  1. Hi

     

    Had a letter from Equidebt saying my 'Financial situation has improved' claiming they have seen my credit report (although they haven't asked permission to look at my credit report so would thought this is a breach of data protection?)

     

    I have had a debt I have been paying off with them for as far as I can remember, going back more than 10 years, I pay them £10 a month, have done for the whole duration, have £2000 to pay off, but I can't remember if it was a ccj or just a payment plan with them to pay the debt off.

     

    What I would like to know is if I should just ignore the letter or write back and tell them I will not be increasing my payments and leave it at that as I will not be!?

  2. ok, I did complain, both to firstcrud and the train operator, I'm not one for just ignoring it and waiting to see what happens next.

     

    I wrote a letter of complaint to firstcrud, basically calling them a bunch of idiots. I have reported them to office of fair trading

     

    I also emailed the train operator, they replied very promptly and apologised for a debt collector chasing the debt that did not belong to me. They have instructed firstcrud to not contact me again and have written off the debt.

     

    So a good days work all in all.

  3. Good morning one and all.

     

    My wife opended a letter yesterday that arrived at our address but was addressed to someone we have never heard of before.

     

    The letter is from First Credit Management and they are chasing a debt of £68.00 concerning a non-payment of a a train fare during July 2008.

     

    I do use the train line concerned but do not travel between the train stations they indicate, I am a seanon ticket holder on the train line so there wouldn't be any need for me to dodge a fare in the first place, so this is not me. My wife does not use the trains she drives so this has nothing to do with us.

     

    They have also spelt the name of our road wrong at the end with a 'p' instead of a 'd', the name on the letter is so different to my surename that there's not even one letter in it that's in my name!

     

    So what's the best course of action here? I was going to send them a letter explaining they have the wrong person, indicate how stupid they are for not checking records to see if the person lived here or not and indicate that I will complain about them etc etc. Any good letters I could use?

     

    Or do I just ignore them?

  4. Ignore the mugs.

     

    As they are claiming that you can reduce the amount you owe if you pay them within a certain time frame is a very good indication that they know they can't persue the debt in court, they always use the reduced payment routine when they know this.

     

    You will normally get another 1 or 2 letters from them claiming to be passed on to their legal deptartment, which is normally the same person printing a different letterhead from a different folder, then you may get another letter from another debt collector claiming to be collecting for the orginal debt collector, when in fact again they are the same mugs with another letterhead.

     

    Ignore them all and enjoy your smugness at their loss!

  5. Hi All

     

    Bit of advice please.

     

    Back in the early 90's up to around 95 my debet problems were really bad, no need to go in to details, but i defaulted and got many CCJ's on credit cards and loans.

     

    Since the mid 90's I have been paying around 4 CCJ's off at around £5 a month for sums of around £2500 - £5000 each.

     

    I have moved house several times during those days and all have fallen off my credit reference files many years ago. I have not contacted any of them since the CCJ's but all paymens come out of my account via standing orders each month.

     

    I now can't even remember which banks they were for and how much is owed on each but I guess I will still be paying them all for the next 20-30 years at the current payments.

     

    My questions are should I still pay them or just cancel them all and wait until the debt collectors find me and start asking for the money, and I just ask them for the valid paperwork to prove I owe it?

     

    Or

     

    Do I just carry on paying them, as I have a moral responsibility to pay them as it was me who took the credit out so I should pay it back?

     

    Only thing is I do think one of them may have been a bank overdraft in which case would that be a bit more difficult to get away with out paying?

Tell them you don't know the person in question, tell them you will find out where they work, put them on hold, then every couple of minutes ask if they are ok to hold as you can't locate the person but will keep trying, keep doing this until they go away, hopefully they will stay on for a long time at cost to them, welcome to the world of 'how to annoy the DCA as much as possible' it's a fun game! :D

Problem with these clowns is that the calls are generated by an automated call system, the fool at the other end is not directly phoning you it's the system so when you pick it up it alerts an operator in the centre and they then begin to speak to you, I'm afraid they were not asked to have brains when they were interviewed for their pointless job so when you tell them not to phone again they don't have the intelligence to be able to update the system, that has to be carried out by a more senior person, and so the cycle will continue through the system with the constant mundane phone calls.

     

    Write to their complaints department and also report them to OFT for harrasment, they should not be contacting your wife at work anyway.

The only thing is that the credit card debt goes back many years and when I asked the DCA for a CCA they closed the account saying that the original creditor did not have one, therefore there's no sighned CCA by me which should mean I never even gave the original creditor permission to check my file as they don't have a signed CCA.

     

    The reason for the check on my file is that they sent a letter to me at my address asking if I was MR xxxx xxxx with my first name mis-spelt by one letter, I told them that the person does not live at my address, that's when they did the check on my file to get my correct name I guess.

  9. It's not that important to the fact that it will not stop you from getting credit. It's a check to see if someone lives at a certain address for instance.

     

    I noticed it because I pay for the alert service of experian so knew about it within 24 hours of being recorded.

     

    My gripe is that is was carried out by a DCA for a credit card debt to find out if I lived at my address. I did not give them permission to do this, they didn't ask me, and it turns out that the DCA does not have a CCA for the debt either.

     

    I don't see why they should have access to my records if I haven't given permission, even if the search is nothing, but they can see my records etc, surely this is a breach of data protection?

     

    It may sound petty but I really what to do something about this why should DCA have this access and why should experian give them such easy access. What can I do? Or can't I do anything?

    I had an unrecorded search on MY Experian report by a DCA, can I have this removed?

    I know it's unrecorded by I never gave this DCA permission to do a search, or do they still have a right to do the search?

    The DCA wrote to me several times asking if I was a MR xxxx xxxx, they spelt my first name wrong by 1 letter, I responded saying I was not, they then checked my credit file against my address and then wrote back to me this time with my first name spelt correctly.

    I have this search against on my file but with the wrong name.

    I have asked Experian and the DCA to remove this, Experian have replied with the standard reply of writing to the DCA but if they do not give permission they can't remove it.

    I have complained to OFT and ICO but this has gone for 6 weeks now and I've heard nothing.

    Is there nothing really I can do about this? Or can I take this further? Even to the point of taking both Experian and DCA to court for breach of Data protection?

    Or basically am I just talking a load of B****CKS and should just accept this and move on? :confused:

  11. My method is not as clever as PGH but may or may not be as effective...

     

    I would simply post an A1 sized sheet of paper, folded several times of course to be able to post, and on it would be written in massive bold letters taking up the whole width/length of the paper...GET STUFFED ASSHOLES I DON'T WANT TO BE YOUR FRIEND!

     

    With in small letters the ref/account numbers.

  12. Both Equidebt and Rockwell for 2 different debts.

    I tried 2 experiments with both.

    First with Equidebt I tried the ignore everything method, I received the first letter asking if I was so and so that lived at the address, then the pay £250 a month to clear the debt, then the take to court letter, then the CAS letter claiming to act for equidebt and offering a 50% reduction if paid whole amount, not heard from either again for 2 months now.

    Second with Rockwell I tried the not my debt letters, I received the first letter asking if I was so and so at the address - I replied with no reference to my name on the letter and no acknowledgement to the debt or the name. They responded with a letter claiming the debt was for Barclayshark originally which was passed on to moorcrap and they took it off them, and that I need to pay fully or they will take me to court - I replied saying it was not my debt, still not acknowledging who I was or the debt was mine and asking for a CCA with an attached £1 postal order - They replied within a week to say Barclayshark had no CCA so they have closed the account, again this was 2 months ago now.

    I guess I will get another couple of dumb ass DCA's in the next few months trying it on and I will just wipe the floor with them again, mainly thanks to this site.

    How different it was back in the late 90's when I was in so much debt and had around 5 ccj's and countless defaults to my name, I have since paid all this off but if only I knew what I know now those many years ago I could have stopped some of them debts, if not all!

  13. Wow! Their letters have not changed much over the years, still trying the old 'we are your friends and want to help' rubbish, bunch of mugs! I used to get the same letters with the same wording from them way back in the late 90's, used to ignore them all the time!

     

    Soon dropped them as my chasing DCA many years ago, the fools!
