  1. Where PPI premiums have been added to a loan without the knowledge of the borrower and no PPI policy was ever arranged or details given to the borrower this must constitute fraud or at least breach of contract .Has any member any knowledge of actions for fraud succeeding
  2. Hello martin 3030. The cases described seem to be about bank charges .My issue is with a mortgage lender who charged 6% of the outstanding balance(nearly £10,000)when I was forced by them to sell and redeem a mortgage early or face repossession. This penalty applied during the first three years of the loan and there after became nil.True the penalty was included in the mortgage docment but then in the bank charge cases the charges are always in the documents. The issue with the banks is about whether the charges made are in excess of the costs they incurr.Surely the same principal must apply to mortgage redemption, Nottingham 99
  3. For some time last year there were several actions pending on the above. What is the current status ,have they all been lost and if so on what point of law? Will a judgement against the banks on unfair chares improve the prospects of these actions eventually succeeding?
  4. In early 2007 there were several cases where cutomers were trying to reclaim penalty charges. What happened to these claims? Were they all lost?can somebody bring me up to date?
  5. What has happened to these claims .Have they all failed or are any still running?
  6. Thanks Zoot, What happens next? Is the matter dead or are other cases pending?
  7. Do we know the points of law on which the claims were struck out or lost? Nottingham99
  8. Having read all the comments on the kensington letter it seems to me that the structure of the charge merits comment. In my case the charge was expressed as 6% of the redemption sum in the the first three years of the mortgage and nothing thereafter.Purely arbitrary and very difficult to present as a rational estimate of the loss they might suffer. Also even at a discounted interest rate for the first three years, their rates were still above the regular market.Their letters are intimidating but mostly bluff. It must be called
  9. I assume this group to be people who have paid savage redemption sums to the Kensington mortgage company. please respond and let me know your progress to date in reclaiming, Nottingham99
  10. Dear All, I am keen to hear if anyone has obtained repayment of these charges.I am talking about those charges which can be several thousand pounds rather than the exit fees which are more typically 2-300 pounds
