Hi Gary just to let you know that today I received the N159 from District Judge Ackroyd at Oldham cc and he has odered the draft order for directions in my claim, no need to go to court now though the Yorkshire Banks Solictor must have not wanted to go any further after she recieved the copy AQ DO and Section G she sent a cheque for all that is owed to me yesterday! Thank you very very much you are a star, you all helped me to beat the Bankers.....
  5. We Beat the Bankers! just to let you know that yesterday I received a cheque for everything YB owed me ! Not only that but this is a victory for GAG because today I received a letter from Oldham CC informing me that District Judge Ackroyd has considered the statements of the case and allocation questionnaires filed and allocated the claim to the small track, also he has granted my request in section G other information that special directions may be given as per attached draft order..... No wonder Ms Ross has settled out of court, You should be proud all of you, well done for providing the knock out blow. I must also applaud District Judge Ackroyd for his forsight in this matter. (Oldham CC is a good choice of venue for our battle against the banks) Keep up the good work x
  6. thanks so much for your advice I do agree with what you say, I had to take Yorkshire Bank to court to get my any where with them but my friend is scared and skint! she is going to sleep on it before she makes a decision, I know though what I would do! but I don't know what people like us would do without the help of this site....
  7. I agree but my friend is very nervous and she has asked me to see what you think about her idea of writing and asking them to up thier offer to at least 50% of the claim (£4185) and if so how should she wird this letter, you help would be greatly appreciated.

Help someone PLEASE, I am helping my friend to claim £4185 from A & L and need some advice on thier tactics, I am claiming against Y B but A & L have some very different ways of going about this! Sent off initial letter on 15th April 07 LBA sent 23rd April. Today received this letter from them:- Dear xxxxxx Thank you for your enquirey requesting that we refund the fees and interest that you have paid on your current account. These fees form part of the terms and conditions of your account and were generated because payments were presented for payment, for example, cheques or direct debits, when there were insufficient funds available. As you maybe aware the OFT is currently reviewing the issue of current account charges. It is our understanding that they have suggested that there maybe some similarities between the default charges on credit cards and similar charges applied to current accounts, however, it recognises that the application of the general principles set out in 2006 to the banking industry is not straight forward and that a more detailed examination is needed in relation to bank charges. Default charges may apply to current accounts when items are presented for paymentwhilst the account is in excess of its overdraft limit and are returned unpaid (bounced) and a fee is charged. We do not believe that the term applies to other types of fee. We believe that all our charges have been applied in accordance with the terms and conditions of your account, of which you have been given a copy. However, having reviewed the particular circumstances of your case and taking into account the ongoing OFT review,in order to resolve this matter we are prepared to refund the sum of £1739 in full and final settlement. This reflects the difference between the amount of charges for unpaid items actually applied to your account and the ammount of charges that would have been applied to your account if the charge had been £12 ( being the ammount that the OFT indicated was not unreasonable in relation to credit card default charges). Please sign the eclosed copy letter to confirm your acceptance of this letter and return it to me in the envelope provided by 20th June 2007. On reciept, I will apply the agreed refund immediatly. You may have seen media reports that some banks have considered closing certain customers accounts where the customer has complained about bank charges. We would like to reasure you that this is not our policy and if you do accept our offer of settlement,we will continue operate your account. We will do so on the bwsis that you accept the terms and conditions of your account previously notified to you, and that charges wil be applied in accordance with our current charging policy. We would stress that as the OFT has not concluded its review, the offer of settlement contained in this letter is made on entirely ex gratia basis and without any acceptance by us that £12 is an appropriate charge for returning an item unpaid. Finally where additional funds are required, it is always best to arrange overdraft facilities in advance, to avoid incurring fees on your account. Y A W N............................ They are offering my friend £1739 when her claim amounts to £4185 This is before interest is applied when she claims in court.

Hi just to let you know that after sending AQ DO and section G other information, still not heard anything from Oldham CC but the banks solicitor sent me a letter asking me to settle for everything accept the interest ( Charges & Court costs) but without any interest because as they point out I am not entitled to this before it goes to court. KA Ross seems to have miscalculated the amount of my costs and has offered too much, meaning that I would only be £112 short of full claim, of course they point out that they are doing this only because the amount of the claim would quickly become disproportionate to the amount claimed etc etc...

  11. Sent off my AQ, DO, Section G other information to CC on 1st May, should I ring the CC and see what the judge has decided and should I start printing court bundle now also should I contact Ms Ross YB's Solicitor to see if she wants to settle now? gettin nervous now to be honest!
  12. Sent AQ, DO, Schedule etc. to cc today also sent copies of all to YB's Solicitors as you advised. Now watch this space! gonna concentrate on court bundle now thanks again for your help sarah..
  13. Thanks Todge for the advice, did what you said and sent both court and banks solcitor all the documents you told me to. Posted them today so watch this space, have to say this is playing havoc with my nerves! Once again thanks its a good job I have somewhere to go to ask questions or I'd be way out of my depth...

  15. Thanks Sarah will do that right away never realised this with MCOL because there is only the POC which you can send on line, perhaps I should have posted them to Northampton cc when I filed the claim, will this now be a problem?
  16. yes i did send a copy with LBA and I sent another to Kirstie Ann Ross so shall I still send 3 more copies of it to the cc with AQ etc.?

When I send in my AQ Should I send the one that the court issued filled in by hand or should I type one on a template, and if there is not enough room to fit all I want to include in Section G can I send this on a seperate sheet? also if I have not sent a schedule of charges with my poc should I send one to court with the AQ and Draft Order for Directions. Please can you tell me where I find the AQ Template? thanks in advance

When filling in AQ am I better off typing it out on an AQ template or hand writing the form issued by the cout? where can I find this template and if there is not enough room in the section G box to fit in all the contents of your template, can I send a seperate attached sheet. if I did not send a schedule of charges with my POC should I send one with my AQ and Draft Order for Directions request? and do I send a copy AQ and DO tonYB's Solicitor - Kirstie Ann Ross, Thanks in advance x

  23. Been reading up on the AQ strategy, do I send in the completed AQ with the draft order or wait, I'm getting confused and want to be sure that I don't screw up would appreciate some advice
