  1. Well it worked. Claim for the lot. First Direct will ofer 80% on your first letter after Prelim, and full ammount after that. Only 4 letters in all and the 4th was a letter of acceptance. Go for it guys. After all it is your money.:-D:-D
  2. I know the feeling. I cant wait for the next one. Just waiting for my statements.:)
  3. Congratulations........:):) Definately worth it dont you think. Dont get too drunk.
  4. Thankfully i haven't got to deal with Barclays then. Still good luck and stick with it. It will be worth it in the end.
  5. Thanks Madhouse5, It took 7 days for them to respond to my initial rejection letter. Hopefully you wont be far behind me. FD were too easy. I hope the rest give in this quick.
  6. Message to any Mods. How do i show that i have been successful on my threads ? Thanks
  7. :) Well it was all worth it, and very painless. For me anyway. Not too sure about the bank. Second offer received today for full ammount £1465.00. I am going to accept this, but will be accepting with my own letter as opposed to their required declaration. My letter reads " I accept the sum of £1465.00 as full and final settlement ref to the above account with First Direct". They state that i will recieve a cheque sent to my home address. Does anyone know how long its taking them to issue such cheques ? Thanks to CAG. Without this site i dare say this money would have forever lined the banks pockets. I am now waiting on a couple more claims to be as succesful as this one, and i wwill be only too happy to make a donation to this fantastic site. Thanks for all you help. :)
  8. Well it worked. Statements received. Worth the phone call. Now for the maths and my claim. Watch this space. They have even reminded me of an account i had forgotten about. (Still within the 6 year limit). So statements requested for this as well.
  9. Well today i got fed up of waiting and tried one last time to make some contact with the ignorant people at Lloyds TSB. I phoned my branch and spoke to the stand in manager there. I was quite direct explaining they were now in breach of the DPA and if i didn't get a decent response today then i would be going to the courts. I think i frightened her a bit. She got back to me within 2 hrs with a promis that my SAR would now been expedited through the system and would be out to me within 7 days. And free of charge. She even said that they would only send me the charges file to speed this up. Well we will see. I wait in anticipation. She knows whats coming otherwise. Apparantly she was saying that the center set up to deal with charges reclaims is currently innundated with letters from customers wishing to get their charges back. Now theres a suprise.
  10. I havn't had my statements that is the issue. In fact i have had no response from them what so ever. My issue is based on them not complying with my SAR.
  11. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6986-data-protection-act-non.htmlSorry Im getting confused. According to the template i used the time scale was 7 days. Yet you say 14 days. I dont want to mess this up and look a complete idiot in court. I used the template as recommended by UKAVIATOR. See above, Template 3. Thanks
  12. Thanks. It leaves you a bit unsure though when they state that the acceptance form must not contain any ammendments or it will declare it null and void. I do understand what you say though, just needed clarification. Thanks again. I await their reply.
  13. Yes, your right still the DPA request. And they havn't replied to the LBA either. What now ?
  14. Hi Nicsussex, I followed the template for the 7 day issue.
  15. Guess what. No reply. LBA sent 16th April. Still nothing received. Is the 7 day rule based on working days or calendar days ? Thanks guys.
  16. Hi All. Ive been reading for some time now and have already taken some action against 3 banks. (FD, Abbey, & LTSB) I sent my SAR off to FD on 7th March. Got a reply and my returned cheque on 15th March. Statements arrived by Courier 6th April. I done my homework and worked out they owe me £1515 in charges. (Im claiming for everything they have highlighted as a charge). Prelim letter sent 10th April, and a reply received with offer 20th April for £1245. The letter seems the standard rubbish they are using to hopefully put people off going the whole journey. Any way im not accepting and have just written the rejection letter stating that it will be accepted as part payment givivng Mr Kernaghan 7days to pay the full ammount or i will issue the LBA. A question for all the knowledgeable one on this site. The offer states that the figure offered would be the full and final settlement of my complaint against the bank. How do i stand should a new offer arrive as i am also requesting statements ref to my FD credit card account. Would signing the offer letter prevent me from making claims on other FD accounts ?. Any advice is much appreciated. Thanks.
  17. PPman159 On the last enquiry, actually they hadn't. Just a delaying action probably. I know they have it though. Watch this space. If there is no post by 12 today then i will be sending a letter promising court action.
  18. Hi Ukaviator Thanks for your quick reply. Much appreciated.
  19. Hi Everyone. Iv sent my DPA letter with £10 payment (Registered) requesting my account data (charges etc). I sent it to my local branch. I have confirmed delivery electronically and it was def recieved. However on passing the branch 30 days after sending the letter i thought id pop in and ask how things were progressing. To my suprise i was given the response that they had not recieved my letter. :o Fortunately i had a copy with me which i willingly supplied, and was told that my account details were now being loaded and a response would be sent to me ASAP. The 40 day window is up tomorrow and as yet i still dont have any reply from them. What do i do now ?? Any help would be much appreciated. Thanks Darren
  20. Thanks for that. It wont hurt to give it a try. Watch this space.
  21. Hi guys, In addition to an Excess overdraft fee of various ammounts each month. (this i know i can claim), but i have also been charged an Overdraft fee for each month that i am using the arranged overdraft. Can i claim this fee back as well ? Thanks.
  22. Thanks for that quick response. I did think this was the case. I have a lot of reading to do by the look of things.
  23. Hi all. I am very new to this, and having recently been made aware of what the banks have been doing to me all these years, i am eager to fight back and take a stand. I am going to look at claiming off three different accounts i have held in recent years. One is still current, and the other two now closed. All three accounts are with different banks. I want to know if a small claims option would be made seperately against each bank, (meaning a max total of £5k for each account). What i am trying to say here is, are there any problems with making several claims through the small claims court ? You guys have been at this for some time now, so one of you must know the answer to this. Thanks.
