  1. i got my sar and my reply from my initial compliant. the standard stuff saying they dont see anything wrong with my application and i ticked the box saying i want ppi. funny thing was though it wasnt ticked on the screenshot they sent. i applied for my sar at the time i got my letter saying the investigation would take 10 weeks because of the back log. anyway they are saying thats the end as far as they are concerned. what do i do next? i know 100% i wouldnt have asked for it because of the way i work and being stung in the past. i am thinking the box may have been pre selected and you have to de select it. still i am really annoyed by it all. i was annoyed at the time i cancelled it because i know i didnt ask for it. i rang them about their "investigation" and i mentioned about the screenshot they sent the box wasnt selected but they just said it was an example of the box and not mine. what should i do next? send them a letter saying i am going to the fos?
  2. well how can they prove they've not mis sold it to me if they will only supply 6 years worth of information? or is it up to me to prove i been mis sold it?
  3. hello, I took out a capital one loan in 2003. Because of the way i work (independent contractor through a ltd company) I refuse to have any type of insurance with loans/cards as i have been stung from an insurance that was suggested i took out on a new car i once bought. i was out of work once and tried to claim but was unable to so i have always seen it as a waste of time and never requested or agreed to it since. anyway back to capital one. i got this card in 2003. as far as i am aware i have never asked for ppi insurance. the only reason i can think that it had slipped though is that the box was pre-selected and i missed it. anyway i work away a lot and never checked my statements from opening to 2008. in 2008 i checked my statement i think it was when i set up my online account and to my surprise i had been paying ppi for 5 years without even being aware i was paying it. before i go further and before people start saying how can not check my statement etc etc it is easy. i only used to check my balance on the telephone and yes i did this for 5 years so i did not see the need to check my statements. i knew the payments and apr were extortionate and i just put it down to that. i do remember ringing up straight away and cancelling it stating that i did not even ask for it to be taken out and at the time asking for it to be refunded. i have sent in a letter of complaint. i got a reply back last week saying it will take 10 weeks before i get my case looked at. in the mean time i am applying for my sars information so i have that to hand if they refuse me. looking at the threads on forums capital one seem to be very difficult to try and get my money back from. does anybody have any advice that will assist me? i am expecting the letter to come back with with i didn't tick the box but it was sold to me when i activated my card. i am expecting there also the phone call not to be recorded and a transcript to be done. i know 300% i wouldn't have had it over the phone because i never take it out after my previous experiences.
  4. just had yet another company offering a pain free liquidation for the sum of 4k + vat. saying that if i have a interview with the OR (which i presume is receiving officer) then i will be chased for taking illegal dividends. are they scarmongering?? i am starting to think how can they offer this service with no comebacks????
  5. i have ceased trading now and the letters have gone out stating this.what happens next?and i am suopposed to submit a vat return at the end of this month so what do i do with that?
  6. i have another question. if i cease trading. what happens to my buisness bank account? do i close it down or do i leave it open but dormant? the problem i may have is its with the same bank as my personal account and they are linked. i.e. i cant get a personal loan without the approval of my buisness manager.
  7. i was thinking last night. the hmrc encourage trading whilst insolvant!!!the lady i spoke to said to pay what i could afford. i told her i was thinking of going insolvant but i did want to pay it off long term. she said pay the 500 for 3 months and to phone back to see where we are and to think more about what i'm going to do. seems strange that they are encouraging me to trade whilst insolvent to pay something to them. i think that is all they are after to be honest. just to get something out of me. but looking back i have been chasing it for 10 years and year after year it because of the hmrc not giving me time to pay things that i am trading insolvant. could this be a defense i wonder?

  9. i have just had a woman from hmrc calling me. asking for the payment in full. to my surprise i said i would need 2-3 years to pay off what i owe. that wasn't dismissed. i have to get back to her by tomorrow with what i can afford.
  10. i have set up a new company and have my letter ready to tell my creditors i have ceased trading. see below Dear Sir/Madam Account No: _____________________________ I am writing to inform you that xxxxxxx Ltd is technically insolvent and hence has ceased trading as of [date and year] The company has insufficient funds and no assets to formally go in to liquidation and hence invites creditors or members to issue winding up proceedings should you wish to do so. If it is not subject to any formal winding up proceedings the intention is to apply for Strike Off under s1003 of the Companies Act after a period of three months from the above date. Yours faithfully i can only apply for the strike off after 3 months i think but i think i'll get beaten to it. toddle is this the right way about going about things?

  14. i forgot to say. i rang the business helpline. although helpful they have made me feel worse! it looks as though i have been trading insolvant. the lady on the phone said this will almost certainly mean i will be chased for tax personally. if this happens does anybody know if they will be more flexible on how i pay it back? i am now sh!tting myself.
  15. I don’t think I’ll get the chance to strike it off as the ccj went to court last Thursday. Apparently it’s not long until they come knocking. I will write to them though and I have ceased trading.Some company rang me today saying they'll liquidate me and it’s a lot easier and won’t leave a mark against my name like (they say) the hmrc liquidating me. anyway they will only charge me 7k plus vat!!!! if i had that i'd give it the hmrc and pay off my debt. What happens if the hmrc liquidate me? I have read on here some person had an interview with the liquidator and it was painful!!!!! This is what I am scared off!!!!!!
  16. So toddle I can cease trading with this company now and deal with the debts etc whilst starting a new ltd company. My accountant is rubbish as well. I ask him what I should do and all he says is well I’ve had the money. I know he is right but it’s the last thing you need to keep hearing when all you want is advice.I cannot go down the sole trader route as the companies I do contract work for won’t allow it.To be honest I want to pay the money back but need to do it over a good few years but they won’t let me do this I would imagine.What’s my next step with this ccj?I have no assets and the only person I have a contract with is the mobile company which I presume I can transfer to my new company.

  18. Hi all, I received a letter from the county court saying the hmrc was seeking a ccj against my limited company for corporation tax. I owe 19k in total. This has risen over a few years. It started in 2001 when I was out of work for 12 weeks. I foolishly used my tax money thinking I could pay it back. I have chased this ever since and it’s got to this. I honestly don’t know what to do next. I am a one man contractor limited company with no assets. I have been paying the minimum PAYE to get my Ni stamp and taking the rest out in dividends. Now I am scared that if I go into liquidation they can chase me personally. I have tried to catch it up over the years but I would have to re pay it over 2 1/2 to 3 years to make it feasible and something I can realistically pay off. But they won’t have that at all I wouldn’t imagine. I hear of people going into liquidation and I have avoided this for 11 years. I am scared of that because it’s a massive unknown for me. I don’t have the cash to do it voluntary and I need to carry on working after it. I don’t suppose you can be a director of two limited companies whilst one of them is going through insolvency. And what happens with being able to operate as a limited company after insolvency. The other thing I am scared of is them chasing me personally for the cash. Someone who I know has said they could pursue me if they feel the company has been run badly but this is unlikely for the amount owed. Knowing my luck though they will. Has anybody been through this? If so is there anything I can do? What do I do with the pending ccj? And what happens with insolvency and the implications? I honestly don’t know what to do and I have avoided all this for 11 years now.
  19. sorry for getting back so late. i did this two months ago and heard nothing. sept 2007 was the date i settled it but even on june 2008 file it still saying i missed upto may 2008 payments. creation say red castle need to sort it out because from what i understand rad castle logged the file but in creations name!!!!!!!

Hi, i bought a car from carcraft in rochdale in 2004 but what they failed to tell me is the the finance on it was split with two companies. one of these was with open and direct finance. when i realised this was going on i protested against it and was in dispute with open and direct over it. the amount i actually owed was around £2500 but they want £4900 to settle the account. anyway as time went on i refused to pay it. this debt was not recorded on my credit file. in 2007 i got a letter of red castle recoveries representing open and direct (now called creation finance). also when it was passed on the debt appeared on my credit file showing i missed 6 payments and i owe £4500. in sept 2007 i came to an arrangement with red castle and settled the debt for £2500. now this is where i have the problem. the debt is still on my credit account showing i am still missing six payments and that the debt is not settled. i have phoned open and direct who say its red castles problem because they logged the debt with the credit agency but they have logged it in creation finances name and experian will not accept anything from red castle. how do i sort this out????? simon
