  1. Did phone them and both I and she were very polite...She said they will try and send the missing statements and as soon as possible. I asked her how long it would take and shge said up to 28 days so i asked her to put a note on the request saying that I would make a complaint to the Ombudsman for non-compliance and she said she'd make a note of it...all very polite...I said by the end of the week so we shall see... Rah...and ...thanks!
  2. Hello again...I was entering the details into the precourt spread sheet and I figured out what might have happened... They have sent me records f0r 2001 twice and probably kept my copy of the missing statements, where these ellusive other charges are probably detailed... Any advice on getting hold of these records...Write a letter? Saying what? Theaten with court proceeding for non-compliance...? Or a phone call...?
  3. Thanks... I'm currently looking at the details sent back from MBNA listing the transactions and charges and trying to make sense of it all... They have sent me a breakdown of all transactions of both credit cards with 2 "Breach fee summary's" for each card listing all the overlimit fee charges, overlimit fee adjustments, late fee charges, cash advance interest, credit insurance fees, cash advances ATM, cash advance fees, retail sales interest, payments, and a few others like special cash interest, electronic balance transfer fees and a few of the retail sales, but not all if i cross reference them with the statements... These are subtotalled in two coloums..."Fee amount" and "Above OFT". There is a summary at the top... Most interesting is that someone has written in pen near the Total Breech Fee ammount...(ie, the money figure)...quote..."+24 from copy stmts 434". I presume that this is refering to the charges that only show up on the photocopied record kept by A+L before MBNA took over the running of their credit cards, and 24 multiplied by £18 (the fee charged by A+L at the time) is 432...two out from their figure of 434... However I can only find 6 of these charges on the photocopied statements and copies of statements between march 2002 and march 2003 have not been included... This may mean that I didn't use the card between these dates, or that they simply haven't sent me those records...but that maybe where the missing charges are...or they are trying to confuse me deliberately... Very frustrating... I have to assume that they have sent me complete records and base my claim on the set of statements I have recieved rather than simply trust whoever wrote this on my breech fee account summary... I suspect the card wasn't used between these times as my final payment in March 2002 was a lump sum of over a thousand pounds bringing the account to zero...so where are the other charges the hand written note referes to...unless they aren't unfair fees and refer to something else entirely... I shall plod on... Oh...and well done if any of you read all that...
  4. Yes...I know you're right...Thanks... I kinda wanted someone to tell me to take the cash...but you're right, I will need that credit rating someday...and I could clear the balance if I persued a claim... Arse...and thanks...both...in equal measures... (Have you been speaking to my mum???)

Right...I've already short settled on two MBNA credit cards...I owed aprox £1500 on each (totalling aprox £3000) and I paid £1600 as a short settlement on both cards...leaving £1400 outstanding, and their letter said they will not persue the balance... I have just worked out that I was charged aproximately £1500 in bank charges (without interest) which is £100 more than the £1400 balance which I haven't paid and they won't persue. They have already sent me cheques for £290 and £440 which i can cash now and walk away smiling...BUT...if I claimed the charges back in court, would the full settlement of £1500 simply be taken off the outstanding balance of £1400, leaving me with only £100 to spend or will that be awarded to me as a cheque... Of course what I'm trying to work out here is how to make the most money back from MBNA that I can actually use rather than getting awarded money that will simply reduce a balance on paper... (I know this might seem irresponsible, and I if I removed the entire outstanding balance I could get the defaults removed from my record but I'm just past caring about my credit rating and I won't be in a position to get a mortgage until well after they have come of my credit file anyway...) So to reap the most usable cash should I cash the cheques I have now...threaten them with court to get a higher settlement figure, THEN cash the cheques...or take them to court and go for the full amount, provided I know they won't simply take it off the outstanding balance...(will they?) Ahhh...this is my point...There will be a piece of legislation somewhere to govern who has control of what information when this happens...only I don't know what it says...and one could go mad trying to figure it out... I'd say at a guess that both MBNA and A&L would have control over information regarding transactions and charges pre 2003...but that's a guess...
  7. Yeah...that's what i figured...sent them off this morning... All I can do is follow the procedure and hope for the best... Does most of the trouble with MBNA occur becuase they fail to release the info on transactions and charges requested in t the SAR? If so then I have fairly complete set of statements, so it shouldn't be too much of a hassle...or am I missing something?
  8. Indeed...never been happier to give a tenner out my own pocket...such a good forum and such a good site... I will be back with more silly questions that a toddler could answer as I'm sending out 6 SAR's in one go and will be juggling them all at the same time...so there maybe more tenners to come, but looking at my stoodent loan, it may be a fiver next time...watch this space...

    MBNA or A&L

    OK... two things... First...I'm about to send off my SAR and presume i'll get the standard responce...What is this FFSA Mass complaint of which you speak? Second, charges made on my A&L credit card pre 2003 (before they were issued through MBNA)...will I ask for a refund through MBNA or A&L? Who do I take to court? I presume it's A&L as they were the ones who charged it!

Started another thread about what to do about having multiple account numbers on one credit card http://www.consumeractiongroup.co.uk/forum/general/84829-one-account-different-account.html Antone else here have multiple account numbers for one A&L credit card account account from when A&L stated to issue their credit cards through MBNA in 2003...? If so, then which account numbers do you send to which company (A&L or MBNA) in the SAR to ensure one gets the all the details... Do I send the A&L credit card account numbers (pre 2003) to MBNA or do I need to request these from A&L separately with a new SAR...? [bribe] As I said in the other thread...I'll donate another tenner to the site if I get an answer from someone today;-) [/bribe] Oh...and apologies at being so feckless regarding this procedure...I'm still trying to send off my SAR's...I'll be much more of a pain when I need to fill in the spread sheets and work out interest...   13. Bump...seriously need a bit of advice on this... If it comes to it, I'll send my old A&L credit card account numbers to MBNA in the SAR...but if I do this will this be a reason theyc ould use to delay sending me information (could they see it as an attempt by me to ask for information about A&L credit card details that I'm not intitled to recieve through MBNA, and stall the process while they go through more security checks...?) I've checked the FAQ's and searched threads but can't find anything specificaly related to this issue...but sorry if it's blatantly obvious...I've just missed it. Many thanks all... I posted this question on the end of a thread in the Alliance and Leicester forum...but I've got the Data Protection Act S.A.R - (Subject Access Request) letters typed up and I'm itching to send them off...so thought I'd start this thread... My question: Sometime towards the end of 2002 and beggining of 2003 A&L partnered with MBNA resulting in any A&L credit cards being issued through MBNA... The account numbers changed as a result...This means that some of my credit cards statements have different account numbers depending on wether the were before or after the switch... I'm about to send off my DPA SAR letters to the banks I deal with (in this case MBNA) but need to know wether if I only send them my current/present account numbers they will only send me details of charges made to my accounts while they had their new numbers...or will MBNA have to look back to when the account was handled by A&L under a different account number and send me those details as well? Or will I have to send a separate DPA SAR letter to A&L to get details of charges made before MBNA took over the running of A&L cerdit cards? I have put this post in the general forum because this may be a general issue that affects other banks as well as MBNA/A&L claims...and the the answer is no doubt a piece of legislation that will affect all banks similarly... ...sorry if it's in the wrong place...Feel free to move it if required...
  16. Phoned them up this morning and got the sort code...thanks! One more thing though... I've decided to claim for charges made back as far as I have records... A&L handed over their credit card service to MBNA in 2002...ish...Before this time I have found a different account number from the current one...ie. when they switched to using MBNA, the account numbers changed... Does this old account number have to be included in my Data Protection Act S.A.R - (Subject Access Request) if they are to return all the required information...or will charges made under the old account number be found and disclosed to me if I only submit my current account number? Also, do I have to apply to A&L for info regarding charges made before 2002 and to MBNA for info regarding charges made after 2002...even though they are the same account? I've been going through about 7 years worth of statements for about 8 different account and I've found lots of account numbers...as you can imagine! Many thanks...

I had an account with A&L which I closed back in 2001...I have the old statements but it only gives me the account number and says to look at the front of my check book for the sort code...Obviously I don't have the check book anymore...How do I find out the sort code for my SAR... It was the Bournemouth branch...can IU ring them and ask for the sort code of the Bournemouth branch? Will they tell me? Sorry to be a nusiance...again... Many thanks!

  19. Thanks... I know what happened... I was looking at this forum but using templates from another site and I got confused...duh! I'm using this sites templates now and got it all organised last night... But just so I know (and I almost embarrassed enough to PM this question to so only you know)...I make my £10 cheques payable to the company's name ie. Barclays Bank Plc and MBNA Europe Bank Ltd...yes? There isn't anothe department I need to make them payable to is there...? And thank you for the welcome...
  20. Ok...I need to know which letter to use when I send of asking them for a list of all charges made on my account... I'm using the standard letter found on the Unfair Bank Chages UK web-site linked below... Unfair UK Bank Charges Free help from Govan Law Centre, Glasgow On most of my account I have both charges for non-payments AND charges for honoured payments...so which letter should I send...? Oh and are Barclaycard and Barclays Bank the same organisation as far as me paying to recieve information about my charges...or will I have to pay both of them? And the same for Alliance and Leicester credit cards and MBNA credit cards...are they to the same address too or do i pay both? Oh and one last question...Credit cards don't seem to have sort codes...so I won't need to provide one when I write to them...jusst my name and account number...yes? Many thanks Drew P.S. Yes...I see what your saying...Basicaly, if when i look into it the charges are more than the remaining balance then I stand to make a bit of cash back, but even if they aren't then it will reduce the balance and look better on my credit file... I'm just waiting now to get the cash together to get the list of bank charges from all my different accounts but once I have a clearer picture of how much i've paid in charges then i'll know if i can think about getting the defaults removed or not... Out of interest, if i have two accounts with MBNA does the £10 charge for getting the breakdown of charges apply to both or just one account...do they do two for a tenner, like a BOGOF offer...or is it £10 per account... *ooo...let me guess...bank...charges...that'll be ten quid each then*
  23. Ok...so if i try that one then they'll be able to persue the balance even though they've said it won't be persued...and if I try and claim the charges back then the short settlement no longer stands... Just to clarrify...that is what you're saying...yes?
  24. ...Ok...read the FAQ's and I'm well aware that if I missed the answer to this one I'm gonna get flamed but here is my question... I recently closed two credit card accounts by accepting their offer of me paying them aproximately 40% of the balance. I paid an A&L credit card account and an MBNA credit card account (both owned by MBNA) a total of £1600 and they have... "...REGISTERED A PARTIAL SETTLEMENT WITH LICENCED CREDIT REFERENCE AGENCYS..." and go on to say that my default will remain but they won't persue the remaining balances... Can I still claim back my charges? If not then I've got plenty of other accounts to chase and I'll love every second of it... Now if this in in an FAQ or there is another thread about this then I throw my self at your feet and beg forgiveness in advance... p.s....will be donating some cash to the cause when my student loan comes through in April...
