  1. Dear John72 My claim was for just under £780. The solicitors were Sechiari, Clark & Mitchell in Brighton. Beyond giving the court the standard defence "you signed up to the terms and conditions ..." they did nothing. LTSB did the same with my daughter (she has an account with another bank, which settled almost by return no questions asked.) However LTSB settled her's, after entering their defence (same solicitors), within 3 weeks. I just don't know how LTSB work it. They can't think it will just go away, because there are loads of account holders going after them - I had 2 accounts I was going after them for but I combined them in 1 claim to cut costs for myself. I've still not seen anyone having to go to court. As long your case is set down for your local court you have the advantage because the bank's court costs go through the roof - it's just uneconomic. All I can say is keep the faith and carry on, don't be disheartened. Good luck. Hamofthegrey
  2. After putting in the usual defence the bank have seen sense (?) and coughed up before going to court. What did I do? I wrote to them asking to give the actual cost to the bank of each charge made. I then went on to ask for details of exactly what steps were taken by them stage by stage and the cost at each stage, the time taken, the use of personnel/computer, letter templates and any other thing that contributed to the true cost. Suddenly, I get a letter from their solicitors saying that they will settle my claim immediately ("considering it amicably resolved"). What caused the bank to suddenly have a change of heart? Did they come over all sentimental for a customer who has been with them for 20 years? Good luck to one and all. I have been much encouraged by everyone, and hope my success adds to your hopes for quick settlements.  Hamofthegrey
  3. Hello I've just joined (didn't know of all of you and forum - sorry - found you through Google and looking at Wilson v Love 1896! Still got here in the end. I've been reading what people have been doing and I'm much encouraged. My bank Lloyds TSB is playing 'hardball' and has finally entered a defence at County Court. Basically it says that I knew what I was signing up to when I opened my account and they charged me the going rate at the time. They've completely ignored my argument. I have asked them to produce documentation to show how every single charge they made was calculated and what actual work was required in making the charge. As there are a large number of charges that will cause them some work. I am sure that the bank's solicitors costs must be way over what I am claiming. A very close member of my family has also made a claim against the same bank for a much smaller sum and they have entered the same defence! I think Lloyds TSB must have a blanket policy of 'fight every single one whatever the cost'. Has anyone got any experience of Lloyds TSB at the Small Claims Court? I'd love to know what went on if possible.
