Return date was today, Lloyds TSB havent replied atall to myself or the court, how do i get my decree? i phoned the court(glasgow) to ask them but they were very unhelpful and told me to write into them a minutes All help appreciated. Hi i raised me court proceedings for £165 a while ago, the return date is this thursday. Thing is i got a letter today saying they will charge me £30 at tned of the month for unpaid D/D. do i add this on or what do i do about it? thanks Emma

Was sent a letter offering me £60, phoned the person with name on letter, advised him had raised court proceedings, offered full amount over the phone looks like Victory!!

i filed it a week ago with glasgow sherrif court. i phoned them today and they havent even sent the summons off yet... is this normal for it 2 take this long? they said theyd do it today but still....

you can request the charges be refunded regardless if you know what they are for are not. If it goes to court the statement saying charge on it is evidence enough in itself and the bank would have to defend it saying if they are actually for something different. Also the easiest thing to do would be put your mothers name on the bottom of her letter rather than mess about saying youve got permission. You can still represent her easily enough and if you say you are acting on someone elses behalf it tends to delay things a bit. Emma

good luck tommy, you will probably receive a letter from them asking for 8 weeks to deal with your complaint as i did. dont be tempted to wait as after the 8 weeks they just say "we wont be refunding you, you can now go to ombudsman" Emma

yes it is. as long as the charges, not including interest or court expenses, are £750 or less.

ok so if they decide to close my account will i continue to make my payments as normal (20 per month) and will i still be charges their 16.9% interest p.a. and will my credit rating be affected atall? thanks

i have a question i hope some1 can answer. If i am successful will egg close my credit card? i hve £500 outstanding on it and i read in their t & c they can close it if they fel the customer - egg relationship has broke down (which it hasnt!) but can they close it and demand me pay off the full balance for any other reason?

Total came to £215 19/02/07 Sent letter giving them 1 weeks before court action 26/02/07 sent letter giving them 1 more week and 1 last chance 28/02/07 received letter asking for 8 weeks 28/03/07 received letter to say they were still dealing with complaint and will get back within 4 weeks. 29/03/07 Filed small claims in Glasgow Sheriff Court. will keep you posted, Emma

Ok, dont have the exact speicifics to hand but got taken to court for the SAAS overpaying me by £260. i didnt defend the case and agreed to pay by ticking the box for monthly installments. They decree came back saying i have to pay £260 + £130 court expenses, i phoned the sheriff clerk and she said these were the standard court expenses but i thought for small claims in scotland you only had to pay the £39 if u lost? advice please.
