Thanks Shadow, I phoned them yesterday and accused them of STEALING money from him for the last 18 months, maybe not the right thing to do but what the hell!, told them i was reporting to the Ombudsam, FSA, BBC watchdog etc etc. An hour later someone called me back saying that they were closing the account with no more to pay!! RESULT
  2. Hi Everyone, My father passed away on the 03.03.09 after a sudden illness. He left a credit card with Capital One with a balance of £800. He had been paying the protection insurance for death, injury etc so i informed Capital One over the telephone of his death and duly sent in a death certificate as requested. A week or so later i recieved a letter from them asking me to contact AXA insurance, where i was then told that he was not covered as he was over 65. My Dad died aged 66 and 5 months, so therefore he had been paying the premiums for some 18 months for nothing. I filled in a form saying that there were no assets and nothing available for creditors, which there isn't, and have just received a letter from Capital One saying there is £700 available for creditors from his estate and they want a prorata offer. (I dont have a clue where they got this figure from!) I have checked thoroughly through Dads paperwork form the last few years and i cannot find any letter from Cap One saying that his insurance is now worthless now that he has hit 65, or any other correspondance except monthly statements in fact. Every other company that i have spoke to after his death have been marvellous and could not do enough for me except Capital One which incidentally was the only one that he had insurance on in case of death. This is now starting to affect my health and the greiving process which surely i am allowed to have. Any help would be greatly appreciated.
  3. Thanks freakyleaky, I have decided to go and see my local bank manager so that i can put my points across to him. if i get no joy i will write a letter to the complaints dept at the HSBC and forward my complaint on to the the financial ombudsman. Laddie
  4. Hi Everyone, I have had a managed loan ith HSBC for the last few years. Due to wife loosing job, baby been born, mortgage going up etc i fell behind to the tune of 6 months payments. The bank charges, due to the loan not being paid are £193 and i owe a total of £1781. I contacted the bank on June 10th and spoke to a line manager who agreed to park the account and would accept £45 per month for 3 months. I was called by an advisor on July 03rd who could not find any record of the call - unfortunatley she couldnt do anything about it but would get someone to call me back from the managed loan department - they did on July 10th! The guy that called on July 10th (obviously new, obviously reading from a script!) went through an income / expenditure form and concluded that i couldnt afford anything and the best thing was that the HSBC made me insolvent!! I asked to speak to a line manager (David) who apologised and agreed to the £45 per month payments again for the next 3 months. I received a letter on the 15th acknowledging the call and saying if the payments were not satisfied further action would be taken - i have not missed a payement since the beginning of June (3 x £45 payments - original loan £30 per month). Imagine my suprise on 08th August when i received two letters for the HSBC DEMANDING repayment. the first for the bank account £193 giving me 7 days to pay in full. The next letter for the bank account £193 and the managed loan £1588 giving me 28 days to pay in full (which one do i believe?) I spoke to them again today and they have advised there is nothing they can do, even though i have a letter acknowledging the agreement! and they are going to take me to court. Does anyone have any advice as to what i do next? i have told them i will carry on paying the £45 per month. Thanks in advance:cry:

Hi Xpuser, I believe you can keep adding on the charges until you are paid out - but if you get to the court stage which i hope you don't, it costs you to amend the amount for which you are claiming. I actually worked my charges out to less than what IF paid me (only £28 but worthwhile having nonetheless!) John
  6. Hi Silou, Just phone the standard 0845 609 4343 number, they will speak to the relevant department on your behalf. Good luck - IF seem to be one of the better banks at paying up. I get the general impression that not many people are taking them on, so maybe they are more willing to pay up? We are behind you and watching with interest. John
  7. Hi Frankies Mum, You must get your mother to phone them up and find out what is going on, you may be worrying for no reason. My experiences with the staff at IF are generally very positive, give them a chance. It is much easier talking to someone on a phone than face to face. Tell your mum we are all behind her. John
  8. Hi Moonboy, I agree with Babynan. I am suprised to see that someone has got to this stage because if you read back thru the forum, it has not happend to often with IF. Definately give them a call and ask them what is going on, my experiences with the staff at IF are generally only good. John

  10. Please take back all of those nasty things that i have said about IF, i have just checked account and the money has gone in (at last) and has been back dated to the date that they recieved my acceptance letter. HOOOORRRRAAYYYY
  11. 7 to 14 days that is a disgrace!!! I was told that once it had been signed off, a proper human being would actually manually add the funds to your account.

  13. Hi Codeycat, Have you tried annoying the hell out of them by calling them up regularly? As i said, i called them 3 times and got a different answer everytime. I am going to call them up during lunch to see if i can have a definate date as to when the money will be paid - that is all i want to know! Keep me posted and i will you if you get anywhere! John
  14. Hi Moon, Don't panic!!! Add all of the charges up using the spreadsheet on this site. (I did not claim for any interest but was going to claim the 8% if it got to the court stage which thankfully it never!) Write the Prelim Letter as per the template, i sent mine to the head office in Halifax. Within the 14 days you should recieve a letter saying that they are investigating your complaint etc. You will then send your Letter before action and if it goes like it has been, you will recieve an offer for 50% as a good will gesture... do not accept this because within a few days of them getting your refusal letter, they will offer you the full amount. (You will then have to wait an undisclosed amount of time for your money - this is where i am at the moment!) If you have any problems, you can PM me or start your own thread, we will all help you in any way that we can. John
  15. Hi All, Just a quick update, i may have won but trying to get the money out of IF is something else. They received my acceptance letter nearly 2 weeks ago but still no funds. I called them first thing yesterday morning and was promised it would be in within 2 hours, they would even give me a call on my mobile just to let me know. I phoned back after 3 hours and was told that the lady who signs the refunds off was very busy and very very important and she had lots of meetings to go to and the funds would definately be in by 5 oclock. I called back on the offchance at 4.45 and was told by someone else that it would not be today and there was no way that they could guarantee the funds being in the account by the end of the week. I was told that because it was such a large amount it had to go to authorisation from a higher level! I asked to speak to the person at the bottom of the letter offering the full refund (who had already authorised the payment!) and was told that this was impossible as they were too important to speak!!! I am going to call back again this morning to see what sort a response i get today..... Banks! don't you just love 'em

  18. Hi Folks, Just had the best conversation with IF ever, they have sent out a resolution letter offering a full refund. Yipeeeeeeeeeee:D Can i just thank everyone who has helped.... and offer a little bit of advice to anyone who is thinking about reclaiming their charges - Please do it, i like everyone else was sceptical, nervous and worried but i have read and read until my head hurt. Followed the very simple advice on here and have just managed to claim nearly £3k back for the sake of 3 or 4 letters and a couple of telephone calls. Please can a moderator move me to the won section, a donation will follow as soon as the cash hits the account. Thanks John
  19. Hi Codeycat, I agree with Babynan but dont be tempted to accept their offer. Easy to say i know, but we have all been there! It looks like IF are offering everyone 50% as a first offer then coming back in with the full amount before getting to the court stage (at least i hope so!)   20. Hi All, Spoke to IF yesterday, they have told me that 'the matter' is being dealt with but would or could not tell me how. Praying for a settlement...... One thing i have noticed recently when speaking to IF, is how much friendlier the staff seem to be! Anyone else noticed? John

  22. I hope not, i hope that they will pay up as they did with Andromeda! The 7 days are up tomorrow that i gave them when i rec'd my 50% offer. I will speak to someone tomorrow afternoon if i get a chance. The story so far...... 1st May:- Rec'd list of charges 2nd May:- Sent Prelim letter recorded delivery. 16th May:- Rec'd letter from IF, looking into complaint. 16th May:- Sent LBA 6th June: Rec'd letter offering 50% 6th June:- Letter saying thanks but no thanks sent to them. Gave them another 7 days to offer full amount.
  23. Hi Xpuser, Still quite new to this but will help in any way i can. The best bit of advice that i can give is Read, Read and then read some more, it will let you know what you might come up against. Although, reading about some of the other banks I.F. seem to be one of the better ones at paying. (i hope i haven't just put my foot in it as i have not got anything back yet!) Laddie18
  24. Sorry should have said, they did offer 50% same as Andromeda & Babynan. I have sent rejection letter by email and will send recorded delivery in the morning. As my LBA time was up and i should have sent the court claim in, i have given them another 7 days to respond to my rejection letter. I just hope i have done the right thing. £1400 + is an awful lot of money....
