Bank Submitted Defence 28/6/2007 - I must submit AQ by 17th July
Banks Solicitors have sent me letter stating:
REQUEST FOR FUTHER INFORMATION
We have been instructed to write to you as our client is, entirely on a without predudice basis and with no admission whatsover to liabilty, minded to enter into settlement negotiations with you but before doing so, we are told that ther appears to be a discrepency in what you are seeking by way of a refund of Bank Charges.
We note from your pleadings that you are claiming (alleging) that various deductions were made from your account over the past few years, but you do not specifically say when and how.
In light of this , can you please provide us with the following informationby return:-
1. Each and every individual amount of the charge that you are claiming and disputing;
2. The date of each and every charge that you say was deducted from your account.
3. How you calculate any interest.
4. How you calculate the sum of £1933.76
5. Confirm sort code and Bank account numbers.
we would be grateful if you would respond within 14 days of the above date so that we may then take our clients futher instructions. In any event kindly acknowledge safe receipt of this letter.
Is this normal?
What should I do?
Submit my AQ and Allocation fee as normal and also send the solicitors the requested info?
Surely if the solicitors are saying they will be settle ther is no need to pay the Allocation fee?

Hi im ready to serve my N1 to the court!
Nothing in FAq section acutally explains what you should do with the form when youve filled it in? Should I post it or deliver in person or is that not an issue?
How soon will things move once the court have it. Im going away for a week on friday 15th till 26th. I dont want to have to do anything in this period!?

Just filling out my N1 form.
How do I work out the daily rate from this section....
Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx per day [(enter daily rate here - (CHARGES+OD interest)x 0.00022 = pence per day)] OR at such rate and for such periods as the court deems just.
I know how much interest im owed...
Charges £1720.00
Interest under s.69 County Courts Act 1984 £211.92
Court Fee £120.00
TOTAL £ 2051.92
But i need help with the bit above/\/\/\/\/\/\/\/\

Will it effect my claim that ive included the defualts paragraph in my prelim letter but I plan not to use it in my LBA.
This is becuase I have been issued not default notices?
As I was earlier confused by the definition.

I am trying to claim 1720GBP back from lloyds i have a graduate current account.
Just got a letter from loyds after sending my prelim. It basically says that the charges are for a service etc and ignores my demands. I guess this is normal. One thing has worried me tho, they mention this..
"The OFT has published new guidelines on credit card default charges. We still talking it though with them. The important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesnt apply to your charges as these were for dealing with your request to go over your agreed overdarft limit. They are not default charges because you havent broken you agreement. These prices are for a service we provide in these situations."
As I had most of my statements (and I just phoned lloyds for them to send me the ones i was missing) I never sent a statement request letter. So I do not know for sure if they have entered defualts on my credit score. I just presumed they had so included the paragraph in the prelim letter.
So my questions;
How can I find out if theyve enterd defualts now?
Will it effect my claim if they havent entered defualts on my credit score but i included the defualt paragraph in my prelim?
Are they just bullsh*ting me to confuse and scare me and they clearly have 'defaulted' me.
Sorry to ask but i dont want to mess up at such an early stage. Please Help!?
PS Can you explain how im meant to keep all my progress in one post im a little confused about this too!!

Thankyou for your help. Yes the bank have sent me a letter explaining what has been agreed. Can you explain recriminatory action?
I am paying £60 each month £35 of which is just interest, can I claim back this aswell.
You are completely right about my attitude I am not even in my overdraft with the amount they owe me.

Im looking to claim back aound 2,000. However I am currently in a repayment plan with my bank as I am several hundered over my OD limit. I am paying back the minimum each month to keep them happy.
If I start my claim soon the timescale will probably mean that the whole process takes place before Im back in the agreed OD.
Will this payment plan or the fact that im over my od limit effect my claim????

I have parachute account. All buisiness has been moved.
Havent sent any letters but have all my statements so dont need to send the data protection letter.
In terms of my od repayments they have only just rung me today, only mentioned legal action if I dont do anything. I said I would ring them back in the next week when I had an idea what was happening with my cash flow. Maybe I should offer a small payment monthly and begin proceedings?

They are asking me to enter into a repayment agreement.
If my charges were repayed this would not be needed.
Should I just go ahead and start reclaiming charges?

Im massively over my od limit. The bank are threaterning legal action. I havent even begun to take action against them for nearly 1900 pound of charges. What should I do ??

Hi, Im currently preparing my court bundle after submitting my AQ.
The court bundle thread suggests you include a copy of the terms and conditions.
I dont have this!?
Can anyone supply me with a copy of the Lloyds Student account T&C's or suggest where I might get some?
Im sure there was a tread on this lloyds forum a little while ago asking for people to help by summiting copies of T&C's.
