Hi people. Long time no see. I'm in the process of helping a couple of friends of mine with a problem and need some up to date advice These two friends run a small time curtain making making business. Very small scale. They did some work for an interior designer last year for about 10 months. All was going well until the end of last ear when she started moaning about the quality of some of the work. She then refused to pay about £2000 for work done. Her complaints about the workmanship are very spurious indeed and any small problems my friends have put right at their expense. She was sent a first and final letter befor action. She has replied threatening to counter sue for over 8000 for loss of business and additional expenses incurred as a result of my friends alleged poor workmanship. My friends are happy to pursue her through the scc but I'm a little unsure of the procedure if she counter sues. If she counter sues for £8000 could it end up being put outside of the scc and as such e issue of costs need to be considered. Any advice would be welcome

Just a quick update. As suspected Barclaycard had registered a default whilst the matter was in dispute so I decided to impliment the banks complaint proceedure alleging they had breached the banking code. That was a torturous affair to say the least but eventually last week they agreed to remove the default. A good result eventually. Im just about finished with the re claiming game having got back almost every single penny paid by the kids. I wish you all good luck when the bun fest resumes next year that is assuming the banks havnt all gone bust as a result of their greed in the mortgage business. If the judgment goes against them next year it could be the final nail in the coffin and perhaps then we can get back to ethical local banking with decent customer service at a reasnoble cost.

Rumbley I have also the same problem. Just moved into a house which previously had a contract with Talk Talk The previous owner has cancelled it For ease I tried to start a contract with Talk Talk but they tell me the line has been discontected and I will have to get in touch with BT to get an Active BT Line Speak to BT who will only do it if I pay them about 130.00 for the privilage. The line still works but this is because it takes about 10 days for the cancellation to go through. This is really P@#$%ing me off Any ideas anyone

I had exactly the same charge with Direct line and like you they had referred it to a debt collection agency almost before I had time to read the letter. I ended up paying it but I wasnt V happy

If your claim was for charges plus the interest you have paid on them then your entitled to continue with the claim. What you cant do is claim the statutory 8% allowed by the court unless you have issued a claim.. It is a fairly simple process with a pen and calculator to work out how much interest youve paid on the charges and you will be surprised how much it comes to Eg. a £20 charge will become £23.57 after a year at an interest rate of 1.4% per month

NTO - Notice to owner NRO - Notice of rejection in reply to your formal representations. If you have made only informal representation as a result of the PCN wait for the notice to owner and make formal represenattion. Then wait for the Notice of rejection which will no doubt have some errors on it. Long way to go yet

The most recent NPAS annual report slated the councils for not showing descretion especially towards incidents like this. I would appeal. The maximum it will cost you is another 30.00 and the chances of them getting all the paperwork correct are slim. Are you able to post the PCN, NTO and NRO on hear so we can look at it

Why didnt you use the above. Nowhere on the PCN other than the tear off slip does it mention the 14 day discount. This is a stone bonker winner The PCN doesnt comply. There are loads of examples of motorist winning on this point alone. -

Colin Dont panic The chances are that the case will be stayed due to the OFT case and in your circumstances that isnt such a bad thing. Take what youve got to court Apologise if necessary and explain honestly why it hasnt been done lloyds would be hard pushed to complain as they havnt produced papers either. Worrying about it just isnt going to help. Your no worse off than you were 6 months ago. certainly dont give up and make sure you attend court. good luck

If you dont know this bloke then you are taking a risk all be it you have done everything you can to find out about the car. If your parting with serious money then tell him to get the V5 which takes a couple of weeks and then you will do the deal. I wouldnt touch it without one neither would a dealer and that should tell you something your call though
