  1. Fantastic, Fd have decided to pay up, started 15 Feb 07, followed all the time lines and advice from this site, had incredible advice and support, (if not i maybe would have stacked at the county court stage) had an offer today for the full amount plus court fees of £6,210.15. For anyone else out there, do not give up!! it may seem daunting at times, but if you continue with the advice and inspiration from this site , you will get your money back> Rgds Zipster
  2. Everyone, good news, The judge issued a 'Stay' on the claim until 17 May. Sent a letter to DG solicitors 30 April that i aquired from the AQ thread. Then out of the blue came a letter from DGS for a full and final settlement for the whole amount plus interest and court fee. FANTASTIC !! A couple of questions is there a template letter for acceptance with regards to confidentiality and one for the court to end that process? rgds Zipster
  3. GaryH, No problem, i have sent the first 'stay' letter to DG solicitors and copy to the court. Zipster
  4. Gary H, Many thanks for the link to the thread. With regards submitting another AQ, i spoke to Penzance CC today and they are happy with the one i submitted 10 days ago. They seem to think i will hear from FD in the near future to settle, shall i send the letter anyway, do they need pushing along or are they just overwhelmed with claims? Rgds Zipster
  5. Had a reply from Penzance CC the judge has ordered that the claim is stayed until 17 May 07 to enable parties to attempt settlement. Should i now contact First Direct solicitors, or just make sure my AQ is with the court. I have had no contact with DG solicitors throughout proceedings, should i phone or write to them to try and settle? Rgds Zipster
  6. Had a reply from the CC saying that my claim is stayed until the 17 May 07 to enable the parties to attempt settlement. It goes on to say that on or before the 31st May 07 one of the following steps must be taken. 1) Notify court that the whole claim is settled. or 2) Notify court that an extension is required. or 3) all the parties must file a completed allocation questionnaire at the court. I thought i had already filed the AQ, do i need to file another one? any feedback of what happens now would be welcomed. Zipster
  7. A quick update, I arrived back from holiday yesterday. Found the AQ waiting, completed and took down to the local CC with my £100.00. (1 day before the deadline) They said the Judge would look at it next week and i should hear from them soon after that. Have had no correspondence from FD throughout the proceedure, fully expect this to go the distance and to turn up at court. For info the AQ was a N150 and I used the new format for the proposed directions. Rgds
  8. FdDhave just filed a defence today, (2 days before their deadline, i will now await the AQ, i have 19 days to get that back into the court, which is quite fortunate as i am out of the UK from tomorrow until the 11th April. The lady i spoke to at MCOL said that it would be dealt with my local court Penzance. Zipster
  9. Bankfodder, Gizmo111, Many thanks for your help. Rang the court today, they were really helpful and basically said the same as you bankfodder, if they file a defence then i have 19 days to return the AQ,(plenty of time ) if not then tick the judgement box when i get back. Rgds Zipster
  10. Could i ask for some advice please. I have filed an MCOL claim which FD have acknowledged on 28th FEB stating that they intend to defend the claim by DG solicitors Birmingham. 28 days from then is the 29th March to file a defence. I am out of the country from the 28 March, how will this affect my claim especially if i have to fill out an AQ. Can i contact someone and let them know the situation? Can i delay at all? Rgds Zipster
  11. Madhouse 5, the claim was issued on 23rd Feb, deemed to be served on the 28th Feb, so i believe 28 days from 28 Feb. Rgds Zipster

  13. Damjef, Don't get me wrong, i am certain that i will get my money back. However, With FD you seem to have to go all the way before they settle. I suppose they are hoping for every successful claim against FD , many potential claimants, are put off one way or another by the whole procedure that we are now involved with. Zipster
  14. Damjef, sorry you are right 29 March is the date. I read it incorrectly on the notice of issue it stated that the defendant FD had until the 14 March to reply, which they have. With regard to the Financial Service Authority they are due to report on the whole issue of excessive bank charges and could tell the banks to reduce thier charges as they did to the credit card companies which is now set at a standard rate of £12, i believe. If they do this to the banks i read somewhere that they could then offer claimants the difference for each charge applied and settle that way. Does that make sense. Rgds Zipster
