Is anyone getting anywhere with going to court on Estimated charges.
jshtr3 replied to draigfach's topic in Barclaycard
Sea side lady, did I make a mistake, is it this that you don't reccomend or claiming on estimated charges? -
Hi, I would reject it and file your claim. on the date specified in the LBA. You clearly stated yor requirements and the consequences of not complying with them. It's just ploy to string things out further.

How long have you been waiting for the rest of your information, have you complained to the information comissioners office? My thoughts would be don't file. I've read things can get tricky for estimated claims unless you have explored every avenue thoroughly. I assume you sent an LBA for non compliance of your SAR. If so you need to file for this first. It will take longer but better safe than sorry. You could also try claiming for the charges you can prove then claim again once you get the rest of the info. -
Are the courts so overwhelmed as never before
jshtr3 replied to RETURNED TO SENDER's topic in Lloyds Bank
Has there been any other occasion in the history of the court service where so many litigants in person have acted against a few institutions, and is there anything within the operating framework of the courts where a test case can be forced if someone is deemed to ba abusing the legal process? Where can you find this type of information? -
There is a buddy system on this site, if you get to the point of attending court (which doesn't happen that often anyway) people can volunteer to give you a hand. See this link for something that happened recently, worth reading the whole thread if you have a spare 6 hours http://www.consumeractiongroup.co.uk/forum/lloyds-bank/41729-pen-lloyds-tsb-21.html#post830534

Hi, this is what I used "Therefore I require that you repay £348.00 in charges plus £237.77 in compound contractual interest charged at 27.9% (the amount you charge me on purchases.) Total £585.77. I have attached a schedule of the charges to this letter

I had the same issue with my LBA last week. I just ammended mine to "please send me a copy of ......." From what I understand it's clearer that credit card charges are penalties due to fixed payment dates, stricter limits etc. so not as important to have T&C's but still worth asking for and having. Change the spreadsheet now as it ties in with you accepting offer as part payment. Hope this makes sense.

As long as you didn't sign anything to say you wouldn't claim again then yes, you can claim again. Don't think it makes any difference if you pay off OD or not
-
Never submitted one of my own so don't know if it's standard. Nice to see you're concerned about how your printer feels about its work though. Perhaps when all this is over you could send it to a rescue centre with reems of A4 to feed on, or reccomend it for a promotion to FAX machine;)
-
Don't suppose it can hurt sending a cover letter
-
Fairy, you need to start a thread in the halifax forum but the advice will be the same, they aren't OK and you can claim them back
-
You can't claim OD interest but the others are OK. How come HSBC was easy cos you don't have an overdraft?
-
Yes, when claiming CCI you should include it from the begining
-
Yes, give them 14days then file. Ammend your spreadsheet by entering Gesture of good will in the charge column and the amount refunded as a negative £-216 and the date you recived it. Spreadsheet should do the rest. You must do this before you file your claim. EDIT Told you this already ERRRRRRRR;)
-
Congratulations, You don't have to agree to their terms by the way. Just write back crossing all the terms out of their letter you don't like and go book your holiday:DWrite to the court telling them it's settled once you have cleared funds in your account.
-
Hi helmllwyn, Sounds like you've had a nightmare. Good news is you can still claim any charges they applied to your acount. Firstly you need to start your own thread then have a read of these http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/ Just ask if you need more info
-
Hi mutley. You can claim for both accounts together but be sure to mention both account numbers on the letters. I used the andover address for corespondence but your branch will be fine too. When you get to filing your claim make sure you use the registered address at gresham street in london. No need to include anything else with the prelim and LBA (except the schedule of charges). Have a look in the FAQ's if you havent already. Hope all goes well Trev

LOL I knew they were good but.......

Hi Drifter. Unfortunately no cheque today, think [problem] pay a man purely to ring people back and say "cheques in the post" I hear this a lot (and have used it a few times myself:eek: )and he has the most convincing tone to date.
-
If you still have an account with them it may be worth ringing your call centre, they may be able to tell you when you opened the account and yes, now is the time to join the claims as long as they are for less than 5K combined. You will need to file using N1 as there won't be enough room for your POC's claiming online

These are the links you need, Use these details http://www.consumeractiongroup.co.uk/forum/bank-templates-library/681-4-particulars-claim-n1.html to fill in this form http://www.consumeractiongroup.co.uk/forum/bank-templates-library/844-n1-claims-form-pdf.html. You can't save the form once you have completed it so make sure you print off at least 3 completed copies. -
Chrissie, As aviator said in post 13, if your claiming contractual interest there really isn't enough room o file on MCOL. You need to use an N1 and file at your local court.

Hi, I used the vampiress google SS with CCI throughout at 17.9%, this was on my statement at the time. SS very easy to use, just put in date, type of charge, amount, intest rate and date of claim. It did the rest.
