  1. :grin: After 4 stressful months i have evetually got my money back £1196.29 Inc Court Fees and interest. After filing a court claim on HMCS Online and paying £120 it all paid off. In the letter they put "i have returned the form of Acknowledgment to the courts indicating that Halifax intends to defend your cliam. However, on a purely commercial basis, it will cost Halifax money to defend your cliam in terms of legal costs" So even though they are fobbing everyone off, they still pay at the end of the day. Go for it and don't give up, they have also said i will get taxed on the interest. There is always someone trying it on!!! :grin:

  3. Hi Just thought i would update you all on my progress. I started all this in February and now have filed a court claim. I did it with Money Claim on-line i keep checking the progress and i have looked today and the claim has been Acknowledged and have been given another 14 days to reply. Has anyone else been in this position? Is it a bad sign? 30th July midnight i should hear if i have won or not! Keep your fingers crossed for me Michelle

This is my query.... 16th April I sent a letter Halifax requesting my bank statements, I enclosed a cheque for £10 23rd April – letter telling me areinvestigating 29th April - I wrote again, as I had no reply 2nd May - I received a letter with 2 pieces of paper with charges for both my Halifax accounts. Not the statements that I paid for 11th May - I get a letter saying further to your letter we are still investigating and will get back to you !! Confusing when already received what I asked for 14th May - wrote back to the Halifax asking for the Bank Charges that have been charged to my account for the past 6 years to be paid back plus the interest 7th June - I get a letter from 'Sorry you are not happy we are in the right and not paying up' blah blah 13th June - I get a letter on HBOS letter head, headed completion of request, starting due to a technical error I might not of received the info that I requested, which I did, but the list of charges were different, one account was fine and the other accounts there was a big different in the charges sent to me previously I have emailed 2 different people about this and no one replied to me, which makes me more frustrated. TODAY, my husband just called me to say i have yet another letter with another list of charges 3rd list. WHAT IS GOING ON. I am at the N1 form stage but i feel like i need to have it out with someone at the Halifax. Should i carry on the with the N1? or call them?? Thanks
  5. i sent an email to Kelly Duffy on Friday, i have not heard anything. Would she reply to me or do i have to chase, i sent it again yesterday but still not heard anything. is there another person to send it to, or shall i just leave it Michelle
  6. i have done as much as i can so now i am in the process of the N1 form but this is what has happened, i was about the send an email to someone at the halifax On the 16th April I sent a letter to The Halifax requesting my bank statements for the past six years, I enclosed a cheque for £10 for the statements, and gave 40 days to hear from you. On the 23rd April – telling me you are investigating On the 29th April - I wrote again, as I had no real reply On the 2nd May - I received a letter with 2 pieces of paper with charges for both my Halifax accounts. Not the statements that I paid for On the 11th May - I get a letter saying further to your letter we are still investigating and will get back to you !!   7. i sent a cheque for £10 and i just got a list of charges and no bank statements!! Do i need to get that money back?

Really confused, i have had 3 responses to my claim for 2 bank accounts. 2 saying no go away you knew about the charges etc, came on different days and from different people, on Halifax letterhead. Am in the process of filling out the form to start court proceedings will finish this weekend. Then yesterday i get yet another letter on HBOS Headed paper from yet another person with a different list of charges for my 2 accounts one is the same anount as the previous list but the other accounts has another £350 worth of charges on. Do you think i should phone and argue the case telling them they are appaling and they should sort it out and get back to me with my money. or just start court proceedings, i feel i need to tell them how bad it is that they don;t seem to know what they are doing. Does anyone have an advice for me?
  9. Thanks for the reply. I am feeling really daft about all this at the moment but i have to make sure that i get it right. I fill all the info in on the N1 form? Where is says value - i am just claiming charges do i delete where it says overdraft etc..? In particulars of claim - do i just fill in where it is red and delete other words as appropriate. I live in Leeds so do i just put Leeds - how do i know which court to send it to I keep a copy, send one to the cour and i sent one to the Halifax is this right? At the top of the page i am filling in it says In the..... and on the sheet i printed out for help filling it in it said At the......... is this the same thing. Sorry to sound so thick but i want to get it sent off this week. i also need to send a cheque for £120 as i am cliaming £1340, will they cash this?? Thanks, any help would be great....:-|
  10. I got a letter this morning after months of writing letters and waiting. The last letter i sent was asking for the amount and giving them 14 days as the letter i sent before that asking for the money they ignored it. (again!) What is the next step, please advise me i don't have time to look for the answers on all other emails at the moment. All help would be fantastic Thanks Michelle (very angry)
  11. I sent a letter to the Halifax over 14 days ago asking the my charges with a list of the charges i want paying back. They have not replied after asking them to reply, so now i have a letter that i am going to send today, saying if they do not pay up or respond in 14 days then i will start court proceedings, if they say right go on then what do i do, how do you go about getting a court date, it reallty scares me, i hope they don't go that far. I would call them but i am not a very confident person and would worry that i would not sell my case very well. Any help would be great Thanks
  12. After sending my letter to the Halifax on the 7th March i finally got a reply on Friday. I had to send them a reminder letter in the meantime as i had not heard from them after the 40 days. Then i got a letter saying they would reply in the 4 weeks and they did. I got a list of charges!! Is this right, can i ring and ask for statements or just accept them. Am i taking them that they are all just bank charges and nothing else, and can i add interest on to these amounts. I was very dissapointed with a list, how do i know that they have addedd all the charges. Any help would be great. Thanks
  13. After 40 days of not hearing from The Halifax, i sent them another letter giving them 7 days notice to send me info. I received a letter from them yesterday within the 7 days, which i was suprised at, the letter is as follows.. Thank you for your recent complaint. Im sorry to hear you are unhappy about the charges which have been applied to your account . One of my colleagues will carry out a full investigation of your complaint. Our commitment to you is that we will repond to your concerns as the earliest opportunity. However, we do want to ensure that the issues you raised are thoroughly investigated. If for any reason, we are unable to respond fully to your concerns within the next 4 weeks we will write to update you of our progress. Then loads od blurb is getting a third party involved. What do i do? Wait 4 weeks, or can i go back to them? This is just for one account quote to account numbers to them and they have only quoted one back to me. Any ideas??

Stuck now, i have looked at the templete letters and not sure which one i am sending as i have not heard anything and the 40 days are up, they have cashed my cheque, the letters i have seen had a space for me to put in the amount they owe me but i do not know that amount so i can't send that one, can anyone help want to sed it today.

  16. The Halifax have now cashed the cheque for the statements, 40 days is up on Sunday, do i wait till Monday to send letter if not received any statements from them or send it Friday?
  17. After reading a reply i decided to make my own thread. This is where i am up to now.... I sent a letter on 7th March which was a template letter from the website, i enclosed a cheque for £10 for the cost of the statements. I still have not heard anything yet the 40th day is 15th April. But i recall this letter just went first class, not recorded, im not sure if i should send the letter out again with a copy of the other letter attached or just wait till the 40 days are up and try again, does anyone have any advice.   18. I have a slight worry, i think the letter went 1st class and not recorded, so they can deny getting it, shall i send another one recorded with the other one attached? Still not heard anything. sent on 7th March.
  19. Hi Everyone This is great, thanks you everyone for advise have not had chance to read everything as yet. I sent a template letter off to the Bank nearly 3 weeks ago now with a cheque for £10. Cheque has not been cashed and not heard anything back as yet. How long do it wait 40 days? Then what? I have heard there is a cut off point for claims in April, is this true. The must owe me thousands and i am getting worried now that i will noe get anything. Do they take ages to reply? I can imagine they will say they never got it. Any help will be great Michelle
