  1. I had a notice of change of solicitor to Ashurst this morning too.
  2. After having my claim stayed at CCC I tried the hardship route with the FOS late last year, they contacted the bank and I had a promt reply from A&L saying they were looking into it then on the 8th Jan 09 I received another letter announcing that they "believe our charges are fair and reasonable and are satisfied they have been applied correctly to your account..." "Although we appreciate your comments, we understand that the Social Security Act 1992 does not prevent financial institutions from applying charges to accounts where a customer may be in receipt of benefits." yada yada not their fault "Having reviewed your account, our records confirm that account facilities were withdrawn in April 2007 and the final debt balance of £192.01 was settled by a refund of fees to enable the final closure of the account. We are satisfied that these actions were appropriate at that time although we do fully sympathise with your current situation, we hope you understand we are unable to consider a refund of remaining fees until the outcome of the test case is known." Does anyone think it's worth me getting in touch with the FOS again or should I just wait out my stay at court? I'm rubbish at all the legal stuff surrounding this and with my 'fibrofog' it feels like I'm banging my head against a brick wall and that admitting defeat is my only option. Any advice received gratefully!
  3. Hiya, I just posted this in another thread and thought I'd make up another so maybe the other people claiming at Cardiff can share their experiences... I got moved to Cardiff just days before my judgement, it was stayed along with hundreds of others. I sent off my N244 stating that I was a single parent on income support and in financial difficulty and that all monies taken for charges were taken from benefits and they rejected my application, from what I've read of others who have applied against the stay whatever there position may be their applications are being rejected too. Are they even reviewing the applications?! I spoke to a clerk who said for me to apply against they rejection all I need do is send in a letter but I'm not even sure if there's much point. so much for justice is anyone else going to write in against the rejection? Any ideas on what to write?

  5. Hello all, I've been meaning to fill you in on what a clerk told me last week but what with it being the last weeks of summer holidays things have been a bit manic! Having heard nothing at all with regards to my N244 I rang CCC last week and the gentleman said that they'd had over 600 applications against they says(which is brilliant!) but because there were so many they were being reviewed in batches and that mine sould be reviewed some time this week. If I hear anything this week I'll let you know. On another note, it's a shame I seemed to miss most of you at the non hearing last month, I was in and out of the court(after having spoken to a confused clerk) all within about ten minutes tops! keep up the good work and good luck all!
  6. Phew, thanks guys. I've already sent in my N244 so I'll just take another copy with me just in case. I'd rather leave the press interviews to you guys though! Good luck to everyone tomorrow! I'll be the one looking rather frayed with dark circles! xxx
  7. hey, I'm a little stuck on what I should take with me tomorrow. It was a prelim hearing for me. I sent in my N244 last week. You think I should take a basic bundle with me? I haven't even made a dent in it yet, I'm gonna be up all night at this rate! :S
  8. I had a very prompt reply from Paul Flynn(MP) "Thanks for your letter Are there any more details about your claim against ..which bank? Are some not better than others. Although I do occasionally creep into the red, I haven't paid any bank charges or penalties. Banks tend to be greedy and I would be grateful to have more information in order to pursue this matter. Best wishes, Paul Flynn" any ideas on what I should reply?
  9. Hello, I've written to Rosemary Butler(AM), Paul Flynn(MP) and Glenys Kinnock(MEP), will let you know if I get a reply. I also spoke to one of my local councillors who mentioned that they have already opposed this in a commitee meeting recently.
  10. Hello again! I'm gonna go on Tuesday as it's probably better to be safe than sorry. Do you think it's worth taking my court bundle with me though? I know it's only a prelim hearing but from reading a few forums quite a few cases have been settled at prelim and I'm ever hopeful plus it won't feel like I've totally wasted a Saturday night staying in printing off what feels like millions of pages!
  11. Thanks for the reply Smutley. Fingers crossed enough people will object and the judge will decide to hear our cases. It's great hearing people do well in their court cases but it's a bitter sweet thing when we were so close! Oh well time will tell I guess. Thanks for the info and good luck to you!
  12. thanks for that link Smutley, it's quite reassuring! I've been looking at the 'got a court date' thread and trying to sort out what I might need to take with me (I hope I'm not jinxing my application to overturn the stay:) and it's got a link to 'New strategy for Allocation Questionaires' saying that I should take a copy of 'N149/N150 Allocation Questionnaire' with me. Do I still need to take it even though they went straight to a directions hearing dispensing with the AQ?
  13. got my stay letter this morning dated the 3rd of august. I sent out my N244 yesterday! When will we know if the stay has been lifted? Will they write us or do we just turn up and hope?
