  1. I dont use my overdraft (much) anymore, so asked for this fee (£3) per month to be removed. They have continued to take it and ignore my letters. Is this a compulsory charge? the £3 has yet again taken me over my limit so will no doubt be charge next month for the privelege! I have also written to the bank on the last two occassions before they took charges each month asking them not to do it because i would just claim back. The first time they sent me a copy of my T&C 3 weeks later, this last time they complete ignored me - getting really fed up with them. I also was told a new offer had been send out to me on 17th August. Nothing arrived, emailed S Watt and got a response waying sorry it is 'lost in the post', we'll send another. argggggh!
  2. that is the breakdown. i have overdraft loanguard of £3, interest at £0.76 and this maintanance of £32.88? i'm very confused. i hate how they disguise these figures.
  3. I'm the middle of persuing RBS for remainder of money they owe me, already paid up £1500 lately plus another £300 prior to this, but still more to come. This month I've been very good, once exceeding my overdraft (of £100) by £2 thanks to my loanguard charge coming off before pay day. grrrr anyways, I've got my statement and got a 'maintainance charge' of £32.88 , now i woudl presume this was what they are charging me for going overdrawn (i think a tad not in line with guidelines but that is by the by) but it seems a bizarre amount, any ideas? Thanks
  4. just noticed my spreadsheet had a wrong formula and half the interest had not been added on so revised charges, interest and CI are:- £2278 charges, plus £1380.02 interest (at 16.35%) on charges + £3384.31 contractual interest (at 29.84% as per RBS unauthorised borrowing rate)= £7042.33.
  5. right progress sent request on 19th, nothing by 3rd so lba sent, but response received yesterday dated 26 June? never mind. they are offering £390, tbh i'm surprised they offered anything after their previous 'full and final settlement' so impressed with that. I have sent a decline, only accept as part settlement. so thats been sent today. I'm a bit confused how I'll go ahead with a court claim as I'm in Scotland Basically I'm claiming £5717.66 (£2278 charges, plus £956.21 interest (at 16.35%) on charges + £2483.45 contractual interest (at 29.84% as per RBS unauthorised borrowing rate)= £5717.66. but this is minus £1858 already received in goodwill gestures, so where do I start. I'm a bit confused where to take the goodwill gestures from before thinking about a claim? any advice welcomed Thanks
  6. I am putting together my schedule of charges. I've used the following rates, can anyone tell me if they are correct? interest rate for royalties gold - 16.35% unauthorised borrowing rate for CI - 29.84% Thanks
  7. hi all just received my statements from rbs. i requested them in March, they sent me an offer of £1500 without sending statements, i accepted and persued statements. i have totted up and it comes to c£3k without interest. obviously i have to deduct the £1.5k which ive received already. how do i go about this? im a bit unsure how i deduct the 1.5k already received. I'm going to do my request tomorrow so any ideas gratefully received. i'm going for CI. is this at 29.84%? thats the rate i can find on their website, any confirmation grateful. also I'm in Scotland so not sure how this affects my claim. once interest is on its about £7k arrggggghh which is well outwith the Scottish limit. Thanks Fi

    egg were easy!

egg have been an easy one to crack here. asked for statements (didn't so an sar so no fee). received within a few days, send prelim for £200 plus interest, got an offer of £40 within days, refused, asked again last week, letter today refunding £200 plus interest of £96 woohoo. wonder why they are so variable. Donation winging its way shortly once cheque cleared. capital one, GE and RBOS here we come

    can you?

go after further charges once you've signed that 'full and final settlement form'? does it stand legally? i have discovered I probably have a lot more than was offered to me and signed the form. I have folowed up with a letter saying that i accept as part settlement until they supply statements (been waiting since 12 March). i stated they can take the money back if they wish until i know the true cost. any legal advise gratefully appreciated. Fi
  10. Hiya Im putting in my small claims for Egg and Capital one who are doing the 'we'll give you the difference between £20 and £12, final offer .... etc etc' does anyone have an example of wording used in their small claims to include contractual interest. I've done one but but want to make sure the wording is very accurate. Many thanks Fiona
  11. after my claim went into to capital one for c750, they have credited my accoutn with a measly £120 grrr. they sent me a letter about it, but it reads. ____________ Dear **** BODY >> >> We trust if we dont hear from you >>>>>> >>> Yours sincerely ***** ______________________ so i guess half the letter is missing, ive phoned and asked for a duplicate to be sent, well a PROPER letter, idiots!
  12. I send off an SAR for my closed burtons adn new look accounts and got responses today. basically one said that they couldn't find any transaction history therefore unfort could not comply. then the other asked for a cheque for the SAR request. can they just say they cant find anything?
  13. Hiya Im taking on a few companies. RBS to the total of a couple of k, probably about £3k, maybe a bit more. I'm also taking on Capital one to the tune of £800ish. these both include interest. What is the best way to go about it? I live in Scotland, should I get a PO Box addy in England and go through moneyclaim? or should i go the FOS route? or should i do a summary cause or whatever they call it. I'm baffled. Thanks
  14. what do i do if they say they cant find statements? The accounts closed in November 01, so theres a chance they could stall long enough for the 6 years to be up and i coudln't claim? help!
  15. Hi I have writen to GE Money asking for my statements - got a letter back saying it had been sold to Thames Credit. Can I contact them for info? I woul dhave thought given account was with GE that they would give statements. anyone else had this? the account was closed in 2001 Thanks
  16. can they take the money back? I thought given it was a goodwill gesture they couldn't? I have paid off my overdraft and taken my limit to zero so there isn't really much money in there to play with, but what I do have i need for living! I have sent the initial letter but will sent the SAR with the bit about part settlement. Has nayone had money taken back off them before? Thanks
  17. what do you reckon? It says it hopes this resolves my complaint, which i never made....... RBS LETTER Than you for your letter of 12 March 2007. I am sorry that you have concerns regarding the charges that have been applied to your account. We explain all of our t&s including our feeds and charges at account opening and they form the basis of your agreement with us. Full details are available at any time on our website and in our branches, and updates are sent out regularly tour customer. For your convenience I am enclosing these. RBS has for a number of years provided many every day banking services to customers free of charge when accounts are in credit of within a previously agreed overdraft limit. These services include access to our branch network, cheques, Direct Debits, Standing Orders, UK debit card transactions and UK ATM withdrawals. Whilst our services are provided without a corresponding charge, we do make charges when customers, by their actions, request an increase to or the creation o fan overdraft in excess of their previously agreed limit. By reviewing such requests we provide an additional service to customers in many instances allowing items to be paid either by creating or increasing an overdraft. These charges can be avoided entirely by arranging suitable borrowing facilities in advance. For these reasons, we do not agree with the basis of your complain. We believe that the charges we levy are for providing services and that they are not penalties or charges for default. Furthermore we believe that these charges are fair, reasonable and transparent. However having reviewed your case and as gesture of goodwill and without admission of liability or error, in this instance we are prepared to offer the amount of **** paid direct to your account. This amount excludes any packaged account fees or interest paid. To accept this offer in full and final settlement of your complain please let me know by completing the attached form and returning it to us in the reply paid envelope provided. If you would like to discuss this offer please contact the number above. Any charges that properly accrue in the future will be applied to your account in line with our published tariff and in accordance with your agreement with the bank. Should you be unwilling to accept these, we may need to consider if we are prepared to continue to provide you with your existing banking facilities. I trust this will resolve your complaint. FSA guidelines state we can regard your complaint as closed if we do not hear from you within 8 weeks. If you do need to take your complaint forward please let me know within this time. MY RESPONSE Dear Mr Watt Account: * Letter of 22nd March Thank you for your letter of 22nd March, where a goodwill gesture offer was made for £* and subsequently accepted. I am a bit confused however, as I am yet to receive my statements as requested in my letter of 12th March or order to calculate the ‘real cost’ of the charges applied to my account over the past years. I would be grateful if a list of all charges, or failing that, all my statements which you have available to you, preferably from the initiation of my account could be sent to me as soon as possible. Yours sincerely
  18. Hi I wrote to RBS on 12th March requested my statements , on 22nd March i got an offer of £1500 without ever asking for a refund. it was the usual bog standard letter, we dont admit liabiility etc etc etc. i accepted it. But I realise now it was probably a lot more I was owed, and i have never received my statements from them. given i never put in a claim, can i go back and claim the rest? or does the signature form specifiy what you are signing for? given the offer says its not a refund but goodwill gesture, is it worth trying? sorry if this sounds greedy, just wondered if i have a leg to stand on? i guess im lucky i got an offer (i guess this was a mistake!) so quickly. Thanks lots
  19. I feel this might be a hard nut to crack. i sent a letter to them, no response so i sent a secure message (it's an old egg card account but have a loan with them, - to pay off the credit card ) i got a response to my message saying they hadn't receive my letter (surprise), but if i sent a cheque for £10 and told them what statements i wanted and provided proof of my new address i could have them. i also had to respond to mesage to confirm this. so i did. then i had another message saying they statements would be free because im an old customer (not sure of the logic in that - charge your faithful ones and let your abstainers go free!). and they didn't need proof of ID cos my acount was closed, doh, how litle sense does that make. they said it would be actioned immediately. fingers crossed. Is this likely to be a long haul? Thanks Fi
  20. I had two accounts with them and they hammered me for charges in the early 2000's - up to 2002 i think. i want to call them to find my account numbers - does anyone have a phone number - it was for a new look card and burtons card. Thanks
