cheers for that jazzdocs, i had read of other people who had negotiated and got what they want so thought i would give it a try, no harm in doing so because if i didnt get what i want i could just let the claim run its course, congratulations on your win anyway:D

ok, this is were im at, sent all letters to my timescale, filed a claim through mcol which was issued 5/5/07 then acknowledged by abbey about the 20/5/07. I recieved on saturday 2/6 a copy of there defence and a letter off abbey saying that i should pay something when i go overdrawn or can't meet direct debits blah blah and the charges are liquidated damages and not penalty charges and therefore valid pre-estimates of loss. It goes on to say that my claim is for £2045.95 in charges and interest and as a matter of goodwill and without any admission on abbeys part abbey will offer to pay me 65% of my claim which is £1329.86, they have given me a form to sign and send back. My problem now is i dont want to accept 65% but i would accept 90%, i would love to negotiate with them but theres no contact information on the letter, does anyone have any contact information for vivian roux at abbey or is there a template letter anywere i could use to negotiate the amount offered, any help would be appreciated.

hi, been a member for a while now but never posted till now, iv'e just read and read and read, you cant go wrong with a site like this so a big thanks to everyone involved, I did my mcol against abbey for £1925.95 inc interest on the 3/5/07, checked the mcol website on the 4/5/07 and it said issued, im very excited in a nervous kind of way, will start a thread in the abbey section soon.
