Hi dewsbury, if you look on there it has a list of all banks etc and their exit fees, with details how to claim them .
I got £135 back off Halifax with a phone call it was dead easy, they sent me a cheque within days

hi dewsbury, you only have to phne the halifax for these fees to be refunded.
i will find the number and get back to you............

My letter doesn't actually say full and final settlement so I'm not offering anything back lol.
Will have a bash at letter in morning........too tired to be bothered now.

Hi Chop, I havent had time to mess about with the letters yet, unfortunately my mother is in hospital after suffering a heart atttack on monday so I'm a bit up in the air.
Will try and find time to do it today.
I didn't use MCOL, I filed at my local court, so I'm hoping I can ring them and tell them and follow it up with a letter?
I think letter 5 will be best for me too when i have a bit of a jiggle with it lol.

Hi SSL, I know you said rejection letter no. 6 but that's when the offer is from the solicitors.
My offer letter was from the bank, should I just write a letter saying thanks for partial payment and the claim will continue for rest of money (with better wording tho lol)

Well mine is slightly different scenario as I got letter yesterday informing me what they were going to pay. I rang and said I disagreed with the amount and would continue with the claim for the rest.
They are disputing about 4 entries on my schedule, but they aren't very good at maths their amounts are wrong even if I take these away we get different totals. That may have something to do with the fact that they are paying *approximate* interest!!
Anyway the details are above, I will inform the court of the partial payment then and send a letter accepting part payment.
Any idea which letter is the correct one or do I have to adjust one?
None of them seem to fit properly lol

Money in my account this afternoon, so they didn't waste any time.
Right I'm not sure what I'm supposed to do now?
Do I sit and wait for 30th and see if they put any defence in for the remaining £334.07 or do I have to do something now?

Hi Kellfi, you need to file either with MCOL or an N1 at your local county court now.
They have had enough time to reply to you satisfactorily.

I will just sit back and wait until the money is in my account then and see if they do actually defend.........they only have 7 days left.
They haven't done anything yet apart from acknowledge the claim at court.

I rang and spoke to Gunita Benjamin on 01422326496.
She says the difference is because Im only allowed to claim back 6 years from the date of the Claim being served ie 2nd May!!
I argued the point as it is from when i was made aware of the unlawful nature of the charges imposed.
She dissagreed and said to what I wanted to do but they WILL DEFEND the £334.07
I also said I was aware of people claiming back well over 6 years successfully too.
I worked out the difference from when I sent S.A.R - (Subject Access Request) to their dates and it is 280.69........I know its not much to some but it is to me..........
My SAR was sent 21st March 07 and the first charge on the statements they sent me was from 31/12/00 so she is arguing over 2 months!!
Dont know what Im supposed to do to get the rest of the money (£334)
but am I correct in saying I should ring the court and inform them of the offer??

Hi Ecksact, by prelim I mean the letter asking for repayment of charges from Halifax.
I have had an offer from them today regarding the first account, not satisfactory but I will try and sort that out

You dont need to know what you are talking about........they have a dedicated number for this.
They will ask a few security questions, ask when u took mortgage out etc etc then tell you how much they owe you if they do owe you anything.
They then send out a form to sign and return then send you a cheque.
They forgot the form signing stage for us though and just sent the cheque lol
