  1. Hi All, So here’s my question….. Welcome wants to repossess my vehicle, I have paid LESS than a third (only just) and ive locked it away in a friend’s farm. So what can they do now? Of course I think I have some valid reasons for doing this which I have listed below, I won’t make this thread too long as to bore anyone so here’s the basics. Purchased vehicle for £8000.00 2 years ago. Total finance £14000.00 of which £4800 was PPI that I didn’t want and “attempted” to cancel in the first instance. Paid fine for first 9 months. Lost job and struggled with monthly payment of £400.00 Welcome offered a reduced payment, same interest charge, of £180.00 over longer period. I said yes, but after repeated calls to them no new agreement was given to me. I stopped the payments earlier this year. Constantly wrote to them asking for account history, PPI to be refunded off balance, and copies of agreement, got no replies. Had first ever letter from them last November cancelling agreement. Sent Collections Company to collect vehicle without warning. Finally I got a subject access request from them and copies of agreement few days ago. Took advice through solicitor and they advised that as I am in dispute, any removal attempt is unlawful. The Subject access request is now being studied by the solicitor (free!) but the collection company keep turning up daily. Should I give in, burn it, hide it, or emigrate? (Tongue in cheek of course)
  2. Can anyone help me on this one? When i took out a car finance agreement with Welcome in April this year i was asked how much i could afford each month on the repayments, i said £200-£220 a month, but when they tagged on the insurance it went upto £320, i struggled for the 1st few months, then read the policy and found out i could cancel at anytime. So i wrote to them in October and tried to cancel, each time i contact them they say they didnt get the letter, even though copies were hand delivered by me to the local branch ! I am constantly in arrears with them as i cant afford the extra £100 each month, they add on £10 for phone calls and £25 for knocking on your door. I have repaeted asked them to cancel it, and requested a copy of all my payments made, but i get nothing from them at all, just phone calls every few weeks demanding payment. I have not paid them now for 2 months and they are saying they are coming to get the car, what should i do ??
  3. From personal experiance i dont remember getting a default but presumed i did. They went for a re-possession hearing with me, but i managed to pay all arrears a few days before the hearing date, by borrowing off a friend. As this was done before the date, the hearing was cancelled, and i had no charges. Scarey stuff though.
  4. Hi All, What on earth should i be doing now! I have a Ford Minibus that i use for my business. Its under 3 years old, and covered by Fords Warranty. The drive shaft has failed, and they will repair it for me under warranty. BUT the part is out of stock with FORDS themselves, so my local Ford Dealer has it on "Back order" Fine i here you say, but that was all 3 weeks ago, and now the part is expected on 13th Aug! I should now mention that each day i am without the vehicle is loose around £200. So with much time on my hands now, i went looking for the part myself, and found one 300 miles away, with another Ford dealer, my little did i know Ford delaers wont talk to each other for some strange reason, so my vehicle is still unroadworthy. Do i have any come backs on Ford themselves or the dealer? Any comments ( inc should have not brought a ford )
  5. Hi and thanks for the reply. We have now recieved a court date which gives us around 5 weeks. Blemain have told me on the phone that if i clear the arreas before this date, all action will be stopped, and we can continue to pay as normal. This is exactly what i want to do, and am now trying to borrow the arrears, but can i trust them this is correct, will they withdraw the action, or just take the arrears and keep it going? Any help please
  6. Hi everyone, just done a search for Blemain on here and now wish i had not! We got behind with them on a £45k sec loan, arraers are around £3k now, i explained to them our circumstances had changed for the worst, and that i was selling a second property abroad, of which i would recieve the proceeds in around 8 weeks. They advised making a token payment of £200 which i done, but then got a letter saying it was all going to court. They now tell me it has gone to court, and that i should try to pay the arrears, but i still have not got the money through from abroad, ( hopefully 6 weeks now ). What should i expect from the court, i dont have the £2000 for the arrears and will only be able to clear it when the abroad money arrives. I am really worried what to expect from the court, or what their next move will be. I know that i have the option that everyone says dont take, and thats get another secred loan, with someone else and pay them off. So at the worst those application documents could be sent off, but it all seems extreme for just a few weeks wait. Any help or advice would be just great as i dont know what to do. thanks
  7. Hi, Had a default notice around 4 weeks ago, made a token payment of £200 a week ago, then the letter i got saturday was dated 16th, and asked for full arrears with 7 days which have now passed. They said today that if the arrears are paid in full before any court date ( not yet set ) then that would be ok, but i am concerned that they will ask for the entire loan repaymet of 65000, which i could only do by re-mortaging with an adverse company, as i have equity in the property, but poor credit history over the last 18 months. any advice is appreciated thank you
  8. Hi, I have got behind on a secured loan to the sum of around £2000. The loan amount is £60000, and its been running around 6 months. I contacted the loan company today, after getting a letter from them on Saturday, trying to sort out the arrears. But they have informed me that they have submitted the matter to the court, and i will have to attend. This is fine, as i have nothing to hide, and i know that i will be able to clear the arrears within 2 months, however as its a secured loan, i am worried they they will want the full amount of £65000, and that would be a disaster. Can anyone let me know whats likly to happen, will the judge just grant that the arrears should be paid, or what else should i expect?? Thanks
  9. Does anyone know how i stand if my estranged wife no longer lives with me, and bailiffs are calling to collect a county court warrant of execution for here debt? We have been seperated 3 months, she is abroad. She had a CCJ through recently for £5000, the a warrant of execution, then a private baliff visit, not a county court one. I told the guy she was not living here, and he just went away. I then got a letter asking "her" to pay, which i returned with details of her address abroad. Now i have a letter stating they will return in around a weeks time to collect goods. Anyone know what i need to do??
  10. Just jumping back on this thread, having read the other thread advised by KJD, the "collectors" of the vehicle only had a fax from the finance company. They produced no ID, had no officail documents, certainly nothing from any courts, and assured me that the vehicle would be returned the next day. Which was a total lie. On the advice of others, and a serving Police Officer, i am about to report the incident to the Police, just in case something was not correct.

No tools in my vehicle, as i removed all my stuff. Did the "collector" has the right to take it? i dont know. Please feel free to comment. Here`s what i posted on the Debt forum earlier. Taxi Repossed yesterday - Not a good day Hi Everyone, This forum site has been a great help to me over recent months, with regard to my current financial difficulties. I want to share what has happened to me over the past few days with everyone, just to get some feedback from you, whether this is positive or negative, well that’s up to you. So here`s the story. I am self employed as a Private Hire Driver, that’s similar to a Taxi driver, but I work for myself, and only do Airport runs etc, and not on the taxi circuit. In December last year I purchased a new People Carrier for my new business that I had set up. The vehicle was priced at £18000. I put down a £3500 deposit and had the finance arranged for the remainder. My monthly payments would have been £399.00 per month, which were fine. On the 1st March this year I was admitted to hospital unexpectedly, and was not discharged till 4 weeks later. Subsequently I fell behind on the payments, to a level of 3 months. The finance company were aware of my position once I was discharged. A default notice was issued at the end of April, and the finance company gave me 14 days to pay the arrears. This I was not able to do. So they informed me by phone, and letter that the account would be passed to a collection agency. I was to pay them the arrears direct, then the account would be passed back to them. By this time we are in the 2nd week of May. I had no contact from the “collection agency” until they turned up at my door at 8pm at night, 2 days ago. They stated that they had come to collect the arrears or the vehicle. I explained that the £1500 they were now requesting wasn’t exactly in my back pocket but as I was now back on track, I would withdraw it from the bank in the morning in cash. This they wouldn’t accept and wanted o take the vehicle. I then offered them a cheque, which they said they would accept. Knowing the money was in the bank to cover it, I thought that was the end of it….how wrong I was. Last night they returned, and said they should not have taken a cheque, and that the vehicle was going to now be taken there and then. These guys were intimidating to say the least. I asked to speak to their boss on the phone, which they then called. I wont at present mention what was said but the threats made by the “collection agencies boss” were certainly not on the correct side of the law. The two guys who collected the vehicle along with their “boss” on the phone did however state that if I contacted the finance company in the morning, paid the arrears in cash, the vehicle would be returned immediately to me. I spent the next ½ hour removing possessions, taxi radio, and council badges from the vehicle, and away it went. So I contacted the finance company this morning, only to be told basically, the vehicle will not be returned at all, arreas paid or not paid, it really didn’t matter. So that’s it, vehicle gone, business down the pan, and a full diary of bookings, that I now have to cancel. Please feel free to comment, thanks for reading, and sorry it was so long winded. Thanks

Hi I paid the arrears by Cheque, which they brought back to me the very next evening, un-presented to any bank, I offfed cash the very next morning either delivered, paid into an account, or inserted anywhere they wanted it, but they still took it. Yaffsimone1 - Ive told the 100% truth on this experiance, so its only fair i tell you of the business concerned. Finance Company - Dunctons - non-prime vehicle finance: Duncton Debt Collection Company - JCA Associates ( Isleworth ) Hopeful - Just doing a search now, and managed to place some of my bookings with other drivers i know. They took the vehicle at 9pm last night, and i had 4 adults + 3 young children to collect at 1am. Managed to get someone else thankfully.

  15. Thanks for the replies. The finance company thats chasing the debt now, is a gather the 3rd company which has "purchased" the debt from the original finance company - GE Capital Woodchester. The current debt collection company have stated that the only options i have are to surrender the car, or pay the arrears. Selling it to another party was not an option, as after the sale they would still have a claim on the vehicle.
  16. Hi, I have eventually obtained some amounts which have been paid. The car is basically sitting on my driveway, and now not being used since the tax run out at the end of March. The finance company are calling me daily, wanting me to complete the Voluntary Surrender paperwork. If i do this they said they may get £8000 for the vehicle and want me to then pay the further £8000 outstanding. Total amount of finance was £29000 at time of purchase Balance owed to date £16000 I have paid to date £12000 Arrears are £4500 I think i am around £2300 short of the 50% payments amount. I have a friend willing to give me £12000 and even a local dealer offering £10500 so it all seems a bit unfair really. The £8000 quoted by the finace company, as to what they "might" get is only a guess. The vehicle will be auctioned off with no reserve, so if its raining or theres something good on the TV that day, it could in theory go for peanuts !! So what should i do :? :? :? I could just say S*D it and let it go, then they will have to chase me for months for the balance, probably going through the courts, as i cant russel up a Grand let alone 8 , or are there any other options open to me Any advice please Jimbo
  17. Hi Thanks for all the replies so far, i am just checking the paperwork now. I am sure less than half the debt has been paid, and we did not take out extra insurance at the time ( silly i know ). Ill check the paperwork, and post more details.
  18. Hi All, Can anyone advise me on this. Purchased new vehicle 2004 on HP, via Main Dealer for about £26000. This was when everything in the Garden was rosie! Paid monthly for around 2 years reducing balance to £16000, then because of loss of job was unable to continue the payments, and last paid for the vehicle around 11 months ago. The debt seems to get passed to varoius DCC`s over the last year, all of which to date I have advised them i cannot pay, as not working. The latest company has now issued me with a Voluntary Surrender notice, which i am tempted to complete. However, they have told me that i should expect around £8000 for the vehicle which they will submit to auction with no reserve. They will then of course ask me for the remaining £8000, which to be honest is well beyond what i can afford. I can get £11000 for it from a dealer, and even a family friend has offered me £13000 for it, but of course there will still be HP outstanding on it. Is there anyway i can pass the vehicle onto the dealer, or friend, GET THEM to pay the DCC direct, then come to an arrangment with them over the balance, without any ties to the new owners? Hope that makes sense, any advice would be appreciated. Jimmy

  21. Hope the following is not too complicated, but any advice is appreciated. In 2004 my wife run a hair products mail order business. Unfortunately this did not succeed, and she closed it within its first year. She was the SOLE TRADER. During this time she used one particular wholesale company that she had a credit account with. When the business closed she was unable to pay them the £4500 that was owed at the time. As time passed she eventually received a solicitor’s letter asking for the £4500, she made arrangements with them to repay £200 a month until the debt was clear. This she done until the balance was down to around £2500. She then became ill and was unable to deal with her finances, so I wrote to the solicitors after she failed to pay them for 3 months payments. I told them that I would continue paying it for her, as she was at that time in hospital. Because at that time we were both not working, I offered them £100 per month. This was accepted, however it was always difficult to meet the payments and in November last year we paid an instalment 3 weeks late. The solicitors issued a county court “Claim form” against her for the outstanding balance ( £2200 appox ) + costs £400 + wait for it interest £3100 ! making a total of just under £6000! I rang the solicitors and asked why they had added so much interest, and was told it was in the wholesalers terms and conditions, that my wife had signed, & that they could do that. I returned the claim form to them, but only admitted the £2200, and signed it myself, not my wife. No heres the tricky bit, my wife and I have separated late last year, for various reasons connected with our marriage and her health. She has moved abroad with her family. We are hopefully not going to get divorced, and in the back of my mind, I hope that after a separation we will eventually get back together. She has very little money, and the same applies to me, hence I have been dealing with this for her. I still live in the family home, which we jointly own ( mortgage) and I have both the kids. I could go to a solicitor I suppose and get them involved, but I don’t want to “Rock the boat” with my wife for the future. As the debt was in her name, and she is not living in the UK, can they still come after me, and if so what should I expect? I hope that all made sense! Thanks Jimbo
