  1. I have a Cap credit card. They show interest as "Purchase" and "cash" im guessing that merchandise is the same as purchase. If you look at your T&C's you will possibly find they charge different rates, thats why they seperate them. Are you claiming CCI?
  2. This may be a silly question. Is the account in question stil "live" if not have you moved house at all since it was closed?
  3. Whatever you decide Hewst you will have the backing of us all here on CAG....Good Luck
  4. Could you not apply for B's defence to be struck out. It was 28 days + 7. Surely this alone is an abuse of process. Its about time the courts stood up and invoked the rules of the legal system. It's very much a case of the tail wagging the dog in my humble opinion. I for one am getting extremely P**sed off with the arrogant attitude that Barclay's show to both there customers and the legal system. Its about time the Courts hit back and insist they play by the rules. Sorry for the outburst but like tony im hopping mad
  5. Having not been in this situation i can only offer limited advice You can fill in the N244 form on the PDF sheet but are not able to save it, so print off at least 3 copies. Yes use as MB's post Then i presume a new N1 form with the new POC's, again print off at least 3 copies. The Abbey ones look great, obviously ammend to suit your own case. give it to court and bobs your uncle. Hope this now puts your mind at ease. I know it will have cost you an extra £35 but its best to get it right. Please correct me if any info is wrong
  6. Wow Tez Looks like you have had a busy day. Was it a post i made on another thread re POC's that you spotted?
  7. It will take at least 2 weeks to be transferred to your local court, then a case of how long is a piece of string before you get a date
  8. You should also take a look at this http://www.consumeractiongroup.co.uk/forum/halifax-bank-bank-scotland/97691-contractual-interest-precedent-lost.html?highlight=contractual+precedent+lost
  9. A legal prescedent has been set re CCI. See below http://www.consumeractiongroup.co.uk/forum/halifax-bank-bank-scotland/97691-contractual-interest-precedent-lost.html?highlight=contractual+precedent+lost
  10. Hi All Acceptance letter returned on 14th. Their cover letter said payment will be made within 10 working days of receipt of acceptance. I wonder how long they will take? I can guess...lol Trucker
  11. lol...yep... but won't it cost £35 to change poc's?
  12. Point taken... we must be careful... i put a comment on another thread that the POC's that are causing probs are from the other site
  13. Come on Daz you know it word for word..... Especially as the SOC's are being sent
  14. Don't get trigger happy when 14 days is up... come back and ask the question before you hit the judgement button
  15. It would be helpful if you could post up here the first 3 points of B's defence Trucker
  16. I get the feeling that the original POC that you used was from Martin Lewis's site. By the looks of it you have not included your account number on POC, which from reading other threads could be a problem. You may still need to amend. Thoughts please saintly!! All the POC probs seem to have originated with the other site when filed via MCOL
  17. gregob Please stick to 1 thread, don't start a new 1 everytime you have a question as it becomes confusing trying to keep up with your progress
  18. Roxy You should get B's defence any day now. Transfer usually takes a few weeks and the court date really depends on your local court, their workload etc. SOC = Schedule of Charges. Have a look at this thread for T&C's http://www.consumeractiongroup.co.uk/forum/bank-templates-library/101412-document-library-work-progress.html#post956704
  19. Assuming you did eventually file your N1 then i would continue with the court action. Send B's a rejection letter http://www.consumeractiongroup.co.uk/forum/bank-templates-library/25716-rejecting-offers.html
  20. You don't need to do anything at mo roxy. You should recieve a copy of Barclays defence together with a notice of transfer. When you get the defence please post up the first 3 points as i guess that they will ask for SOC
  21. I think Dino is away until the 23rd July. I think you should contact other members of the Team bigem.
  22. Title Page Photman V Barclays Case Number *********
  23. If you can get into the Branch do so and speak to the person that took the cheque from you. You may also be interested in this that states personal accounts can draw up to £1000 against uncleared cheques Ask Barclays a question
