  1. Barclaycard are not playing ball. Offered a measly "Goodwill gesture", saying my legal argument is not recognised, so it's off to Court!!

    Cant find anything that explains claim process for a thicko like me.I can get my head around composing a bundle, but at what point does it get submitted.

     

    Do I fill out the N1 and take it to the Court, await a hearing and then submit my bundle? When do they want the fee paid? Or do I take the whole lot on the same day and pay there and then?

     

    If they have offered a small refund/goodwill gesture,what amount can I claim back if I have been asking for contractual from day one. Is it the balance and interest on the outstanding amount, up to the day of submission to Court?

     

    Anyone out there can help?

  2. Have finally been contacted by Ashleigh Evans ( Senior Customer Resolution Manager). She apologises for delay in contacting me, believes charges are fair and offered £200 as goodwill gesture.

    She has explained how to get details of my charges, even though I have submitted these with my Prelim and L.B.A She also suggests i contact the debt operations department because I am claiming that my account is in dispute. I have clearly stated this in every letter I have sent to these clowns.They have withdrawn my overdraft, passed my details to a debt collection agency, placed a default on my record, and constantly demanded payment even though every letter states In Dispute.

     

    I have had enough and now preparing my first ever Court Bundle but am a bit confused about it and don't want to cock it up.

     

    Do I complete an N1 form and add it to the ( revised to match my circs)bundle?

     

    Where does the Claim number come from to put on it?

     

    Do I hand it in personally at Court,with the fee, and send a copy to Abbey?

     

    Sorry if I seem a bit thick, but the thought of Court scares me stiff !!

    Received a further letter stating that my account is "not in dispute".

     

    Thought that was my decision??

     

    And all fees are fair and transparent and I knew what the terms and conditions were.

     

    Yeah right

    But we are prepared to pay £960 into your account as a final gesture of goodwill!!

     

    That'll do for for me. Now for the rest of them!!!!

  4. I have now been contacted by Debt Management and Recovery Services of Milton Keynes.

     

    They state that they want immediate payment of debt totalling £3,106. This is in spite of the fact that I have been contacted by Abbey, who state they are looking into my complaint, I am a valued customer blah blah.

     

    I have sent three letters , all clearly stating this account is in dispute.

    I thought they couldn't do this until my dispute is resolved??

  5. Don't know what to suggest any more. What really gets me is the fact I have tried to do the right thing after losing the plot, and all these people just blatantly ignore legitimate requests and continue to harrass people on the phone. I wouldn't mind, but I fully expect any fees returned to come off the outstanding balance, and I am willing to pay what I can in instalments.

     

    Being treated like something on the bottom of their shoe is driving me nuts. I am tempted to sit tight, shut up and see if they get me into court. My credit score is wrecked anyway, so they can't blackmail me with that one.

     

    No wonder people go into hiding!!!!!!!!!!!!!!!!!!!!!!!!:mad: :mad:

    What a fantasic thread!! Hope I can be as tough as you were.Have told them they are off to court.

     

    About time these t**sers were taught a lesson. Have spent hours juggling with various banks/cards last week. Looks like most cave in towards the end.

     

    We really need a league table of the most incompetent ones.

  7. Have submited a request for £420.00 plus £66.81 interest .

     

    I have now received a reply from Arlene Linnie, Customer Liaison Officer, stating that their charges are fair trasparent blah blah, and a full and final settlement of £208.00. being the difference between charges and £12.00.

     

    Along with this she states :

    " We do not recognise the value of your interest credit request as any payments made to an account following the application of a fee are automatically applied to reconcile any outstanding fee(s) followed by interest before being processed against any account balance. This is in accordance with our payment hierarchy system. The recent Office of Fair Trading ruling did not accept your refund interest request."

     

    Is she correct? :confused:

  8. Well i have finally spoken to MBNA s "customer relations department and told them in no uncertain terms they are wasting their time asking me to pay instalments when they owe me over £1600. Lo and behold, the girl agreed with me and the phone has been dead for at least a week.

    Now the good news!!

    Goodwill gesture of £620 paid in to the account.

    All seems to be going to plan. Needless to say I am going to accept this as part payment and continue to court until I get the full amount and default removed.:) :)

  9. I have CCA'D Fredrickson International for a copy of my Egg agreement. They have responded by sending a list of my transactions. Obviously not what was requested.They are also demanding to know what I am proposing to do to discharge the debt.

     

    I was paying Capquest £75 a month, but they handed the debt back to Egg and wouldn't explain why.Funnily enough I had CCA'd them as well.

     

    I have set up a direct payment to Egg for £75 a month.

     

    Can Fredrickson take me to Court when I am making efforts to pay this back? Albeit cutting them out of the equation.:confused:

  10. Fresh start today, and a clearer head. I have found a simple credit card spreadie on the templates and it is working everything out so far ( eg days since charge and interest).

    I have just one really daft question.

     

    In the interest column, do I put the monthly amount , 1.385%, or times it by twelve to get APR ?

     

    If I do the latter it seems a bit high, for example £20 charged in March 2002, now has £8.40 in interest on it, if charged at 16.5%

     

    Everything else seems clear. Any experienced claimers out there ??

  11. After having a win against Egg I am now going after Bar****dCard.

    I am owed about £800 and , feeling brave, want to claim contractual interest. I can't get any of the spreadsheets to add the days up or the interest.What I am I doing wrong?????:-? :-?

     

    One and a half hours typing gone up the wall!!!!!:evil:

  12. Have just had a win against Egg and now going for Morgan Stanley.

     

    Feeling brave and going for fees with contractual interest throughout this time.

     

    I am using Vamp's spreadsheet, which adds everthing up brilliantly.

     

    BUT....where it says Interest, do I put in the monthly rate ( which confusingly is 1.167% purchases and 1.496% cash advances in December 2002) or times it by 12 to get the annual rate?:confused:

     

    Because of the info they sent me I cant work out cash advances from purchases, so I was going to go down the middle.

     

    Apart from that I am feeling confident!!!!!!

  13. *SETTLED IN FULL*

    Got a letter last week offering the difference between the OFT suggested rate and what I had paid.

     

    I sent them a letter back saying I would accept it as part payment and Lodge my claim on The 14 th June for the rest.

     

    Got a letter today offering to settle IN FULL UNCONDITIONALLY.

     

    Now for Abbey, MBNA, RBS, Barclaycard, Amex, and Goldfish :) :) :) :) :) :)

  14. Well. I have sent off my prelim for just over £1600, and recieved the stock answer of we'll look into it and get back to you.

     

    In the meantime , I am being hounded by people claiming to be from MBNA , but refusing their department and surname. I keep tellingb the I don't speak to anonymouse people, the account is in dispute, and write to me only, but they are calling up to five times a day!!

     

    They are driving me nuts but I can't get through when I try to ring back on 0800 3890043

     

    Anyone know who they are!!

  15. Thanks for your help. They got me a bit rattled there for a bit. I have CCA'd Fredericksons. I have heard they may be a little bit economical with the truth. I have also set up a regular payment to Egg. When I accessed my account online, all my payments to Capquest were shown, so I thought I would cut out the middle man!

    If it gets to court I will take your advice, and I have the regular payments to show I am not shirking the debt.

     

    Onwards and upwards.
