  1. Hi again Steve. Can you clarify that he has NOT been sacked? What stage all of this is at? I do not see any grounds for a tribunal at all at this stage. He would require his current job spec and the new job spec. If the two are more or less the same then there could be a possible claim. If they are very different then no possible claim. The new post was advertised, he was allowed to apply and was unsuccesful. His old post was made redundant and so was he, this is not unfair dismissal.
  2. Duffman, no matter how tired you are you need to make a plan here bud and stick to it. You seem unsure what the debt is for and that you might be being charged twice for the same 3 account. First thing you have to do is write to both dca's and dispute the debt. The debt should then be passed back to their client company, if they have not bought the debt themselves. As stated by Tau, do not call them! You need a complete record of all correspondence, so everything you send to them must be sent recorded, also check online with 13 digit tracking number when it was delivered and proof available online, print this off and keep it with your recorded delivery slip. The dca's should then contact you no further as you have disputed it. I have done this with British Gas and car phone warehouse and won both. I never owed either one penny. When it is passed back to 3 then again only correspond in writing as above. Ask for copies of all bills if you do not have them. If you admit one outstanding bill then get an arrangement to pay from them. If you admit no bills at all then make sure you know the grounds for this. Take a deep breath and think how you will play this one. step 1, get dca to back off step 2 find out from 3 what the actual alleged debt is step 3 admit or deny the debt step 4 depends on step 3 lol best of luck matey

  4. If the job he was doing ceased as it has from what you have said regarding the different duties then he would have to apply for this new position. As his post no longer exists then he will be entitled to reduntancy payments. As the accomodation was given by the employer then the employer has the right to seek possession of the property as when your pal is made reduntant he will no longer be employed by the school. This is perfectly legal Steve, if your pal is not suitable for the new position as it involves other duties then they can say bye bye to him. But they must make him redundant and pay him.

  6. my other half is 29, in morrisons two weeks ago she was buying a bottle of vino and had our six month old son with her. Check out girl asked her for proof of age. Other half said are you having a laugh, this is my son, checkout girl said you could be a teenage mother. Other half then told her where to shove the bottle of wine and walked out lol. I wasn't bothered at all by this as I had carling in anyway lol. Won't be asking her to get me beers from there tho. Ps I look ancient.
  7. Can the very few of you who are on my back please jump off as I have the only monkey I need on it ie my MRS. I have stated numerous times in this thread what the problem is. It is NOT HERBIE, it is the premium rate number on her website. This is the issue and without going into it all again I will say this. I love cag, no am not a mod as has been put in a post. I could setup a website quite easily and offer a service to reclaim bank charges for anyone who visits the site, I could also advertise in local and national newspapers. This has happened! It happens in my local free paper, but it does not make it right that the information available from CAG is used to enhance the commercial gain of any person or company. We have all seen the companies that have been setup to aid people in reclaiming their charges from banks, have we also seen the percentages they will take when a win is achieved, 30% to 50%! This is the overiding principle and ethos of CAG, it is FREE advice, online, no premium rate numbers, no call out charges. I advise in a different forum to this and as this is my specialised area I am 100% certain in that advice, else I would not post. It is very easy to personally attack someone on this site, that is why there are rules. I have not attacked anyone, i have raised an issue to the post that herbie made initially. At the end of the day, I welcome help and input from everyone. I do not diss anyone. I may look at posts and think hmmmmmmmm that's not right, but I hold my tongue or as it is on here fingers. I object to any link containing a premium rate number, it is bad enough with dca's with their 0870 numbers, but an 090 number from a member of CAG via a link, that is JUST NOT ON.
  8. I agree with you watcher. I do not have a disagreement with herbie at all, I think herbie offers good advice based on fact. I posted about the 090 number, that was my concern, I never complained to any mods about the link. I do not get involved in personal attacks at all and never will, I do not tolerate personal attacks on myself. I hope herbie stays and helps others on here, for free.
  9. Result Neil! I would say Mr Rundle was a very nice man, only because he realised you had him over a barrel, no paperwork means how on earth could they prove they had actually attended. On the subject of the levy was it ever performed at all? If not then why would they show up with a van? Again this should not have happened. I am chuffed that you are pleased with the outcome.
  10. It could be a false certificate. Anyone is free to check to see if someone's id is genuine when they are at your door. All the utility companies have a direct phone number so you can check the validity of their staff. Let's just say that some bailiffs out there are definitely operating uncertificated, the genuine ones would have no problem with you checking that their certification was genuine. Bogus callers and all that!

  14. When I first viewed your site Herbie, I was thinking, this looks like a great source of information. If you recollect I had actually stated that any site that aids cag members is useful. Then I changed my opinion completely upon finding the 090 number. The reasoning behind this is as I have previously posted. I am not at all against you covering your costs and making a profit, that is what happens in business. I am however 100% against links to profit making organisations placed on CAG. As I stated earlier in this thread this is why I took umbridge to your link and completely agreed with the mods decision to have it removed. For me and this is my personal opinion, if you have bailiffs coming for you then £6.00 does nothing more than make the poor poorer. If you were to offer this advice and documents FOC on CAG then I would do nothing but applaud you. I would like to add that at no point have I attempted to justify my "silly arguments" to you. I have stated facts, ie cost of premium rate calls, why it is against CAG rules to link etc. Maybe i should just dress in a smok, doc martin boots and a pink tu tu, run round the house shouting goony goo goo, now that would be "silly"! As for nationaldebtline being funded by finance houses etc. This is correct. However look a bit deeper, if someone calls a finance house for advice and they have been advised by nationaldebtline already then the finance house will be in a better position to get their money that they believe they are owed as their client will hopefully have been advised correctly, the client will also hopefully have been advised correctly so that they know where they stand with the finance house. So in the case of a finance house, as this service is impartial then by donating towards it they have a means to an end, it saves them selling the debt on doesnt it. Just to state nationaldebtline is a registered charity and it is fulsubject to audit by the charities commission, it is funded purely with donations. I would also refer you to OFT and dca's etc, clients should not be forced to call premium rate numbers, ie 0870 which is far cheaper than 090! I believe I have stood by my own morals here, that's why I give people alternate numbers to 0870 etc and in certain cases direct numbers and names of the contact. That is also why I offer all advice I give FOC, all documents FOC. If your service was 100% free then I do not think CAG would have a problem with your link, perhaps you should try it the CAG way and say donations are welcome.

  16. You will find that eviction is the very last resort. She can prove she is attempting to pay. The judge will probably put in place rent monitoring, full rent and some arrears to be paid each month. If failure to pay continues then it starts to get more serious. Has she applied for housing benefit?
  17. How do you know it's been withdrawn? Neil-tp could have paid online or by cheque to the council, this doesnt automatically mean the warrant will be withdrawn. As for the Bailiffs fees, if they have actually performed the work as instructed by the council and those fees are the standard feees allowed in law then they are entitled to be paid.
  18. Both vehicles will be on unregulated agreements then. Am afraid this means that you have no rights to halves and thirds rule. 25k is the ceiling at which a regulated agreement can be made.

  20. Welcome to CAG saxomad, and to making your first post too. I think Ilovebanks already has his contract as he says the terms and conditions are not very clear. We just have to find out what kind of agreement he has.
