds that I missed first time round what is the best way to proceed? Do I need to claim separately or can I just claim the whole amount through the court? I have not yet completed court claim documents or filed at court. All input gratefully received. Gladstanes
  8. MONOPOLY23 HAVE A GOOD LOOK AT NATIONWIDE WEB SITE. TO OPEN AN ACCOUNT WITH THEM THEY WILL ACCEPT AS PROOF OF NAME A RECENT BANK STATEMENT OR HM REVENUE AND CUSTOMS NOTICE OF CODING ie tax coding. To get a notice of coding if you do not have one just call HM Revenue and Customs number from tne phone book and they will sort you out. All the best GLADSTANES
  9. More thoughts from bitter experience. Please ignore LTSB solicitors. The only entity of significance is the Court. If there is a Judgment against you it will be sent to you, but you should have the opportunity to attend court and put your case. Whatever the Judgment is anyway , you can still apply to have the monthly amount reduced in line with your circumstances. Please read all correspondence from the court very carefully. Remeber also that it appears some judges are losing patience with banks. THIS IS ONLY MY OPINION. PLEASE TAKE PROFESSIONAL ADVICE. As said it may well not be charged for depending on your circumstances. All the best Gladstanes
  10. Without knowing your exact circumstances it is entirely possible you are entitled to Legal Aid. Also I do not know if anyone else has had dealings with CAB (Citizens Advice) but my experience of their lawyer was extremely positive. I would suggest that you have nothing to lose by contacting CAB. They are there to help and they will for no charge. All the best Gladstanes
  11. Honory, I think the letter certainly makes telling points. However, could I just check the timings which may be a detail. You say that the claim was settled on March 19. You checked your account on March 12. Was this not before the claim was settled? Otherwise it is great. Regards Gladstanes

Also clarify in your mind the difference between any claims you may have on your LOAN account and your CURRENT account. I would suggest that whilst the two accounts are closely connected the two CLAIMS will be separate issues. The accounts will come under separate terms and conditions.   19. RedDeath. I can only admire your determination. Please take the very best legal advice available. As a pricing analyst you will know that you must protect your downside. Using the gambling analogy again- "every hand's a winner and every hand's a loser". Make sure they think you are holding a royal flush and watch them fold at the last minute.   20. Dear RedDeath, I have just read most of your thread. Bear in mind that by claiming contractual interest you are effectively getting a totally unrealistic return on your money from an investment point of view. The key point is surely have LTSB charged you this punitive rate of interest ON ALL FUNDS THROUGHOUT THE TERM FOR WHICH YOU ARE CLAIMING? Is it not fair to make calculations based on the return you could reasonably have expected on your funds had they been invested for you from the point at which they were unlawfully taken from you up to now. That is really why 8 percent is used I think. All the very best to you with your claim.

  23. Hallo all. Frome memory I sent first letter on or around Feb 19. Reply within two weeks was standard rubbish. Sent Martin Lewis LBA and heard nothing so sent a copy last Monday. I intend to file an N1 and would very much appreciate any input to avoid glaring errors on this form. In fact ANY advice is more than welcome. More power to ALL RECLAIMERS. Regards Gladstanes
