  1. Quick update - All charges have been cancelled by total parking solutions. I sent the same dispute letter by snail mail and got a totally different response than the snotty agressive e-mail reply. thanks for all the help.
  2. Thanks for the speedy advice!! Its a private car park, Although in reality it could of been a number of people who my the car (my boyfriend and my parents both drive it, but it may of been myself, i really don't know) my real problem is not with getting charged, its the magnitude of the charge in relation to the offence £70 is just far too steep, and surely just like the bank charges are now getting forced to do, they should be at a decent and fair level. Is their any way this can get or is getting its profile raised - i'm sure theres thousands of people who would love a refund ala illegal bank charges that paid out of fear of prosecution? Also - any advice on how to proceed here? I'll write back and point out their errors, but i'm stuck after that...

I have got a parking charge from totalparkingsolutions (similar company and system to europark) I sent them an e-mail taking advice from the forums, I asked them for proof who was driving (it was one of 2-3 people) and also disputed a £70 charge for parking and hour over the limit- this has been my reply from them. Is this information correct or even legal? He also calls it a fine, which i thought private companies cannot do? Dear Kelly, The registered keeper of a vehicle is the person responsible for paying the charge, regardless of whether that person was the driver or not. The person whose name is registered at the Driver and Vehicle Licensing Agency is still liable for the charges, and under these circumstances until we have knowledge of the driver details we are currently perusing the registered keeper as this is who we deemed to be responsible for the breach of the site terms and conditions. As you can appreciate it would not look good in a court of law if you are refusing to supply us with the driver’s details should this not be yourself at the time in question. We can not see any reasons why a registered keeper would refuse to supply the driver’s detail unless they were deliberately trying to mislead us to believe they were not the driver at the time. From a legal point of view we could potentially report the matter to the DVLA and the local authority for further investigations for their legal status. With regards to the fine level in place this has no relevance to loss or relation to a charge for excess parking time and applies to all offenders exceeding the permitted 2 hours free period whether this be exceeded by 30 minutes or 3 hours.
