  2. Hi Fred yeah I can see the number, its from the other side of the application that I scanned where they ask the outstanding balance of any other credit cards I hold. Does this mean anything Thanks

Hi Fedup, posted that letter off you reccommended today, also had a call from MBNA about non payment for a couple of month, they said that they do not need to supply me the t&a from when the card was applied for and that the current ones are sufficiant. also said that the application is the credit agreement. I told her she was talking rubbish and to expect the letter I had posted. Can someone just reassure me that the t&c need to be the ones taken at the time of credit and the application is not enough for an agreement. Thanks. Got to get rid of these little doubts that creep back lol Oh I also told her about parts of the form being unreadable and she said she would look into getting me a better copy

  8. Yeah mate its totally unreadable that part, is that good enough for it to fail. Just received another statement from them today with extra charges on. Where do I go from there. Do I send them a letter to tell them its unenforcable. Thanks

  10. Hi I recieved my request for my CCA today from MBNA although it took over the 12 days I eventually got it. Could someone have a quick look to see that it all looks in order and if I will have to start to make payments again. Hi just been reading some of the t&c on part 3a of 3 it says "If you break the agreement you must pay the following default charges: £0 each time that your payment has not reached your account in cleared funds by the date your payment is due. img028.jpg - ImageHost.org Surely this also means all the £12 I have been charged can be reclaimed. I know this anyway as have done with other credit cards but is this what they are saying in the t&c here

  16. Thanks Martin, yeah I was with Telewest prior to Virgin taking over, will Virgin have a list of charges that Telewest applied to the account if it was telewest that charged my account within the 6 years you can claim back.

  18. Has anyone done this with Virgin Media, the £10 they charge you for late payments. Is it just the same process as reclaiming credit card charges as I have done this a few times and are they likely to dissconnect you if you are succesfull in reclaiming. Thanks Mick
  19. Hi Martin been reading bits and pieces of this thread. Im also with Virgin and have been for about 15 years. Can I ask is it just the same process as reclaiming credit card charges and did virgin disconnect you when you claimed the charges back. Thats one thing thats making me be a bit hessident about claiming them back as I dont know if i would pass a credit check to then have to move to sky (if you need one, i dont know) thanks Mick
  20. Send Moorcroft a letter informing them to do everything in writing also send them a harrasment letter if the calling is getting to much. I think there is a link at the top of the Telecoms page about attempting to CCA a mobile company and its suggested that you send off a Subject Access Request. Hope this helps a bit,I'm sure others will be along. Im dealing with Moorcroft at the moment about an account I have with orange.

  23. ok thanks for that makes it a lot clearer, there is nothing on the back of the agreement so I guess they are still in default. Do I still send off that letter to Welcome about the insurance or send a default notice to MDB. Thanks again for all your help and reply's think I would of just gave in without it
