reclaiming charges - MCOL filed, 28days now finished **WON**

I received a payment yesterday. Claim filed 13 March. I pressed the judgement by default button which was rejected because a defence had been entered and the case was being transferred to my local court. I received the court papers today. NW's defence is: "The Defendant denies that the Claimant is entitled to any refund of charges". Can't understand why they've paid out then but I'm not complaining! -

NW have put in a defence for my claim, "The Defendant denies that the Claimant is entitled to any refund of charges". The case has been transferred to my local County Court but yesterday I had a suprise payment in my bank account - all fees refunded! -
Rang MCOL today (after judgment of default was "rejected") They told me NW are defending and that I will receive court papers from my local court tomorrow.

Same has happened to me, though others that filed on the same day have had payouts. I rang the court today and they say NW are going to defend and the case is being transferred to my local court. Should receive the papers tomorrow - scary! Nines -
My money was due yesterday but still haven't heard anything so have pressed the judgement by default button. Waiting to see what happens now.

Hi, I've just phoned MCOL. The date on my Notice of Acknowledgement of Service is 13th March but MCOL say that the date of service is the 14th (the 13th is when Charles Bacon responded). Therefore Nationwide have until midnight tomorrow to defend. Hope this is helpful.

My claimed issued 9 March too. Acknowledgement of Service received from Charles Bacon dated 13 March. Keeping my fingers crossed for Tuesday!

Hello All. I am a student and although my claim is for only £100 I thought it was worth pursuing. I have not claimed interest. I'm not sure, after ready other threads, if I've included everything I should on my claim form. My particulars of claim were issued on 9 March and stated: "Between 24/12/06 and 31/01/07 the defendant applied a number of default charges to the claimant's current account (account number ....) These charges are unlawful because they do not reflect the true cost of going into an unauthorised overdraft. Furthermore, they are a breach of the Unfair Terms in consumer Contracts Regulations 1999, which state 'A term is unfair if it requires any consumer who fails his obligation to pay a disproportionately high sum in compansation.' A charge is deemed to be a penalty if, in reference to the case of Wilson v Love in 1986, it does not reflect the true cost of an item. The claimant asks the court to enter judgment in their favour for the sum of £100.00, being the sum unlawfully debited." Also, as I sent it on-line I have not included any statements etc. I received a NOA dated 13 March saying the case would be heard in the Northampton County Court but have heard nothing since. Please could anyone give me some advice.
