Thanks for the suggestions guys, yes, the NTO was cancelled quick sharpish of course no photographic evidence, even if there was evidence i would challenge cause no ticket on car and warden standing near car. Some of them are a disgrace. By the way, i just had an interesting conversation with someone "important" in RBK&C and they said that all wardens are subcontracted by NCP (you know the car parking company), as far as im concerned Councilis on fragile territory, they cannot even discipline them themselves, NCP have to do it, but if someone sues them then the Council has to answer to it! What a nightmare, i know you must think ive gone bonkers trying to do this, but something has got to change. I will seek legal advice and even go to my police station (they will laugh me out of there i am sure), but ill give it my best.

Hi everyone, I recently received a Notice to Owner in the post, claiming i never paid a ticket back in July, blah blah blah. Basically no ticket was ever issued, and traffic warden was standing next to the car when i got there, and i had a witness. I wrote a VERY strong letter to RBK&C, and told them that the traffic warden had commited an offence, that of FRAUD, because no ticket was issued. I have never received a reply so quickly, next day in fact, saying "sorry for inconveneince and that they will take it up with NCP or whatever and that i cannot be privy to what, if any, action is taken against the warden". Anway, it got me thinking, I am now on a quest and want to SUE the council for FRAUD. Can someone please give me some advice. I am not doing this for me, or for monetary gain, i am doing this to expose what lying cheating ****** traffic wardens we have out there (not all of them may i add), but the level of corruption is beyond astonishing and something needs to be done about it. Just think of all those poor buggers who get these letters and cannot recall 4 months ago, and all the people who pay up that shouldnt have to??!! By the way, it is not the first time I have received such notices, where no ticket was ever issued. I know I am on a long long painful and horrible path, but if someone doesnt stand up to these criminals, who will?

HELLO EVERYONE WHO REPLIED TO MY POST. I WANTED TO LET YOU KNOW WHAT HAS HAPPENED SINCE I RECEIVED THE LETTER FROM THE COURT. I RANG BARCLAYCARD ON FRIDAY 29TH JUNE, KRISTA CAMPBELL, 0207 116 4753, I HAD TOLEAVE A MESSAGE AS SHES VERY BUSY!! ANYWAY SHE DID RETURN MY CALL AND I ASKED HER IF THEY WERE WILLING TO SETTLE OUT OF COURT, TO BE HONEST I WAS COMPLETELY HONEST WITH HER AND TOLD HER I DONT WANT THE HASSLE. SHE WAS VERY APPROACHABLE AND SHE SAID SHE WILL SETTLE OUT OF COURT, NO PROBLEM. I THOUGHT SHE WOULD TRY TO OFFER ME HALT OF MY CLAIM £492 PLUS £50 COURT FEE, BUT TO MY SURPRISE, WHEN SHE CALLED ME THIS MORNING SHE SAID SHE WILL REFUND EVERYTHING. THEREFORE, UNLESS YOU WANT TO PROVE A CASE IN POINT, I WOULD STRONGLY RECOMMEND THAT YOU CALL THEM TO TRY TO SOLVE THE PROBLEM. I THINK, WITH HINDSIGHT, THIS SHOULD BE DONE ONCE A COURT DATE IS SET, AS THEY SEEM WILLING TO SORT IT OUT. IN MY EXPERIENCE, NO-ONE WANTS TO GO COURT DO THEY!!!??? I KNOW I WASNT LOOKING FORWARD TO IT, ESPECIALLY ALL THAT PHOTOCOPYING AND INCONVENIENCE. please please help!!! barclaycard have put in a defence and the claim has been transfered to my area in London. However: 1. the court states that they are dispensing with the allocation questionnnaire!! why is that?? 2.does anybody know the procedure? 3. No date has been set as yet. I am still awaiitng a small portion of my statements from barclaycard, but i know how many charges from the telephone conversations i had. 4, what will i need to defend my claim? i know i need t&cs for barclaycard, so if anyone has them please let me know. 5.very worried at this stage. help!

Hi Any Mc1 thanks for your time, firstly i have nearly all my statements, just one months missing or so. i originally only received a portion of my statements, like a lot of other people, microfiche excuse etc, but i was told over the phone about the total of my charges, whcih amount fo £820. They refunded me the old crap of the portion etc etc, only £8 refunded per charge. I constantly told them i refused this and called and wrote to them. I was told by one idiot at Barclaycard (unfortunately didnt make note of his name, but have the date and time etc), that if i send them back the statements showing each charge, then they will refund me everything. I included this fact in my claim cause as far as im concerned, it is a verbal statement and im holding out on that fact. I never thought it would go to court as i have won 5 cases so far. I am still awaiting copy of their defence and court date. Have you had similar dealing with barclaycard? They are a royal pain in the ass as they are the only ones being obstinate. It pains me to admit ignorance from this stage onwards. Moreover, when i issued the proceedings, i did not enter the interest, as I was not in receipt of all the charge dates. Can i add this on now i have most of them? Will i have to fill out another form? Pay further fees? If Barclaycard win will i have to pay their legal costs?? Your help is truly valued

HI THERE, THE USUAL STORY, BARCLAYCARD GAVE ME ONLY PORTION OF MY CHARGES BACK. I ISSUED A COURT CLAIM AND THEY HAVE NOW DEFENDED IT... I HAVE RECENTLY WON WITH OTHER BANKS ETC, BUT HAVE NEVER EXPERIENCED WHEN THEY DEFEND THE CASE. WHAT SHOULD I DO NOW!??? PLEASE HELP ME WITH THE PROCEDURE. Can I Claim A Second Set Of Charges, Even Though I Confirmed Full And Final Settlement Last Year???

I Won My Charges Back In October 2006 From Halifax. I Confirmed It Was Full And Final Settlement Of The Fees. Unfortunately I Have Incurred Some More Charges Amounting To £380. Can I Calim These Back Since I Confirmed The Settlement?? They Are Exorbitant Charges, Example £39 For Unpaid D.d For £9.!!!!! Help
