  1. Hi, thanks for that i will dig the policy out and have a look. I know when i phoned them yesterday the guy had a word with the manager and he said that they would have to accept liability and for us to fill a claim form in and then the insurers would make a decision.

Our car broke down on the 18th december and we still haven't got it back!!!The rac towed it to a local garage who said they couldnt deal with it as they didn't have all the mod cons (renault megane 04 reg).It went to another garage they tried to replace one of the injectors but couldn't code it in - so then it was sent to main dealer!!! It was stated by the RAC that it was the fuel injector pump. It has now had 4 new injectors and is waiting for a fuel pump. I have been told by the main dealer that CONTAMINATED DIESEL has caused all the problems!!The bill now stands around £1500 so far without the pump, i was advised by a friend to try and claim on comp insurance, i have now filled in a claim form and one of their engineers are going to inspect the vehicle, what do you think my chances are of a sucessful claim?? This has made me really ill with stress and being on incapacity benefit how can i pay without selling the car when i get it back!!Can anyone out there advise PPPPPLLLLLLEEEEEEase

I have now filled in the N1 form for my daughter in law i have been instructed to lay the costs out as follows:- charges overdraft interest interest charge under s.69 county courts act 1984 done the charges bit overdraft interest-is this the debit interest they have charged me? finally how do i work out the interest for s.69 please thanking any replies in advance. alij123

  5. Thanks Jazz for your kind reply,i rang the court to confirm it was ok to send extra sheets and they said it was fine, I haven't quite completed the forms yet so i will be needing a few more answers no doubt!! alij123:)
  6. jUST FILLING IN PARTICULARS OF CLAIM ON THE N1 FORM AND HAVE ONLY COMPLETED UP TO 4a. Can i continue on a seperate sheet????? thankyou:D
  7. How do i go about taking them to court.My daughter in law is on benefits so i cannot apply on line. Also would i apply to my local court or theirs as they live in a different area. Any info greatly appreciated. thanks, alij123:confused:

Hi, I posted a thread on the general forum this morning,hope to get some further advice on here please I applied for my daughter in law to have her charges refunded from the Halifax i sent the LBA and all the dates and sums of money for the charges taken. They have wrote back basically saying that she agreed to the charges etc when she opened the account. I quoted the data protection act letter too about them taking the charges out of her benefits.They stated that they cannot explain to me how they justify their charges as it is confidential!!!!!!! They are not having any of it and are rejecting the claim! What do i do now please!!!!!
  9. Hi, I wrote to the Halifax on behalf of my daughter in law trying to reclaim her bank charges.I followed all the advice and used the templates,i also quoted the act about taking her benefits. She received this letter back:- Our investigations I have carried out a full investigation of your complaint and i am satisfied that the charges have been correctly applied to your account. WHY YOU HAVE BEEN CHARGED When you opened your account,you agreed to our terms and conditions which explained that charges would be applied if you did not keep to the terms of the account.From time to time we have sent you information about the current level of charges.This info formed part of your agreement with us and we have applied them strictly according to the terms agreed. We apply these charges because when customers have insufficient funds in their account to cover a payment they have asked us to make,this means additional work for us.As a result,we feel it is reasonable to charge for this service. You asked us to explain how we calculate the amount of charges for which you are seeking a refund.As this is commercially sensitive info,i hope you will understand that i cannot provide this info. You referred to the guidlines on credit card default charges issued by the OFT,As the guidlines do not apply to bank account charges,i cannot comment on it in connection with your concerns.The guidelines are about default charges which people must pay when they break the terms of a credit agreement with a lender.As previously explained,the charges that you are asking us to refund are our fees for the additional work that we carry out when a customer requests a payment without sufficient funds in their account. OUTCOME I am sorry to advise you i am declining your complaint.I hope i have explianed the reasons for our decision. CAN ANYONE GIVE ME FURTHER GUIDANCE ON THIS MATTER PLEASE:confused: Thanking you in advance. Alison
  10. my daughter in law has been banking with the halifax for some time now, and over the past 3 years or so she has had several bank charges added to her account. I copied the standard letter format to request her statements ready for her to sign and she has just informed me that she has all her statements. Is there a letter i can send about the charges bearing in mind i will have them all to hand on her statements. can anyone help please!!!!!! Also the charges taken from the account have been from jobseekers allowance/child tax credit etc. they have let her off on quite a few occasions but on the latest charge she was informed they would have to take £39 this time all because some company tried taking £8 dd out when there was no money in the account. thanking anyone in advance for replies.
