  1. Hi, a little while back i deposited a cheque for £700 in my basic current account with the above building society. about 2 days later i wrote a few cheques on the grounds of the other cheque would clear first. well the other cheque didn't clear first so i got a few cheque charges. my problem with this is they wrote a leter stating there were insufficient funds in the account pay the cheque, fair enough and they would charge me £29.50 now according to them the £700 hasn't cleared yet they still took those charges out of that £700 that apparently wasn't in my account, why are they allowed to take my money when it's supposedly not there but i can't spend it myself? anyway i sent them the first unfair bank charges letter from the template section and received this reply, now are they correct in that i can't reclaim these cheque charges? or are they just trying to fob me off? cheers chris
  2. ok, i sent lba, they have have now responded offering me £250 as final payment and in full settlement. am i entitled to write back to them saying i will accept the £250 as partial payment but i will be pursuing the rest of the money? problem is now money is extremly tight so this £250 could be really handy but i don't want to roll over and lose the other £390 thats rightfully mine chris

  4. hi, just on writing some lba's to my banks, could someone explain this line in the draft letter, If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice. also where do i add in claiming the cost of the £10 for requesting dpa disclosure? cheers chris
  5. thats what i thought, does that only apply to getting it repaired or to an exchange for a new unit aswell? only gave up yesterday as i was only passin by and didn't havemuch time to deal with it chris

Hi, i bought an mp3 player in november 2004 from dixons and it stopped working after about 8 months, took it back, well what i had left of it as box and manual had long gone and they exchanged it for a different branded unit of similer spec, this has now broken aswell. i have taken it back into the new fangled currys digital which is the same store and there refusing to exchange or repair the item as i don't have the box or instruction manual, now sorry but the manufacturers warrenty doesn't say i have to return it along with all the other parts but the store think otherwise. to make matters worse they are insisting it came with a software cd(it didn't it's an iriver unit so is just plug and play) and they insist it was also supplied with headphones again it wasn't which did suprise me whn i first got it. i have all the other parts for it except the box, manual and apparent headphones and cd that never existed so basically what are my rights regarding this matter as i have my receipt, i am not worried if they won't exchange the unit but im sure im entitled to it being repaired under the warrenty regardless of where the other parts are? cheers chris
  7. basically i posted a long thread in general forum about reclaiming some charges and someone suggested breaking it down into the relevent banking forums so here it goes. lloyds tsb student account(girlfriends account). traced through internet banking that they owe around £100 of charges. wrote first letter to them from template file, received usual response of you agreed to t's & c's it's your fault. wrote back pointing out they broke the t's & c's by applying unlawful charges to the account. they wrote back saying take it to the financial ombundsman. do i take it to the Fo or just file with moneyclaim? problem is she has a £2000 overdraft so can't afford the account to close, but am i right in thinking that if they do close the account then they have to negotiate a repayment schedule? if so then i can only see it as a mixed blessing as at least it would force the hand in repaying the overdraft as opposed to it drifiting along for years and tarting it around to keep interest down? cheers chris
  8. basically i posted a long thread in general forum about reclaiming some charges and someone suggested breaking it down into the relevent banking forums so here it goes. capital one credit card, rang them up and they told me how many charges they'd made, totals up to £160. wrote them the first letter from the template file. they responded saying they would not refund the charges as they were my fault and i also agreed to the t's & c's. but as a good will gesture they refund £40. wrote back to them thanking them for the £40 and pointing out that they've broke the t's & c's by applying unlawful charges. they responded by stating they disagree but as a sign of goodwill refunded a further £40 and if i wanted anymore id have to go to the financial ombundsman. should i go to the FO or just file a claim with moneyclaim? cheers chris
  9. basically i posted a long thread in general forum about reclaiming some charges and someone suggested breaking it down into the relevent banking forums so here it goes. 1, halifax current account, now closed. sent Data Protection Act letter requested statements, gone through and calculated they owe me around £640. wrote them the first letter from template section requesting repayment, they wrote back offering me £80. rang the number in there letter and eventually they offered me £250 final settlement. they've said if i want anymore then i have to go to the financial ombundsman. should i go to the FO, or proceed straight to moneyclaim? 2, halifax credit card, now closed. rang them up and they told me the amount of charges made, totals around £400. sent them first template letter, they responded saying there aware of OFT ruling and there not refunding my money, but i can go to financial ombundsman. i rang them up and they argued with me that the charges are in noway unlawful just that they have been ruled unfair by the OFT and as such they won't refund my money but they are adjusting there future charges policy. so again do i go to the FO or file with moneyclaim, or write them another letter clearly outlining my case and again requesting return of the money? cheers chris
  10. question 3, basically they've spat there dummy out as i had the nerve to argue with them about the charges so they've closed my account in retaliation, basically is it legally fair for them to do this? also i have agreed a repayment schedule for outstanding debts with them, will this be shown on my credit record? chris

Barclays current account now closed, sent dpa letter and received statements and cheque also as they didn't charge me. calculated charges to be around £400, wrote first letter from templates to them at end of april. since then i have received no response, rang them around mid april and they said they received the letter and have since sent two letters, one confirming receipt and that there looking into it, and the other stating there still looking into it. i have not received either of these letters, which i find odd as the address is the same as it's always been and i still get advertising stuff from them. rang again recently and was told there still looking into the matter, this to me is unacceptable as it has been a month now, so what should now be next course of action? should i proceed to send them a letter before action? ring them and ask there stance on this complaint, or proceed to lauching a claim with moneyclaim? cheers chris
  12. ok hoping for some sound advice here, firstly the facts, account 1, halifax current account, closed, after going through old statements total charges add up to around £640, sent template letter from here first, they wrote back saying they'd only refund £80, refused this, rang them they've now offered £250 but say they can't offer anymore and if i want the rest go to financial ombundsman, is this correct or are they hoping ill accept the £250 and forego the hassle? shoud i know write to the financial ombundsman or just file on moneyclaim? account 2, halifax credit card, closed, total charges come to around £400, sent same letter, they refuse refund as they are aware of OFT ruling but insist it only says charges are unfair not unlawful? they say go to financial ombundsman but they'll win as charges are a result of me running the account poorly, again i think there just fobbing me off so as above write to FO or just file with moneyclaim? account 3, barclays current account, closed, this one annoys me, they owe around £400, have written them first letter, no response in 3 weeks, rang them they claim to have sent to letters acknowledging receipt of letter and a further one saying there looking into it furthur, have received neither letter and it's at same address since account opened, but magically i still get advertising stuff from them. ring them again they just pass me around departments. do i still pursue them, write to FO or go with moneyclaim? account 3, firstdirect current account, wrote to them with letter requesting refund, they did this, became unemployed missed a cheque payment got another charge, requested refund they granted this but closed my account which is a shame as i liked the account. are they entitled to do this over my enforcing of my rights as they were quite pushy about me reclaiming charges and threatened to close it after claiming first charges if i went od again. account 4, capital one credit card, wrote letter requesting refund of £160, they wrote back and refunded £40, wrote back saying not acceptable so they refunded another £40, but now refuse to do anymore saying write to FO ombundsman for other £80, again do i write to FO or go with moneyclaim? account 5, lloyds tsb current account (girlfriends student account). wrote letter requesting refund of about £100, they refused as she agreed to contract, wrote back saying they agreed to conduct it in lawful manner they haven'tetc. they still refused and said go to FO, again go to them or go with moneyclaim? issue here is girlfriend has large overdraft so doesn't want to end up in similer situation as my firstdirect account sorry for the long post but i could do with some advice on each of these accounts to get some results cheers chris
