  1. Hiya Sittinpretty71, It's probably the same standard one they seem to be using at the moment read Sarah Lou V Nationwide its quoted on there. They seem to be a bit hit and miss at the moment with claims some people are getting paid before the 28 days and others and having to wait longer. You should receive a copy of their defence from MCOL and then an AQ for you to fill in and send back although they seem to pay up before you have to do this I would chase up MCOL again. Nationwide seem to be making good use of the caos they are causing the court system at the moment and holding on to the money for even longer, which is a real pain. If you do end up having to fill in your AQ and get a Court date but they subsequently pay up in the mean time I would go for wasted costs as well as they just seem to be playing the system at the moment.   3. Hiya, Have you had your AQ'S yet from the court (Thats Legend and Girlybiker) or are you still waiting for a copy of the defence to come through? I can't believe that ehy seem to be paying some people beofre the 28 days and others are having to wait even longer!!. Especially you eddiemno as is was an astronomical amount and yet some people claiming alot less that that are having to wait, and wait, and wait..... Hopefully you will hear something tomorrow. Keep your chin up and keep smiling.
  4. Thanks Parkvale for that, but how long does the court give you to fill in your AQ and what happens if I fill this in and send it back and then the Nationwide pay up. Can I claim the £100 back from them? Many thanks Karen
  5. CONGRATULATIONS EDDIEMNO! THATS FANTASTIC11:cool: I can't believe thay have paid you all that money before you deadline!! Did you go through MCOL or N1 way. My claim is for nealry £6,000 and still hoping that ehy will pay up before next Wednesday (everything crossed) but thank you for the advise about the next step if they dont pay up. Well done and enjoy YOUR MONEY:D

Hiya, Can I just ask as Nationwide now seem to be actually putting in a defence what would be the next step if they do not pay up, as most people at this stage just seem to be waiting for the money to go into their accounts! What happens if they decide not to pay up, does this means it goes to court no-one seems to have got to this stage YET!! They have until the 13th June to put in their defence with my claim and nothing heard as yet (I used the N1 way) and nothing in the account can someone just prepare me for the next stage JUST IN CASE.   7. I think its cause they cant bear the thought of all that money going back into customers accounts!! Remember they make money out of people with no money and have to give it to those who do, so thats why they like to hold on to it for as long as they can every day in their account is a bit more interest for them when its in our accounts they have to pay us interest!! Keep ur chins up and soon our accounts will be a little more healthy, worth every minute waiting:p

Hiya Sittinpretty71, There is a thread on here that Nationwide put in a defence of already paid but when the claimant checked his account the money had not gone in, so he phoned the Customer Experience Team and asked them where the money was and they apologised but there had been an error in paying him but they would sort it out that day. Can you not contact their Solicitors and ask what their defence is as they might have done the same with your claim. They seem to be delaying payment anway they can at the moment. Good Luck!
  9. Hiya busa, This is normal Nationwides standard practise to delay paying you even longer. Are Evershed their Solicitors? They have until the 13th with my claim to put in a defence so a couple of days before yours. Sometimes they are even putting in a defence just to delay it even more so you have to patient and keep smiling.... or atleast try anyway. Good luck with your claim.
  10. Hiya, Unfortuantely the Nationwide seem to be delaying even more noe and they are even putting in a defence with some cases so they are not so quick at paying up. There are a few threads on here that the deadline for a defence has passed and they have not heard anything from either their Solicitors nor Nationwide. They have until the 13th June to enter a defence or pay up with my claim but as yet not heard anything. So am going to have to fight even harder for my money!!

Hi Girlybiker, I have been reading the threads on here and I think you best way is to write to their Solictors Eversheds and give them another 7 days to either put in a defence or pay up, just to let them know that you are being more than generous as they seem to be ignoring you and the courts requests. There is a link on here about entering judgement by default and its not that easy I think MilktrayMan has a court link on here read the Judgement by Default first. Nationwide have until the 13th June with my claim and I've not heard anything yet or had any money put into account, they seem to be becoming quite awkward either that or they cant keep up with every claim. I will be contacting their solictors to remind them that they have until 13th June next Monday as someone had sucess this way if no defence is put or they dont pay up! Good luck!
  12. Hi everyone, If you read Sarahlou V Nationwide you will see they actually put in a defence against her claim and it was heading for the courtroom. I dont know weather this is going to be their new tact tick now just to draw it out even longer but they did pay out before it went to court so I think they are trying to scare people now by putting in a defence, so be prepared. They have upuntil the 13th June to defend my claim so just have to wait and see. Good luck!

Hi Dunk101, If you read some of the thread on here you will see if you write another letter to NW Solicitors giving them another 7 days to either put in a defence of pay up it might be in your favour, as sometimes even having a Judgement by Default does not always guarantee you get your money. Read the court links, Judgement by Defaults which is on a thread that MilkTrayMan has put in. I am waiting for a defence to be put in they have until the 13th June to do so, but having read some of the more recent threads, it might now even get to court so I am reading up BIG TIME!!

Hiya Mars32, I am still waiting to hear still not put in a defence and still no maoney in my account, but after what I have read on here Nationwide like to take it to the wire, so might even have to give them another seven days after the 13th June before filing Judgement by Default, will remind the Solicitors I think on the 13th if not heard and watch and wait. I have my bundle ready anyway if I have to go to court but wait and see what their defence is first. Keep hanging in there!!
  15. Hi Mars32, I filed on the same day as you and my claim is for nearly £6,000 with interest and I filed the same way N1 at the local court. I have received the Acknowledgment of service today to say the are defending so got to wait now to see if they put in a defence, what have you heard since?
  16. Hi Sarah Lou, I've received the Acknowledgment of Service today saying they are going to defend surprise, surprise so have got to wait again now. Dont know about the hearing not got that far yet but 5mins doesn't sound long enough so have you had a date for court then?
  17. Ok, received Acknowledgement of Service today and they are defending, Surprise, Surprise. So another 28 days to wait. Keeping a close eye on the account now so fingers crossed.
  18. OK, Story so far. Issued 1st letter to reclaim charges totalling £4595.50 on 23rd March (took this to local branch) received letter saying no sorry not repaying these charges on 31st March. Sent LBA on 7th April by recorded delivery which they received on 10th April. Received another letter exactly they same as before dated 13th April only saying further to our on-line correspondence!! No correspondence has been don this way but never mind they ignored the LBA, so we filed with the court on 14th May deemed served on 16th May and are still waiting for the Acknowledgement of Service which runs out on 30th May, so I wait with baited breath as to if they are going to defend or not, looking at the other threads on here I expect we will receive notice before 30th and will have to wait another 28days for money!!!! Oh we also recevied yet another letter from them dated 17th May exactly the same as the other two saying they wouldn't be repaying the charges, but that was in response to a letter we sent on the 12th May telling them as they had refused to pay the charges we were filing with court as they had had more than the 14 days to reply to the LBA which they received on the 10th April.
  19. Thats Brilliant Big 'T'!!!!!! I still havn't received an Acknowledgement of Service which runs out on the 30th May I did it the N1 way took the documents into the court if I don't hear anything today will ring on Tuesday but I think they are just delaying it to give them another 28 days if they are going to defend, keep checking my account but nothing gone in as yet!!!

Hiya Everyone, I filed on the 14th May against Nationwide deemed served on th 16th not received Acknowledgment as yet but received yet another letter (the 3rd) last Saturday saying that they wouldn't be paying the charges Blah, Blah, Blah exactly the same as the other 2 letters received so they have til the 30th May to reply so will keep up updated.

Hi Kitesurfer, I avoided all confusion with cheques/P.O. by taking the letter and £10 in cash to my branch where they politely wrote out a receipt and siad they would send it to head office, I received my statements well within the 40 days allowed. Now at Court Stage having only received one reply after the initial request for payment so waiting to see what their next move is. Good luck with your claim. Regards McWills
  22. Hi Sarah Lou, I filed last Monday with Nationwide and it was deemed served on the 16th so waiting to see what they do they have got til the 30th May. I have been reading quite a few threads on here and apparently its a good idea to keep an eye on your account as they seem to put the money into here in dribs and drabs so I am watching and waiting at the moment. I cant wait for it to be over either as my claim is quite high and worry that it will all go pear shaped at the last minute, which is just my luck. Hope you win keep my fingers crossed for you.   23. Well done, I have filed last Monday the 14th against Nationwide and it was served on the 16th. Apart from the court form saying the would defend the case did you receive any notification from Nationwide about paying the money into your account? And when was your Court date for? My claim is for nearly £6,000 so was wondering if they would do the same as we have only ever had one letter from them and that was after the first request for payment the usual sorry cant refund your charges etc, etc. Not had anything since!!

Hi I have just read this thread about the Test Case/Multi Track I have just filed with the Court against the Nationwide my total claim is for £5,900.oo does this mean I will have to go the multi track way through court as I would not be able to afford the costs the claim before costs and interest was £4,595.50 does this make a difference? Especially after the win for Lloyds the other day.
  25. Hi, just received Claim No from Court feeling a bit nervy after yesterdays ruling. Have done everything by the book only received one letter from Nationwide saying that wouldnt be paying the charges as it wouldnt be fair on other customers, they even offerred us another overdraft if we were experiencing difficulties (we are not even overdrawn) cant believe the cheek of them! Our claim with interest is for £5,889.94 so we had to pay the £250 court cost, but got to be done as they didn't reply to LBA which they received on 10/04/07 checked this by phoning them but they still did not reply in writing just said they were inundated with claims and working through them. Filed with local Court on 14th May so waiting for a reply now. Would it be worth sending a letter to the Financial Ombudsmen Service as this way seems to be having far better and quicker results or should we wait and go through the Court now as the Nationwide always seem to want to close your account after court action. Any advice would be greatly appreciated. Also because our claim is over £5,000 would it be sent the Fast Track system or could it still be dealt with by the Small claims system as I wouldn't be able to afford the costs the other way.
