  1. I've just won my case against Abbey! My original claim back in November was for charges alone at £3789.00. As time has gone on - plus interest, court costs blah blah blah - this week I've won £4815.00 so I'm well happy! My advice to anyone starting a claim against Abbey or indeed any bank is stick with it, put in the work on your court bundle & you will reap the rewards. Where do I post my litigation details?? Thank you
  2. Hiya - I have written to Natwest a couple of times. recieved my statements from them & worked out that my charges come to £3063.00. I wrote to them & asked that they repay the charges & they wrote to me saying that 'given the work inolved in assessing your claim we anticipate that we will be in a position to respond within 6-7 weeks'. I wrote to them again & said if they didn't repay the charges I would take court action but since then I have received exactily the same letter saying exactly the same thing (there will be a response with 6-7 weeks) but I've had this letter 5 times, even received 2 on the same day! Is this a cheeky Natwest tactic, should I give them 6-7 weeks or should I continue with my claim completely regardless of anything they are saying? Any help with this would be fab, many thanks.
  3. Hi there! I'm currently taking Abbey through the court process & doing well with that & thought I might try with a Cahoot loan I had...when I say had, I mean I couldn't afford to keep up the repayments & after about a year of Cahoot applying further charges I could not pay, I contacted a payment management programme (Payplan) who I now deal with to pay Cahoot. I hope this makes sense!! Does anyone know if I have any grounds for a claim for the charges with Cahoot considering that this loan account is now in a payment plan?? Or indeed if anyone has been in a similar situation & been successful / unsuccessful?? Many thanks
  4. Hiya. I have received my court date (19th July) & have completed & sent my court bundles. My case is being heard through the small claims track & what I would like help with is this: has anybody claimed for prep costs & succeeded & when would be the best time to apply for these costs??! I'm aware that as it is a small claim case, I may not be successful with claiming these costs but I would at least like to try as it would be almost an additional £500.00. Abbey have until the 6th June to submit their equivalent of a 'court bundle' so should I write to them now (& of course the court) explaining my intention to claim these costs, should I leave it until after 6th June & see if they do submit their bundle or should I wait until nearer the court date & ring them to negotiate OR should I wait until the case is settled then write to them?? Any tips would be greatly received, thank you x x
  5. Hiya! Just read on a thread somewhere that I can claim for prep costs, plus ink/paper/postage etc!! Prep costs guideline claim = 40hrs @ 9.25/hr. As I (like many of us) would like to claim for as much as poss (& putting the court bundle together did take AGES!) - as I have already filed my court bundle (& awaiting court date)- at which stage can a file my vlaim for these charges?? Has anyone else done this & succeeded??!!
  6. I am awaiting a court date & have heard nothing from the court or Abbey for almost 3 weeks. I have completed my court bundle etc & don't like all this hanging about! My AQ was submitted by 7th April as requested & Abbey apparantly have filed theirs (I rang the court to fond this out), is this really just a case of sitting on my backside waiting to hear from the court or should I write to them to try to speed things up a tad?? Has anyone else had to wait this long? The court did say they would contact me within 10 working days & haven't so any tips would be greatly appreciated!!

  8. Okie dokie - so the cheeky little rabbits at Abbey have filed their AQ (I rang the court this morning to find this out). I have completed my court bundle & submitted it to the court & of course one to Abbey. When I submitted my AQ, I also enclosed a copy of a draft order of directions which stated the information that I required from Abbey - however, I have received nothing from the tinkers. What do I do now?? HELP!!!

    Ok chaps - can anyone help me with this?? I have sent off my AQ along with my payment (also sent a copy of AQ to abbey) & draft directions (also sent to abbey) etc... asking abbey for all relevant info within 14 days. My AQ had to be submitted by the 7th April (which it was) & I also made sure that all the info that I had put together as stated on the draft order for directions was sent to abbey & the court. I have not heard a carrot from either the court or abbey saying that abbey have submitted their AQ to the court or indeed the info asked for as per draft order for directions. How long do I have to wait before contacting the court or abbey to find out what the dickens is going on?? Any help would be fab!
  10. Hiya! I'm new to CAG but I'm quite a way down the line with reclaiming my bank charges from Abbey. I am awaiting a court date & only now starting to feel a bit out of my depth!! I have prepared my court bundle already but would like to add a few more bits & bobs to strengthen it a bit - if ya know what I mean??! Does anybody have any ideas that could help? I thought maybe something showing how much it actually costs Abbey to send me an automated letter against how much Abbey charge me? Also some witness statements etc... Does anybody know where I can get this info. or any tips would be FAB!!! Thank you so much, CAG virgin
