  1. Hey there could anybody advise me what is going to happen. I was out on saturday night in a nightclub. I took my jacket off so i could dance cause I was sweating. I then went outside forgetting about my jacket and getting a taxi with some guy who lived near me.

     

    I woke up and phoned the club but it was not found. I asked to see CCTV but they said that they had checked CCTV and they could not see me on it. I asked this incase I had actually wore my jacket outside because a mate told me he thought I was wearing it.?

     

     

    question1 .. since the kilt jacket was hired will I have to pay them the full amount for the jacket :(

     

    question2... Can I gain access to the CCTV footage to make sure I did not wear the jacket out of the club?

  2. Howdy people....

     

    I was coming across the Tay road bridge and went to give the guy my money and it fell down side of my seat and I could not get it!

     

    ANYWAY!... He told me to pay it within 7 days or police would be at my door....

     

    I went to pay it however they said there was nothing against my number plate? It cost me £10 to come through to pay it!

     

    However ! I got a letter through the door saying I need to pay it... however on the letter my bloody number plate is a letter wrong by one character! no wonder they could not find me on the system!

     

    I feel like I should not pay this due to me going all the way to dundee to pay it and telling me there's nothing logged against my number plate! absolute fools!

     

    what do you people think i should do? If they take me to court I can show that on the letter it provides the wrong number plate

    Request for repayment of charges

     

    Dear Sir/Madam,

     

    ACCOUNT NUMBER: XXXX XXXX XXXX XXXX

     

     

    My request

    I am writing to ask you to refund to me the charges which you have levied from my account over the last three years.

     

    I now understand that the regime of fees which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law and contrary to consumer regulations. If you say that they are not, then will you please demonstrate this by letting me have a full breakdown of the costs to which you have been put by as a result of my breaches, in order to reassure me that your charges really do reflect your costs.

     

    Additionally, it has now been confirmed that your particularly high level of penalties are considered to be unfair per se by the OFT who reported on the 5th April 2006 and are therefore presumed to be unlawful in the absence of specific proof to the contrary.

     

    Your responsibilities

    I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

     

    I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise.

     

    I consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them.

    Your concealment of the true nature of your charges has prevented me from asserting my right until now.

     

    What I require

    I calculate that you have taken £180 plus £175.24 which you have charged me in overdraft interest for the sum which you have taken. Total £355.24 .

    I enclose a schedule of the charges which I am claiming with this letter.

     

    My targets to resolve this matter

    I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets.

     

    I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment.

     

    If you dispute that I am entitled to a refund of these charges, I request that you forward within the above mentioned time scale, a copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions. These are requested under CPR Pre-Action Protocol 4.6©, and failure to provide them will be brought to the attention of the court, should it be necessary to commence a county court action.

     

    If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.

     

    After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline.

  4. Wise move monty! when they start pushing you it always sounds dodgy!. I had a guy who bought my car from amsterdamn who tried to buy my car with a fake cheque! kept phoning me asking when his car was coming!!!! u can never tell till its too late sometimes so its good that u had the common sense to not do it

  5. The funny thing is the company that came to do the cement work never done it!... hence it was never actually done so there was a roof with no sides cemented sitting like that for months on end! I believe that could have caused all the water to come in the house again!!!

     

    I just really dont know what to do. I could go to T in the park with this money or could give it to her. If I dont give it to her I could end up in a sticky situation. She said that the surveyor report said the roof was in a bad way however we only rebattoned over the old lines etc that were on the roof. The £700 cost comes from the wages I paid my staff and the tiles etc etc! what an absolute nightmare.

  6. Weegirl you have made me feel so much better! In regards to the cement work... she phoned a guy to come out and sort that but he still had not came 3months after promising to sort it for her so that never actually got done. I think this is the real reason why the council noticed that the roof looked a mess in the first place! Ure advice has been extremely helpful! If you state it is costing here £90 / hour and I have been giving her £40 a month for some time now then it seems she is ****ting me about the lawyer. If she tries to take me to court for the 5k and wins would I have to pay the 5k even if I aint got a penny to my name?

Anyway.. the roof was in a really bad state before I fixed it and rain was coming in left, right and centre in all parts of it so it would have cost her the £4000 to get it fixed anyway unless she had got a private contracter. She did not wait on the councils permission before getting me to do it! hence why she was made to pay the 4k hereself and not half!!!!

  8. It is half owned by the council (since her neighbour lives in the council house and half owned by her which she has bought). Cannot recall exactly what the contract said but said "all work gauranteed"

     

    I think I will just pay her this weekend to get this off my back and get on with my life! :(
